I agree I too have never seen H1B only ad's anywhere even body shoppers never post this kind of ad which is blatant discrimination. .

I have one PERM EB2 labor certified and I-140 PP in under process. Received an RFE for I-140 on June 1st and my company's paralegal analyst responded back on June 6th. Since then there is no news on my I-140. I have another RIR EB3 labor stuck in DBEC based on the case analyst email it should be cleared by June 30th but there is no assurnace on that. Now I am in a fix whether I should file my I-485 on the PERM EB2 where I-140 is stuck with an RFE or should wait for RIR EB3 to get approved.
Also is it possible to file I-485 on my PERM EB2 case now and later use EB3 RIR PD in EB2 case when I get my EB3 labor and I-140 approved?
Please post your experiences and advise. This is really important for me to find an answer b4 I take any step forward.

If I am not wrong VDLRAO is predicting Eb2 will be current with in a year if USCIS continue horizontal spillover. What is wrong with you..
I dont know what VDLRAO is predciting, I was responding to someone, oh wait a minute, it was your post a couple pages back that said "...as from VDLRAO's post Eb2 does not need much visa to become current ..".
So nothing is wrong with me, but you better ask that question to yourself.

I was not planning to file for EB2, but after all this hoopla you have created, I got highly motivated. I am going ahead with it. I don't know your PD, I hope, really hope it is later then 5/04 as I will interfile to EB2... very soon.....stop me if you can!!!

Which organization is the cause of the namecheck delay....
FBI or USCIS?
If I am not wrong, USCIS sends the data to be checked on a weekly basis to FBI on a Electronic disk or tape. More than 90 % of the cases are returned, I assume on a disk or tape back to USCIS. So only a small fraction should be stuck in name check...
Could it be that USCIS is not updating the files in a timely manner with the namecheck information?
Also looking at data, a whole bunch of people got their namwecheck claered in a couple of months...
Any thoughts???

Spouse : PD Feb 2006 - EB3.
Suggested by our lawyers.
File my I-485 with spouse as dependent,
File my spouse's I-485 with me as dependent mentioning receipt notice of first I-485.
File for only one set of EAD and AP docs. Doesn't matter with which.
Filing both in July '07.

I sent a hand written letter to the President and CC'd it to CA IV PO BOX. and I feel a lot better after writing it.
I have also sent a personalized hand written letter to the local Congressman. I will set up a meeting once I get a positive response or in the next few weeks, whichever is earlier.

This is a real problem. I got a letter from a prospective employer, who wanted proof that I was legally eligible to work in the US (alongwith transcripts, previous employment letters etc.) prior to scheduling an interview.:cool:
I believe employers are seeing a lot of candidates on EAD, and for whatever reasons they dont think EAD is good enough and would like to weed those candidates out beforehand.
We need to fight back against this discrimination.:mad:
I think h1b was considered as an initial filtering criteria where they do not have to deal with complexity. Now as they see more EAD trying to switch jobs, they are trying to apply the same filter. They do not understand that EAD is a valid document on the i 9 form.
So what if they find a lot of GC holders?

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. Now stop making fools of yourself and get a life.

"I feel so bad about what happened with your application.
