I have a total of 15+ yrs exp in the IT industry out of which 8 yrs in USA. I am also an EB3 :) BTW I have a 4 yr engg degree from a small college in india :p

I am totally pissed off with this system. The only wrong step which i took was applying in EB3 when i had three years of experience. Now i have a total almost 10 years experience in IT and still waiting like an illegal immigrant for GC.

Hi,
Sorry about your employment situation.
If you think it is serious enough, I strongly recommend getting an Attorney's advice on how to transfer your H1B smoothly and also to clairfy any questions that you might have.
Paying few hundred dollars for attorney's consultation is worth the peace of mind that you get, once your questions are answered.
Murthy.com, shusterman.com etc are some of the good ones that I know of.
Good luck and donot worry too much (as these kind of things never stops occuring in life).

Guys as a RULE. Pls contact the Core members before contacting ANYONE no matter HOW pro-immigrant we think he may be. Let that be a policy of sorts. Just talk to ANY one core member and discuss it before u take any action. Media exposure is a double edged sword so let us please be careful as to who we contact.

Hello Gurus,
My I-140 was recently approved. 140-485 filed concurently in July 2007. I have a new job offer and plan to use AC21. However I am worried because the wages at new job would be significantly higher than the old job. There are two reasons for the big difference
1-Desi employer v/s corporate employer
2-Dallas v/s New York
Any comments from people who have faced similar situation will be highly appreciated.

Maybe I am missing something here but the green card for this beneficiary was started in 2005. The PD of 2000 is due to a labor-substitution. Aren't those the facts here?
I was referring to the whole inefficient, time consuming immigration process. One does not know how long folks who missed the AUG 17 date have to wait!!

Called USCIS and they are asking me to take an Infopass appointment.
Update1: Infopass appointment was not useful. They asked us to wait for the notification from MSC.
Sorry to hear about that ... try taking another infopass ... they should assist.
Like dhundhun said there must be a procedure for shuttling packets between offices
(When we did a infopass for EAD delay - we got a really good rep - but for a friend of mine the rep was less than helpful - for the exact same thing)

Hey its Guidi again,
I too have had that un-even focus problem. The photo was in focus on the right and out of focus on the left. Very wierd. Nikon told me it was a depth of field problem but both subjects were standing exactly at the same distance from the camera.

I have a Ph.D and 2 M.Sc in Aerospace and Mechanical Engineering. I got my H1-B and I also have been employed for 3 months now. My company policy required 3 years before sponsoring me. I do not want to wait that long to start applying. How can I tell if I am qualified for EB-2 with National interest waiver? Is that the only way for me to get GC?
I also want to mention that I have 5 proceedings papers but not journals. I also do not have any citations for my proceedings papers.
Please advice me what is the best senario for me and if I have any chance to apply for EB-2 with NIV.

well said and I agree 100%. it is not as simple as saying that by buying now you are saving 12 months rent. (for one, you get a place to live which has flexibility..though smaller). if you need it now as said above it makes sense (and I would say if u need space because grown up kids need space or you have other family member staying (like parents etc) ..)
I agree Texas did not see the boom that was seen in other places and hence is relatively a better place to buy. that being said, I guess it depends on location too ..even in good places (all except the super bubble states of CA, FL etc) ...make sure that location looks good (good school, less crime) ..and at the same time ..easy commute (who knows ..gas maybe $6 and rising in future)...ino ther words even in TX, if the houses were built far away ..then they too will fall in prices

The fact is, the American is well equipped to deal with $6 prices. The reaction we see is is just due to the unpleasant thought of having to pay more. It is not a showstopper by any stretch of anyone's imagination. At the worst, it just means they will have to cut back on annual vacations which is not a big deal for us, but obviously a catastrophe to the average American.

Just talked to an IO. My case was filed between July 3rd and 15th at Nebraska. I didn't get the receipt # , but the IO gave it to me over phone. Surprise surprise!! The case was transferred to california service center and my rcpt is a WAC number instead of a LIN number!!
For example, check: wac0725850164
That's why NSC is compliant, but people haven't received notices.
I hope this reduces some FUD. If you do not find this info useful, move on!!
