I Still think we have a good chance atleast all those with priority date before today.
The economy is not improving and I doubt if it will in next 4-5 years. Even though there is slight improvent the jobless claims went up
U.S. Initial Jobless Claims Rose by 15,000 to 576,000 (Update1) - Bloomberg.com (http://www.bloomberg.com/apps/news?pid=20601087&sid=aMhGnVzXaSfM)
No way nurses and EB1 would count more than 5-6k per year....
Even out of the 30-40k like I said before about 50% would be from india and china (mostley Eb3) with later priority dates which puts them behind us
Eb2 Filings have drasticaally gone down because of the USCIS rule
Even after giving away all spill over visas to EB2 india and china they will have a lot of visas pending and If USCIS has made the decision that no Visa will go wasted period then we definitely have a great chance
Again my assumption is based on the FACT that USCIS has a policy that all employment Visa numebrs must be used
Lets keep it simple. In the next 4 years there will be 140k * 4 = 560K visas and I would say out of that the only ones with priority before Eb3 india and China are
Eb1 ROW +india & china
EB2 ROW
EB2 India + china (very limited new cases)
and I don't think the above categories would count more than 150k which should leave a lot of pending visas for Eb3
Which would leave a lot of Visa numbers for Eb3 India/china and ROW
Only time would tell if you are right or wrong but I like your view. Shows a ray of hope in an otherwise bleak outlook of the future.
:)

In central NJ, I called over 9 Doctors and only two of them had an appointment before July 1st -2nd week.
One is Dr. Neil M.S. Estrella in Clark, NJ. Appointment was available for Monday June 18th. But the fees for the exam plus vaccines is $430. The second one is Dr. Marcel Stern in Piscataway, NJ 08854. Appoitnment was available for Thursday June 21st. The fees was more reasonable at $350.
If you're in Central NJ, Hurry, Hurry Hurry.
P.S - If some of you get other appoitnments in NJ, post here so that others will know and not waste time calling other doctors.
To look for doctors in your area, go here :
https://egov.uscis.gov/crisgwi/go?action=offices.type&OfficeLocator.office_type=CIV
You can just walkin to Dr Stern office. Even if you have an appointment with them, you may have to wait 0.5-1.5 hours depending on the time you go. If you go on weekend or weekdays after 5 you may have to wait longer but afternoon should be faster. And there fee may be more than $350 if you need to get shots and xray. Hope this help.
If you call them recp. will tell that appt is required but actually it is just walk-in and you may not get any preference ver people who walked-in.

Wish we would not getinto United States Civics discussions and concentrate on Increasing memberships and contributing.
Dont forget the goal....there are a lot of hurdles ahead as pointed out by Sen Durbin and elk already
To have a meaningful discussion / resolution to our problems we should be aware of the process.

I have heard the above from a lawyer. I think there is lot truth in the above statement.
However, in teaching the Univ processes H1B and most faculty pay the USCIS fees. I have written a check to USCIS for my H1B fees. Most faculty also pay their GC dues including lawyer + USCIS fees.
I have also heard that faculty can negotiate for the Deptt to pay the H1B + GC fees.
In my case i paid for the H1B expenses (includig lawyer fees) my self , but my company re-embered the amount once i completed three months. Same with GC, i paid till now, 3500 as lawyer fees. Filling fees extra. But haven't paid any filing fee yet as i am waiting for my PD to be current. And the company is going to give me the money i paid till now back once i complete three years. After which company will pay every thing.

TV25,
1) You were in H4 at first when U came to this country.
2) Then you were sponsored(H1) by some company.
3) you worked for 3 months.
4) went overseas to get stamped(visa) for H1. But they put you on hold for administrative process.
5) You decided to return with H4 visa that was valid at that time. (although technically you are not supposed to enter using H4 since you already started working on H1)
6) You came back to US on H4.
7) Get a letter from USCIS that h1 is denied.
What surprised me the whole time was, why did the consulate not cancel the existing H4 visa, since your status already changed?
That's the first thing they do, when you go for visa stamping...they cancel without prejudice, and issue a new visa....even if its going thru a administrative process, they would still cancel it, cause the assumption is you are going to get the new visa once the process is complete.
See that's what I exactly said in my last post. The COS that is obtained in the US is a "privelege" it is by no means supposed to over ride what the consulate decides in terms of the visa stamp. That is exactly the reason some of the applications get a H1 approval without the I-94. This is done because they are in no position to verify a lot of things that the consulate can verify. If you have a valid H4 stamp and you want to get back into H4 status instead of applying for another COS, you can go out of the country and enter using H4 and your status will change to H4.
Anyway, like I said in our case I asked the IO behind the counter in vancouver if she can use H4 to enter the US his response was "It depends on the officer at the POE ". Guys I spent a good two days researching this topic while we were stuck in vancouver. Basically you can come back but your status is reverted back to H4. You are not supposed to work once you are in the US. In our case we immediately applied for another COS prem processing within the US and it got approved. My wife again changed jobs last year on H1 and that got approved too.
In this case, the misrepresentation of facts in her H1 app is something the poster might want to get clarified. She should be fine.

