Unfortunately, you are showing your culture here with responses like this by clearly proving that you are incapable of provding a proper response. Just so that you know, this fax communication from AILA does not say anything about "Employment based green card provisions".
It only talks about guest wokrer program and opposes HR-4437.
You may choose to support AILA campaign and send out faxes from their website for opposing HR-4437, that may help too. Just know that you are not directly supporting "Employment based provisions".

VO doesnt keep your passport if a via not issued at the time of the interview . He gives it back after the interview. Once you receive the email , you have to go the VFS office and then had in the passport.
I guess this is specific to Mumbai only .. for all other post in India, the consulate/embassy keeps the PP ...
Am planning to visit India during Apr-May time and wondering how to take care of the situation ... seems DHS/DOS/DOL/USCIS/Who ever implemented a process without having the proper infrastructure in place ... and again they take us for granted ... with limited number of vacation days in hand if we stuck because of the PIMS, this will be a difficult situation to handle ..
How the Kolkata consulate doing on this aspect ... can anyway share their experience there ...

We are travelling next month and our travel agent wisely suggested and booked tickets for us via frankfurt by air india. He knows that london is a problem especially when you are coming back on AP.
After reading thru the painful story of milind, I feel that I should never go thru london.

IMHO you misinterpreted the memo. An employer can definitely choose not to hire based on immigration status. This has happened in the past (circa 2001) and evidently many employers do not hire H1B or any employees that require "job related" sponsorship. From the same link, in the next para it says that employers can clearly specify that they will NOT do sponsorship without violating the law. The only question is what is considered a sponsorship, any restricted position (in terms of job responsibility) can constitute a sponsorship (where by employers have legal burden beyond what it takes to hire a US Citizien/Permanent Resident for the same position). H1B definitely falls into this category and EAD borders that category. I am not an expert in labor laws but my experience says that employers have too much control on who they want to hire they can get by with almost anything. The biggest hurdle against any law suit is, EAD is an obscure document with very little clarity about rights that come with it and its usage. It was supposed to be an interim document whose usage only now is becoming main stream. May be one law suit or precedent will clarify it all. But once again employers will get by it the same way they get by with age, ethic, gender and racial descrimination.
The bottom line is if a corporation has decided upon a certain policy (how much stupid and discriminatory it may be) it is futile to fight it becasue they will do it one way or the other. It is better to find an employer who respect your talent and what you bring to their organization as opposed to what kind legal papers you are carrying. What's happening with the EAD situation generally happns in a tight labor markets and we are in one now. In 2005-06 these same employers were fighting with each other to get as many H1B by filing twice the application allowed on the same day and now suddenly EAD is a problem. According to this website Capital One has 1200 H1B's.

I hope I am totally wrong, but you never know.

My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

I just came back to US using AP, I had booked an appointment for Visa interview. But after seeing the PIMS mess I decided to use AP. It was very smooth and easy.

Now the only way to use AP is to withdraw our visa applications, get the passports, and fly back. I will resort to this ifthe passports are not returned by the coming weekend. Chennai consulate sucks!!

For USCIS isn't the date received that matters not the date postmarked ? Never heard them honoring postmarked date. I could be wrong though !!!
If its mailed out today, then you are ok. Its the POSTMARKED date that is seen. So even if it reaches there in July, as long as it went OUT today, they will have to accept it under June's batch of applications coz it is postmarked in June (june 29).

...is getting approved. My case is with an IO since Aug 3 and going by the trend, I should have received an update by now (within 2 weeks of getting assigned to the IO). Not sure whats going on :( This is the worst ever wait in my life. Wonder when its going to end???
