USCIS decided to take our $604 and give me an my wife APs in 9 days! They seem really efficient when they have to take money from us. But really slow when they have to approve GC applications (EB2, PD of Dec 2004). USCIS just seems to be interested in 'extortion' payments to employ USCIS staff - more a lawless mafia than a organization upholding the law!

It is unfortunate that people don't even try to understand the issue and just go about complaining it.
Most people can't even differentiate between what is law and what is not. What are difficult things to accomplish and what are not.
It is absolutely imperative that 5882 pass otherwise the situation will continue to exist.
Here are the my estimated waits for EB3-I
PD(end of the calendar year) and its corresponding wait in years
2001 1 year
2002 3 years
2003 4 years (Bad economy in 2002 and early 2003)
2004 7 years (Case surge in 2003 and 2004 due to booming economy)
2005 8 years (fewer cases in 2005 due to PERM)
2006 10 years
2007 12 years
2008 .....
I think we are fighting the wrong fight. I do recognize the whole EB system is unfair and in particular to I/C/M/P.
The letter campaign is a great initiative, but I am not sure if we are focusing on the right problem. By saying that the new "interpretation of the spillover" is cruel to EB3 I/C/M/P is plain wrong. Both old and new interpretations were unfair to EB3 I/C/M/P.
Old interpretation resulted in good forward movement to EB3 ROW while EB2 crawls.
New interpretation results in good forward movement to EB2 while EB3 crawls.
How does EB3 ICMP benefit from both the interpretations?
EB3 is clogged because of the 245i cases. Unless we focus on the exact problem no amount of letters to lawmakers will not yield any result.

I am anticipating DOS will turn EB2 current in the second half of the year and this will ensure all the spillovers will flow into EB3's because EB2's with PD mid-2007 to now will not be able to clear the NC 180 day barrier. This is what i am doing to call a cell phone or any land line in india. Vonage has a call forwarding feature. Simply log in to your vonage account and go to features and configure the call forwarding feature.Configure such that the call is forwarded after 20 sec's. Intially vonage rings and after that it is forwarded to the india cell or landline forwarding number. Its free of charge as calling from vonage to india #'s is free. Hope this puts the debate to rest.
Why do I need to do all this stuff to call india cell or landline I can do that as such directly through vonage device. My question is how do we call from our mobile to india mobile through vonage. Lingo gives the feature of calling from your mobile number to an indian landline but not indian mobile. I am not sure if your way solves this problem.

Just a couple of comments about Heathrow. The mainland of Britain was plagued with the IRA bombing it periodically for decades which forced them to be diligent about security long before the USA knew what terrorism was. Being security conscious has become a way of life on that little island in the North Sea. Just try finding a garbage can on a railway station platform? There are none so the IRA could not plant bombs in them.
Now about the staff at Heathrow. Surely anyone with eyes that work can see most of them are not British at all but immigrants of some variety or another. A true Brit is a very friendly individual. The invasion of their island during the past fifty years has changed the face of the entire community, not all for the better that is for certain.
And finally, transit visas etc. If they are needed and that is the rule and you cannot find a different route then it is something that has be lived with. The US had them and still has them for certain nationalities, the UK is certainly not on its own. I have been living in the US for almost a decade now and have been stung by their immigration rules as all of the contributors to this forum probably have but we chose to come here so have to put up with the system.
We all have choices so if you do not want to get transit visas just choose a route that precludes the need for one. Ten pages bad mouthing the UK is not helping anyone it is just antagonizing those of us who originated there.
Just because the majority of immigration voice are Indian it is certainly not all and I think that gets missed on so many occasions. We are in the midst of the US immigration system together, or so I thought.
Every country has its own rules, some will be in our favor some will not but if we choose to go there we have to live by them. It is entirely NOT appropriate to expect countries we visit to bow to us on any level!!!!!!!
i do not know why there is any bad mouthing of the English frankly...this has nothing to do with the people or even the city in question. my only visit to London was wonderful, i would happily visit again. i would though avoid transiting through Heathrow for reasons i explained. this is a govt policy- right or wrong and finding historical/colonial reasons is silly. it has a lot do with visa overstays as well, as was discussed earlier.
just to clarify the issue itself though- and trying to keep it to the narrow focus- the direct airside transit visa is literally a run about created to check people that get off a plane at one gate and climb another plane at another gate- in some cases even the same plane! i do hope our british friends at least realise that it is a major pain to obtain visas to be able to do this- and it's not some kind of anti UK stand to avoid flying through LON (and other such airports) that enforce this. in the end it does create some bad feeling- i wish that were not true- but perceptions are fickle things. it's too bad though that everything seems to become about some wounded national pride or historical wrong or suchlike. wish we could all grow up :-)
btw, since we have some engaged brits listening....is it worth the money to take the chunnel between paris and london? anyone done it? what's the best way to find cheap flights in europe? local insight would be much appreciated!!

Yes, They assured me that the plan is for unlimited...also covers all the networks (Initiall y some of them thought that it's only applicable for certain networks)....there is no restrictions at all...any ways I will re confirm with them.....
The only problem with them are taxes, there are other VOIP phones in the market that they are charging just 3-4 dollars as taxes, whereas vonage is charging more than 8 dollars which is killing part.....

Emirates is good. No TV hassels. JFK to HYD trip is good because it starts at 11pm but on the way back it was little painful because you start your journey at 4 am in the morning and if you are a person like me who can't sleep at irregular hours, then it can become painful sitting for long time in the flight.
We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I stay pretty closer to Harrisburg, PA ...thanks

I had my interview on Jan 14th for H1B extension..same company after 3 years..fortune 100 company..VO said approved..but i have not received my pp yet. Its the 18th day and in weeks this is the 3rd one.
My brother also works for the same company same mgr..he also went on the same day for his stamping. His F1-H1. his VO was different..he got his pp after one week.
Have there been people waiting more than three weeks ?? what is the worst wait time for someone here on the forum ??
I have already postponed my flight twice..since i have to take my dad along..i have also postponed his flight twice..this was a family emergency travel and not a vacation..still its so painfull..and like everyday there is a wait..

Every 485 applicant needs to submit birth certificate. If in regional language then get it translated in english. I dont know any place/person for translation, but you would need to submit english version.
Do we need the Birth Certificate for secondary applicants(spouse).
None of the checklist(Employer based I-485) I have been thru say that I need the secondary applicants Birth certificate.
My spouses Birth certificate is in a regional language, and hence the question.

First of all thanks a lot for your reply and i further have some question if you could please help me understand that. the situations is that I have given my New I140 (EB2) to my lawyer and all he did was took a copy of my I485 receipt notice and said he will send that to USCIS. My PD on EB3 is Feb. 2003, how would I come to know if my EB3 PD was ported to EB2 by that I mean to how I would come to know if my I485 was ported to EB2 and still have PD of Feb 2003...

Good find apnair. The bad news is that this bill is getting delayed. But atleast it gives us time to get organized and better shot at making sure that the EB based GC issues are not missed from the bill.

I think it would be fair to split the leftover numbers the same way they split whole year quota.
50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?
I'm wondering why you ask this question. It's not your or my perception of "fair" that will drive the DOS or USCIS but the letter of law. The law is not easy to change but the interpretation of the law which shows up in the US Code (USC) can be changed. Therefore the DOS changed their interpretation to match the INA better and my or your perception of "fair" will not change anything. On the other hand it will only lead to heartbreak and destructive discussions that lead nowhere.
