I keep on hearing about cases of 2000 and before. Good luck to your friend. I am with PD Sep 2001 and I am too mentally prepared to wait for more years..:D
I recently came across an old friend of mine. I was shocked to hear his case. He is an original applicant EB3 India with PD of September 1998. Please note he is the original applicant and this is not labor substitution.
Here are the details
Sep 1998 : Applied with Texas Workforce Commision as regular Non RIR.
Oct 2001: TWC asked to do recruitment. No action was taken on submitting results.
October 2006 : Labor finally approved from Dallas BEC. Concurrently file I 140 and I 485.
Jan 2007 : I 140 approved.
Nov 2007: Took Infopass appointment. Was told case pending name check.
This case is absolutely amazing. My friend doesnt care anymore since he recently married US citizen (genuine case ABCD). He has worked at the same company since 1998 and stuck to stupid job (non IT). My PD is August 2001 and seeing his case I am getting mentally prepared for much much longer wait.

Hi,
Sorry about your employment situation.
If you think it is serious enough, I strongly recommend getting an Attorney's advice on how to transfer your H1B smoothly and also to clairfy any questions that you might have.
Paying few hundred dollars for attorney's consultation is worth the peace of mind that you get, once your questions are answered.
Murthy.com, shusterman.com etc are some of the good ones that I know of.
Good luck and donot worry too much (as these kind of things never stops occuring in life).

I have some good news and some bad news!
The bad news is that. You will get your green card in 5 years and after other five years you will get your citizenship. So in 10 years will be in position to get married.

A lot of times.. companies use this bugaboo of job desc etc.. Those that want to promote you badly enough will find a way.. First of all.. What your job title is v/s what labor is filed under is not directly related.. Secondly you can have matrix responsibilities that span across 2 bands etc.. So lot of times it's an excuse to not have to let you down hard way.. always easier to blame on that "damn immigration queue"

I took an infopass appointment on 12/13 and met with an IO. All the IO did was to e-mail the service center for FP. I now see two soft LUDs on 12/15 and 12/18 on my I-485. I don't know if these are related to the generation of FP notice or something else.
infopass is not useful for fp. I too tried that way, but didnt help.
if you use the poj, and you are lucky to get hold of IO at the office where your 485 is pending, then they have the authority to create new fp notice and they can also check whether your name check is cleared or not. they will also give you the dates as to when the name check was initiated (this is usually 1 week after your notice date).

Contacting the indian Ambassador..that is something new..how can we contact him or how do we drag his attention....
also those 140 processing times do not make any sense..a friend of mine got his 140 approved today..which was filed in Sep 07 under EB2 ..
Let Indian ambassador fix the Indian consulates in US first. Service and courtesy at Indian consulates in US is so pathetic. USCIS is far better compared to Indian consulates.

Consult a good Lawyer. I think there is some rule that you apply 485 for your spouse within 6 months of your 485 approval for her to join you.

Recently I spoke a IO at NSC and she specifically told me that the local office does not see if its assigned to an officer or not. All they see is what room it is in. Ironically, the rooms names are like name of a person.
So it may not be with an IO realistically. The infopass information may not be the best answers you get.

This case is pending with AAO from Nov. 2009.
It will take 24 months to get a result.
Meanwhile he is going to start PERM in EB3.
Got RFE before the denial.
Replied with professor letter and premium evaluations ($750).
Still USCIS insist with EDGE database. It is private, no govt backing, but they are going by that findings.
Lawyer is hopeful for the result, he have 6 year college, they questioned about the 3 year degree, but the labor is for masters, He have masters (2 year) and total 4 year combined bachelors(3+1).
They no need to look the bachelors, when the education requirement is masters.
The evaluator give 20 US universities name which gives masters degree after 5 year course (5 year integrated degree).

However, odd it may though sound, I don't see any real economic slowdown in IT sector. I mean all my friends and acquaintances in IT industry in the US and India are retaining their jobs. I recently talked to my IT recruiter and she told me that as far as she is concerned this year has been like any other years. Bit sluggish at the year end, but loads of requirements lined up for January next year.
Am I the only one who is feeling this way, or others also sensing the same thing. Maybe the real jolts are still lying in the future, in the coming year. Or may be its just a hoax. I would love to know other people's observation on this strange anomaly between what is being reported in the media, and what is being observed on the ground.

The point that I was trying to make but did not state clearly enough was that I feel that when one has a political agenda whether it is pro or anti immigration, children should be kept out of it. Labeling children like anchor babies is dehumanizing. I believe that when kids are involved, as human beings, everyone should always be concerned about their best interest rather than what our political view.
This is why I hate the term anchor babies. The antis are willing to even dehumanize kids if it fits with their political view.

I was thinking this is a good way for short term period until we know for sure what is going to happen to us as far as GC situation is concerned. It may not make the most sense in the long term but is a good way of hedging your bets until you know for sure which way immigration issues are headed.
This may be a good soln for people who do not want to loose their Canadian PR or those who dont want to move back to India for their own reasons (ppl like me who have been in this country for 10 plus yrs on F1 and H1 cobined but with no GC in sight).
