With Eb3 India the Horizontal spillover methodology kills most hope as there is the large Eb2 India backlog. In 2007(I think) the vertical spillover methodology was followed and Eb3 India got 17000 or so visa numbers. So with Horizontal spillover and no number increase I am sorry to say movement is limited.

DOL backlog gets cleared in 6 months. Return of Visa revalidation. Begin of I-140 premium processing etc. etc. Skill bill is too good.
Friends...please...the CIR is still better than the present situation we are in. It increases the H1B numbers, it increases the amount of GCs availbale per year, it excludes dependents from the quota, it excludes STEM advanced degrees (currently employed as well as future students) from the quota, it does require the illegals to wait at least 6 years before they can file papers for their GCs and then thay get to be at the back of the line, additionally, if the SKIL bill provisions are also included as amendments, it will also provide a premium processing facility for I485. The SKIL bill also mandates the DOL to clear all backlog within 6 months. The thinking is that by the time the undocumented aliens (somehow, I do not like the word illegal) enter the pipeline, the current backlog will be cleared and all dates will be current.
Given, the uncertainity in the process right now, I still feel that CIR is the way to go. Also, if it were not for the issue of the undocumented aliens, there would have been no incentive or push to do anything about the system and we would be stuck with this system. As far as the USCIS efficiency is concerned, I would not underestimate them either, the USCIS is known to be very efficient when it needs to (prime example the spectacularly efficient and successful H1 B premium processing system) so keep the faith and help yourselves achieve your dreams :)

I think you should go to either Eatentown( Exit 105 on GSP). Before they started accepting all immigrant applications at all DMVs they used to ask every one to go there. I think you may be able to get a temporary extension for month or two.

We literally reopened a closed factory in Ohio to start this R&D / manufacturing company. ( Politicians have been making a lot of noise to revive manufacturing economy in Midwest)

For those of you who qualify, HSMP , I think is a much better option. There in UK the permanent residence is not dependent on employer and you can do your own consulting. Typical bill rates are 350 to 600 GBP per day based on skill level and years of experience.

In my humble opinion, if people who have been illegal in US for over 5 years are granted legality, then the govt should
1) Close the backlog processing centers where our cases have been languishing for years
2) Grant us green cards if we can show minimal proof that we did infact file for permanancy legally at some point in time.
I mean COME ON guys..the government is giving legal status to more than 10 MILLION illegals in this country, yet when it comes to 300,000 tax paying, qualified, LEGAL, degree holding H1B workers, the same government is penny pinching and trapping us in a bureaucratic paper nightmare. What is 300,000 when compared to like 13 Million?? Its a drop in the bucket. Do not forget that our employers have paid big bucks for every H1B, and additionally paid for the creation of the backlog reduction center, where they are painstakingly poring over each and every case with a toothcomb.

I think we should start a blood donation campaign to impress upon him that aspiring immigrants will not be found lacking in caring for the US army soldiers.

As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.
A country cannot be built with only the kings, and not even a home can be built with only Ph.Ds(Nobody do the dishes).
Unfortunately, Americans will claim that there are lot of Americans who can build homes and therefore no immigrants are needed to do that. They are less willing to do PhD so there is a demand for immigrants.

To make an impact, we need in the order of 50,000 to 100,000 letters with their personal US address on it. Anything less doesn't hold any water..
Are you kidding me. Nobody will write personal address on a letter. Even if they write one, it will be a fake address. and forget 50-100 thousand letters. Even IV members are not that many. Have you ever wondered where all the applicants are when we say there are 500 thousand or 1 million backlog?

Don't worry about this bill being rejected. I am pretty sure one way or the other they need to increase the EB visa number soon, else definetely USCIS will be in big trouble with thousands of applications sitting there for them, now having said that USCIS will find a way to get some bill which will have EB visa count increased passed in congress, so untill then cheer up and complete your filing.:) :) :)

Is there any thing to do with I-140approved/pending with I-485/ead/ap processing?
