These USINPAC folks are shameless creatures who will take credit for the sun shining tomorrow morning. Lets send this guy Sanjay Puri, Robinder Sachdev and his fraudsters team a dictionary so that he knows how to spell IMMIGRATION correctly even if he has some malicious thoughts and actions in his mind. All they are good at is to do photo oppotunities and do these frauds where they claim to have worked or be working on an issue. I can also do the fund raisers and get photos taken. But there is where it stops with USINPAC. The politicians walk away with the money and turn their back on them and these guys start looking for the next politician to do a fund raiser for and get photo opportunity. How much more foolish can this get??

I think what Godbless bought was Universal Life Insurance policy where the Company invests in Mutual funds etc. but that has lots of finance charges and hidden costs. Traditional Whole Life on the other hand has no such thing because by law the company can only buy bonds, govt securities and Mortgages only. Hence the return on Traditional Whole Life policies is low (5-6%) but they are safe and do not have hidden charges and infact insure you at a fixed cost for whole life hence the premium never changes and policy cost to the insured remains fixed while the cash value is an added incentive for the long term. It's like putting money in bank and earning some interest but having a life coverage at the same time for not just 20-30 yrs but uptil 98 years of age. I have a few family members who are insurance agents and they always recommend Traditional Whole Life if you have good income and patience to stay long. For all other folks Term is the best but note that when you retire at 60+ and have built immovable assets then to cover the risk for them you need to have some Life insurance policy and getting Term at that age is like walking on fire. Nobody gives Term after 65+ and even if they do so then the premium is very very hefty which can be a good turnoff.
So, it all depends on your priorities and situation. 95% of US Citizens / PRs with above average asset values & income buy Traditional Whole Life policy because they are living longer and working longer and building assets well into their 60+. Term provides good & cheap coverage for young people but only for max 30 years period. After 60 + people are in soup again without Traditional Whole Life coverage.

The instructions say this "NOTE: Please spell out U.S. Department of Homeland Security; do not use the initials "USDHS" or "DHS.""
You have written the most important words, atleast u did not abbreviate!
Also remember there is NO OTHER "department of homeland security" in the world. Check has gone to USCIS office. They know u mean US, even if u did not write it.
So I am confident that their banks will cash your check. Keep a watch on your bank online. Texas cashed our checks in 7 days and also sent receipt. Dont know how Nebraska is doing. Call USCIS in 1-2 weeks if they did not cash checks.
Worst case they will send the application back. You can then quickly fix the check and resend application. Hopefully if you have applied in time, then a delay of 1-2 weeks does not matter.

In my case, the request was processed at the local branch. I don't recall seeing an option on ICICI to do the wire transfer. But assuming there is, you should give that a shot. You might have better luck at the branch though .... RBI has the so called KYC - Know Your Customer rules for all banks and that may give you some leeway.
Did you mean the local ICICI branch ? I would appreciate if you could let me know the process that you followed to get the money from India.

as far as I know, you paying for H1b is not correct and is illegal and they will be accountable for this. Secondly, I heard the contract dont stand in court, especially when they are rude.
I think you have an option to report this employer to DOL/USCIS, for charging you the H1b expense. Companies should sponser H1b only when they genuinely need and can pay for the expense!
I am not a lawyer, so I recommend you consult one. Also feel free to communicate this issue to your employer and I guess you will be on your own!

you should possibly also carry a copy of the AP application. At least my application clearly stated that travel was for business/personal reasons...

I have travelled on AP and didn't have any problems..although the officer stamped a wrong date (one day earlier) on my passport..talk about incompetence

so can I just ask ... is IV planning any campaigns at all in the near future (i.e. in the next 2-3 months) ?

At this time we have request for interview from over 7 highly reputable media outlets including NPR Marketplace, NY Times, LA Times, AP. We have asked members to interview if they feel anxious about the current state of the affairs. Can you guess how may responses we have recd till now? Is this not part of the effort/campaign? There are few members who will spend whole day discussing sending pizza or fight over tracker data. But we struggle to find sincere members who are ready to interview with the top media outlets. This indicates to us, either everybody is extremely comfortable with wherever we are and no one is feeling the pain, or just 2-3 of us feel the anxiety due the economic slow-down. If over 30 members can discuss for a period of 3-4 days about sending pizza, and the objective is to attract attention for our provisions, then is it not possible to achieve the same with the available media opportunities. Getting media opportunities is a difficult job. And its extremely frustrating to see lukewarm response to the action items and request for help from the members. Please understand that there are many aspects of our advocacy effort. We may be focusing on a specific aspect at a particular time, and its possible that you want us to work on something else. It doesn't mean that we are not working on a specific campaign right now. So I am baffled by your question of doing a campaign in next 2-3 months.
It is possible that next month we may see new bill from Sen. Grassley and we may have to re-adjust our effort to respond to such a bill. Political events are not predictable, but we have to respond to every developing situation. We are always very sincere in the community effort, so I request to please support the effort, even if you do not agree with it 100%. And please participate in the action items, because they are always part of planned activity and is not an abrupt absurd idea.
Campaigns are not based on a specific provisions, even when everyone of us sees it in that light. Provisions are the end product of every campaign. But to achieve our provisions, there is a long drawn process, which includes multiple stages. I am not able to list all the stages in a single post. But I will encourage you to see this document -

I was about to send the e-mail and then I decided to clarify this before jumping on to it.
I am not sure if I am asking the right question, but I am just curious what is the point in sending same e-mails to the editor of the newspaper ? From my experience in talking to them, they seems to be looking for issues and when you have something valid they print. Also a single e-mail from IV talking about us (on behalf of 6000 of us) and the issues we are facing would have sufficed ? Right ? or I am missing something ? I know e-mail as faxes work for political campaign to show numbers but not seen it in news media ?

