AILA has reported that the EB-2 cut-off dates in Visa Bulletin in May 2011 may progress ahead substantially because of large unused EB-1 numbers since October 2010 since it has about 12,000 unused EB-2 numbers. Very good news from AILA and Mr. Oppenheim.

Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

You can't move to EB2 if both employer and position remain the same. I was promoted after working with them for 3 years!:rolleyes: Plus I have a Masters in Computer Science. My new position required more experience and a Master's Degree, hence qualified for an EB2.
Similarly, you can change employers and look for a better job. Then you can use the experience gained at the previous employer. But, ALWAYS, the job requirement has to state the need for years of experience or Advanced degree.
This helps answer my question. I am a little unclear about promotions and whether that will qualify one for a new labor, etc. I personally am not planning to change anything at the moment. My promotion, etc is not being stalled because of my status. So I am OK. Thanks again for your answer.

I plan to talk to my lawyer today. My past experience is that lawyers don't give all the options themselves. You have to know what options you have and then they will give advice on that.
So if anybody has gone through similar situation, please give your inputs. I am sure many other people can benefit from this information.

I got the following response for Ombudsman for AC21 mail sent to them a week ago. They need Evidance of I 485 denials to discuss with USCIS. The following is the mail I got. People who have been affected already. Please share this with Ombudsman..Let's keep the momentum going..

USCIS anticipates a substantial increase in the number of petitioning employers that will file Form I-140 petitions requesting Premium Processing Service and seeking labor certification substitution prior to July 16, 2007. Based on the June Bulletin, I will be filing my I485 in June.
Now, I have H1-B(with my current company till Feb'2010 that I just got approved a month back.(not stamped in passport yet)
-- Should I file EAD for myself ( I probably would want to change jobs after 180 days) ? Or is it better to be on H1-B.
-- Should I file AP for both myself and my wife(she is on H4) ?
Also, when I decide to change jobs using AC21 rule, is it better to tranfer
H1-B to a new company or if I have EAD, how does that work ?
Any inputs will be greatly appreciated..!!

If I were you, I would apply for EAD and AP for spouse and self immediately. You never know when you may need it. Say, your company announces a merger and your entire department is wiped out and you have to leave before coming Friday. It would be almost impossible to find another employer who will send the new H-1B application before Friday. In such instances EAD will help to keep you in status. EAD card for spouse will allow her to apply for SSN and thus Drivers license. AP for wife will help to travel out of country after you have used EAD. So in short, I would apply for all the docs for all members of the family. This could result in spending couple of hundred dollars but will help secure peace of mind.

We received the snail mail welcome notice today after receiving the email ADIT stuff last Tuesday (August 10). That makes it five business days. On the notice it says that we should receive our permanent resident card within three weeks. Anybody who actually received it within three weeks?

I-485 is an individual application, so this list will have all the EB based I-485 that includes the spuse and children.
