    This idea has some serious chances of getting through, if pursued. The biggest thing in its favor is the validation in the form of existing H1B quota for US educated Post grads.

    It will find extensive support from universities/academia for obvious reasons.

    Main opposition to this issue would be from non-us educated people who feel that they would be left out. Unfortunately, they will be overlooking the critical side effect that this provision would relieve pressure on current EB numbers.

    Each MS student invests atleast 20k for his program [average]. He/She doesnot get any benefit from taxes. However, its the university benefits from foreign students. If you take CS/EE/science program atleast 50% of students would be foreigners [avg].

    One of the main reasons why a Master's quota of 20k was added was to retain the "US educated" talent. I suppose we could argue on similar terms for GC quota for Masters students.

    Depending on the education requirement on the labor certificate and how the lawyer responds and how your evaluatoin is done, you could have an excellent chance. I am an evaluator and we have had most MTR's approved with a 3+2 or 3+3. There is a good deal of documentation on your side. I will be happy to examine your documents if you have not yet filed and do a no charge analysis. Anyone with an RFE or Denial based on education can go to www.cciFree.com/ and fill it out and send all of the documents.

    My EB2 was rejected initially but later approved due to Sheila's evalaution of my CA degree equivalent to master's degree. I did not know her but my lawyer insisted to get it done through her. She was good for me.

    Let us see if we can get at least 200 people who vote on this. Many the great souls are talking about complaining to USCIS about EB1s getting GCs using shortcuts. Some of them suggested LET US write to ombudsman office and USCIS & blah blah. Let us see how many folks come forward and vote for this.

    I agree. They have to follow well set guidelines.

    I would say - those having issues must all get together and write to the Authorities asking them to update rules on website and not arbitrary.

    seriously? you working in some gas station too? what other advantages have you taken of the system?


    Sad to see students being punished like this. They are just taking advantage of the system and make some money, but not doing anything illegal. That's what we are all here for right? Make some money. If enrolling for F1 and working somewhere else is against rules, then why did USCIS issue F1 and CPT to the students.

    06/27/2007: SPECIAL ALERT: I-485 Cap for FY 2007 Can Be Exhausted Before End of July? Then What Will Happen?

    According to the AILA, approximately 40,000 visas remain in all employment-based categories, other than EW, for FY2007, according to its sources, and that the USCIS has far more than 40,000 adjustment applications in the backlog queue that are ready for approval, not to mention the additional numbers which will be consumed in concular immigrant visa processing. It is thus possible that the cap may reach within a short period in July, even though no one can predict it until after July 2, 2007. The USCIS at this time does not have any policy announced with reference to July 2007 I-485 filings which are filed after certain date in July when the total number is exhausted. However, considering the fact that the USCIS currently rejects the "Other Worker" category I-485 applications even though June 2007 Visa Bulletin show current for certain applicants because the "other worker" category quota was exhausted on June 5, 2007. This raises a serious concern because as we reported earlier today, the USCIS appears to be picking up the speed of processing of backlog I-485 applications in anticipation of flood of July 485 applications. The USCIS hands may be tied, should the EB visa numbers for FY 2007 is exhausted before the end of July.
    The situation is particularly critical because of the USCIS decision not to accept the I-485 filings without the medical report. AILA demanded leniency but the USCIS reportely refused to accept such demand. Since medical report is "initial evidence" to I-485 filing, under the recent rule change, any I-485 filing with the medical report can be rejected or denied. Reports indicate that there are a huge backlog in scheduling medical examination in most of the areas in the country.

    My received date is July 3rd for 485, I140 approved July 18, notice date June 26, 07. for AC21, Is my safe date Dec 30th or Dec 31st. Should I be working on the 31st December for current(485) employer or I am safe today?

    1. His salary CAN be raised.

    i don't claim to know the answer here.

    2. His wife CAN work, as article mentions that he applied for GC in 2004

    If he is EB3 india, that may have been true till very recently

    3. I never heard about 1 million - I guess we were talking about 140000 unused visas right? Where this 1 million came from?

    the article quotes the Kauffman Foundation report. Please read it. There are about 1 million applicants waiting at various stages
    4. If the company is bought - one doesn't generally reapply for GC.

    maybe generally true, we don't know it's untrue for him though.

    Even little lies don't serve a good cause as this article can be easily discredited.

    That's was his/her problem. If the person have not notified the USCIS about the job change, everything would've been fine :) I am not going to argue with you. If one of hundreds thousand cases had an issue, it does not mean we have to rush and file AC21 every time we change a job. That will just create more work for the USCIS and increase our chances for RFE/denials. That's my opinion. You are entitled to yours. BTW, I changed jobs and did not file anything. No problems.

    Goodluck to you, friend! Just hope Murphy's law doesn't strike you!

    I have not used AC21 and am not planning to use it. Although it is easier for me because I am a Registered Nurse and it is easy for me to port from one hospital to another. My strategy is different though. I am not leaving my sponsor and just working for another hospital in my free time.

    What do you say about your problem when you take InfoPass. You can't take an appointment to just ask what is happening to your case, unless several months have passed after all sorts of dates.
    I dont belive it when ppl take silly suggestions seriously. We should know better having been in this mess for years now...

    We can do better than this. Let's book tickets and fly to DC. We must participate in this event. Please take two days off and be in DC, and if you do not have enough vacation time, take one day off. Please contribute to this event.

    We live in NJ and my husband was not ready to take a day off initially, I was going to come with friends and now after bugging him for days together I finally showed him this message about people flying in from CA and well he is motivated to come, he plans to work remotely on the 17th the lobby day, we are bringing some friends visiting from India too;)

    What is DHS 7001 ?

    I got an automated response from ombudsman saying that I will have to fill out a formal inquiry in the form of 7001. That's the form to fill out if you want ombudsman to inquire into your case.