By sending more emails, we are making the media cognizant of the fact that its not one person but hundreds of thousands of people. Also, these emails are mostly read by interns and they sort them( In big outlets atleast) The more the emails on same issue from diff people with diff body with same bottom line story gives us a better chance. Any Ball park amount I should expect as attorney fee for the MTR ? I know some one mentioned about a CA attorney who does it for $500 but since I don't have H1 as backup , incase if I need switch back to the 2nd employer it is better to keep the current attorney ( 2nd employer ) . looks like he may not come cheap . they asked whether I want to file for Adv parol and it will cost attorney fee $800 . ( I don't have a clue why asked when my I485 is in denial stage) .
I looked at the I290B form and looks not so complicated.
But in this situation I do not want to take the risk of filing myself .

I-290B is pretty straightforward and I helped my friend with his filing and we were successful in getting his I-140 approval. Having said that, whether to self file or hire a lawyer will depend on the complexity of the case and the reason for denial. If its a straightforward case/denial (wrongful) and you have all the documents to prove it otherwise, you can go ahead and file I-290B yourself. Otherwise, hire a lawyer. Did you get the I-485 denial notice yet and whats the reason for denial?

I am no expert here but know that most of my friends did not have priority date current but were getting EAD/AP all the time. So once filed and accepted (receipt#) I am sure you would get an EAD/AP (the first one would come quickly 2-3 months) then extentions of EAD/AP might have a different outcome.

I agree that asking for complicated changes is a pain. But after meeting the lawmakers, I realized that this is the BEST way. Even the lawmakers agree and attest to this.
You are doing a reality check without even being there. Which, let's face it, is not really a reality check. It is more of your opinion and assumption.
Lets also not confuse facts vs opinions. The fact is that meeting lawmakers and educating them about our point of view is the key to this whole GC mess.
Let me ask you a simple question. What CAN be the "perceived benefit" from a rally like this that would make you think that it would be worth attending? Is it something like a guarantee for a GC in 2 months or a bill that passes next month that does everything we legals want? What is it?
Bringing attention to lawmakers about our plight. Bringing the issue right up to the Capitol. Bringing the issue up for even discussion in the various immigration meetings that are held every other day. Are these benefits not important enough for you?

But look at it this way......i already have my GC but i share the pain and frustration of folks who do not..if a 7 month wait process for me was frustrating - i can understand what a 7 year process would be to others like me....if people who are waiting saw the utility of the rally....there would have been more than 2,000 in DC.........but clearly they did not.......i was willing to give it a shot - but unfortunately could not and did not want to specifically postpone something else to make it to DC.......
People have been quoting Gandhi and his South Africa protests.........those were different times and different issues.........colonialism, racial discrimination etc.......if the american govt is non-responsive to the demand from 60% of its own citizens to withdraw from Iraq - how can we realistically expect it to react with super haste to our requests....besides gandhi had the courage to stand up to police brutality, get arrested etc.....in today's days and age - as white collared professionals - do we have the guts and will to do that? For example - we cannot even strike (non cooperation/ civil disobedience movement)....because we get paid by our respective private sector employers.....and our grudge is against the Govt - who do we strike against......?? and if we do strike or court arrest or adopt other forms of civil protest and by chance run up a police record in the process.......who would employ us in the future...in Gandhi's days - they did not have electronic background checks......!!
Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.

Are we here to improve america's competitiveness (if that was the primary purpose of our coming here - shame on us for not staying back and improving our respective motherlands' competitiveness) or our own future - if the latter - lets call a spade a spade.........

just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......

so - whats the "so what" from my post? is it to critique what IV is doing - no! The "so what" is - unless there are drastic and dramatic measures - concrete changes are not possible........small procedural victories - maybe........drastic change.....no way!
just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......

Green Card Visa Numbers Situation
• The GC process involves Labor Certification (2-3 months) + I-140 (0-12 Months) + Wait for priority dates to become current (several years) + security checks (1 month to 2 years) + I-485 processing once priority dates become current (18 months to 3 years).
• Yearly green cards quota for employment based applicants is 140,000. This includes visas for spouses and children. So on an average; it is given to ~ 60,000 families.
• Country visas limit is 7%, with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Generally speaking, for countries like India, approximately 7000 visas (~3000 families) were being issued every year in each of these categories.
• It is estimated that approximately 500K+ (yes 500K) I-485 applications under skilled worker category were filed between July 2nd and August 17th 2007. Most of these applications were from people of India and China.
• If you were unmarried at the time of filing, you will need to continue on current status (e.g. H-1B) otherwise you cannot bring your spouse.
• Employment Based Immigration reforms do not find enough support on the senate floors (Failure of SKIL, STEM etc Bills). As a matter of fact, it does not even get enough support to make it debatable, let alone final voting on the bills.
• USCIS is a self-funded organization i.e. it is run on fees it receives and is short on resources.
What do these jargons mean?
• Priority dates (PD) will remain retrogressed for several years.
• Those who could not file their I-485 now will now have to waitttttt…..
• Due to resource constraints, security checks may take years.
• Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
• Endless cycle of EAD renewals and Advance paroles.
• If working on EAD and for any reason, if any of your EAD gets rejected, you will need to stop working, In other words, need to leave your job.
• You need to be in the same position with same job responsibilities for an indefinite time period otherwise you Green Card application will be rejected.
• EADs are valid for one year and several employers (and rightly so) view it as a temporary permit and hence reluctant to hire you.
• Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
• So virtually you have three options: a) Struggle for several years b) Leave the USA c) Join us.
