Here is my situation, someone please suggest me:
I am using EAD to work for my GC sponsoring company and I got laid off. My HR says that they are going to inform USCIS that I am no longer working for them. HR also says that they won’t cancel my approved I-140 and going to rehire me once I get the new project.
My question:
When I joined them there is information to USCIS.I just filled I-9 form and gave it to the company, no information to USCIS. Now when I got terminated what is the need for the company to inform this to USCIS? Anyhow I am going to join them once I get the new project in couple of months. Is it a new law? Will there be any problem at the POE if travel outside US and come back using AP? Is there any chance that USCIS sends me RFE?

I have read about some cases where ppl who had one of the PDs current, tried very aggresively and got their 485 approved. I have not seen many cases though. Everytime I research on interfiling, I always find those couple of cases so in my opinin, interfiling is not very common. Its a unknown territory as its not a paid service from USCIS.

This date movement could also be to silence amendments like Cantwell's which are based on Backlogs. A parallel GC system to Point based was called a poison pill by Sen. Kyl. I guess may be this is a way to lock up one of those pills. Could be Chertoff's trick to mine-sweep the path for CIR.

Ivaka -I am sorry I dont know about checks cashing because we are doing through a company attorney - company pays for our GC expenses..

Can somebody explain how unused visas are recaptured?
Will unused RoW EB-1 be given to the most retrogressed category (EB-2 India)? Or will they go to EB-2 RoW? What does the law state? Will per-country quotas apply when unused visas are used?
There is no clearcut guideline on how overflow is supposed to work. From people's experiences this is what USCIS has been doing:
unused RoW EB-1 goes to RoW EB-2
unused RoW eb-2 goes to RoW EB-3
until the last quarter of the year unused RoW EB-3 stayed unused.
In the last quarter, unused RoW EB-3 spill over into all other countries irrespective of whether the country has hit its cap or not. a complete free-for-all...

My 140 got approved yesterday! Just 7 days after they received the response to the RFE. :D
Btw, someone asked abt 3 yr or 4 yr degree. Mine is 4 yr degree.

Hello cool_desi_gc,
I downloaded the access database but could not find employee name in there. Is there any other way to get the labor record? Also I don't have the labor case number to match to this record.

Does anyone know whats the protocol for the Bill to be passed???
After the Floor Debate the bill goes to White House or again there has to some measures taken from Senate???? I know there some initiative taken in Senate (last year)..

I am a little concerned with the timing of these developments. I am in the same boat as everyone getting ready to file 485. But I am equally worried about this. These messages are not even getting enough attention and getting pushed down the active list.
They might pull the Rug off from under our feet while we are clamoring about various 485 application issues. Everyone should keep an eye out for it.

Well here is what I have thought of doing if I get into your shoes when I140, US GC looks dicey. (I already have Canadian PR till August 2010).
I would take a three/four week vacation and go and live there. Prepare for a job and get first hand ground feeling of what it feels like living in Canada, make a living and raise a family. After all making a living to able to support yourself is a important corner stone thing. You can't live of fresh air.
Can you compare your situation ? No. You are not the same nature, skills, personality, intelligence and willingness as others and most of all your own Luck. You know yourself best and the only way you can tell that the place will work out for you is when you go get a sample for yourself and your gut feeling. I went to Vancouver and just loved the place. My wife saw the clouds and gloom and hates the place (spoilt by southern california). You will be your best judge.
Take the harshest sample: Winter is tough in Canada. Go now and take a feel of what you will be expecting and set your expectation.
Info: Approx 90% of the Canadian population lives within 100-200 miles north of the US border.
Down the road: Make a plan and see whats your options down the road. Looking back is no good way of planning for the future. 3 years + few months, you can be Canadian Citizen. You have then the option of using TN and come right back into the USA, if you even have the need. Looking back now I feel I should have started this journey 2 years back. In the next year or so I would be a Canadian and could have come right back without the 140 and 485 headache. After two years I am still holding my breath for 140. Rightfully, Heaven is where I feel at peace. US has made me feel miserable and bitter after 9 years of rough rollercoaster and no end in sight. Can't buy a house, can't live freely, always on the edge and mercy of the Boss and H1B.
Having Canadian PR in hand is like having a bird in your Hand, and US GC is like two birds in the bush (I feel the birds are in Bush in Texas :) and its going to eat me, rather than I eating it) You don't even have the US Bird in sight and the story is getting tougher....

also, i think u may need to maintain some sort of residence and retain proof of it (rent lease, utility bills, etc.) to show ur intention to stay here. even though technically GC is for a future job, an absence (even if its not continuous) of 5 yrs will eventually raise red flag(s)
or better yet... u can avoid all this adjucation crap and convert to consular processing (from ur home country) -- find out from a good lawyer to see if conversion is possible. if u r going to be out of US for 5 yrs, why would want to continuously renew EADs and APs anyway?

Indian companies like Satyam had been running these farce show of outsourcing for long time, and finally the reality is surfacing up. Not only did these companies run scam with their investors but also with their clients and employees.
As a client I see them initially low balling the real cost to obtain business and when the in-house engineering capabilities have been eliminated, they will start jacking up the prices. L&T did this with us and thankfully this month we are finally kicking their a$$ out of our facility. And we will do real engineering here in USA!
Couple of years ago, I ran into an indian at one of my visa renewals outside US consulate and he told me how, Satyam forged papers to have him slip into USA on L1 and than once here convert into H1 so he can finally apply and obtain GC. All these years he worked for remarkablly low wages.
Hope Satyam scamsters see life behind bars in India!

My status on USCIS Online case tracker shows,
"Current Status: Fingerprint fee rejected and notice mailed; case in suspense."
When I spoke with my attorney, he says, There are two options.
1. I can dispute and in turn get my processing delayed
2. Repay the fingerprint fees ($70) and forget about my first payment
Naturally, anyone would prefer option - 2.
Just wanted to share with you all...
Before I read the whole thing I thought why this guy is even thinking about it ... Know what I mean ...:) I read the whole thing and thought this guy is as smart as me ... hehe ...Good luck with everything