I just applied to lending tree on wednesday for 450k loan. Still nobody contacted me :(. I have an excellent credit history and me and my wife both are using our history to apply. Finally looks the market is really tight in credit. Last time I applied for auto loan I got replies in couple of hours.
Good luck. I am still hunting in NJ and want to get preapproved.
I few months back got it from Wells Fargo. 100% loan, no PMI, 7.25%, 30 year fixed. I heard they have stopped 100% now. You need to have atleast 3% down. I know it is towards the higher side but I want the safety of keeping the money in my account while we go though his rough economy.

Any idea of how many number of I-140s ? May be 50000+. It looks like it might take at least an year to process these I-140s in NSC/TSC. TSC is faster when compared to NSC, where the priority dates has not been moving, at least for EB1/EB3. What do you say ?
A trivial question: Do they process I-140s based on labor filed date (priority) or I-140 filed date ?
Hopefully they will reinstate PPS for I-140 after they are done with receipting the July/Aug applications.
Good luck to everyone.
kaykay.
I-140 is processed a per RD (I-140 filing date).

I have been on H1B for 3000 days so far and I am still waiting for GC, (filed for 140/485 in November) and I thought I have been waiting for too long, but it looks like one of these people might actually qualify for Guinness Book.
3000 days might seem small when compared to a member's data whom I spoke with during the Sept Rally time. He has been here on a work visa since 1994 and unfortunately he had to start his greencard process several times. He was thankful that he finally got his I140 approved and filed I485 this year after such a long wait.
He was calling members and asking them to join the rally as he truly values IV and the fact that due to IV he could file his I485. I was very impressed with his dedication for IV and also felt sorry that he and his family had to endure such a long wait.

We all know why! America decided it's smarter than anybody else: "Hey, let's let new people into the country and then exploit them for as long as possible! Well, we gotta give them some hope that that some day they would have the same rights as everybody else, but who said we need to keep the promise? There are so many ways not to: overcomplicated "process", quotas on Green Cards, processing delays, no fixed, mandatory processing times, etc." Once you realize the main goal of the immigration policy - to create permanent underclasses whom America can discriminate and exploit, everything that happened in the immigration history of USA, especially recently, becomes very logical. Unfortunately, it's a long time tradition in US to exploit and discriminate "recent" immigrants. Remember "No Irish need to apply"? How about the Chinese workers who built the transcontinental railroad and then were lynched and Chinese were effectively banned from immigrating to US for the next 70 years (see shusterman.com for more historic examples).

I am still waiting for my card, but I received a FP notice yesterday. I think I'll get my card once I am done with my FP.
Thats great. Atleast something is happening. On your welcome notice, did it say that you'll need new finger prints? My welcome notice said I'll get my card in 3 weeks, did not mention anything about FP.

Chandu, here I found the LINK (http://www.murthy.com/news/n_porret.html)
"When explaining the risk of potentially stricter AC21 regulations to I-485 applicants, we are frequently asked, "If I change jobs under AC21 and the regulations are released after that, they won't apply to me, right?" Unfortunately, this is not correct. While it is not possible to predict the content or effective date of any future regulations, they will likely apply at the time of adjudicating the I-485 application, and not just when the job change occurs. In a hypothetical example, if new regulations were to limit the percentage of acceptable salary difference, or prevent multiple portings, the officer adjudicating the I-485 could decide that the job change violates the regulations, even if the change occurred months or years before the new regulations were issued."
Redgreen, please read :)

Yep, I got the same answer from the IO at my Infopass, when I asked about my Interfile. BTW, what process did your lawyer follow to inform USCIS about the interfile request?
PD : Oct 2005
EB3 - I140
I-485 RD 07/02/2007
EB2 - I140 , Approved 10/2007, PD : Oct 2005
Interfiled May 2008, no reply, no info.
After my new EB2 I-140 got approved with (old PD), Lawyer requested USCIS by mail to interfile my Case.
In that notice, he clearly mentioned all about my information in few lines and also request to approved ASAP as the PD is current according to the bulletin.
Hope this helps. If you want more info. let me know. I will gladly share.

I say try to get as many shots as possible at your PCP. For TB and HIV tell him that you have been to India lately and want to make sure everything is okay. For other shots tell him that you are considering to apply for a medical/dental school and need to get vaccination records, which you don't have because everything was done in India. Take all those proof to immegration doctor, he will accept those records.
My wife in fact joined dental school last year. She needed only HIV.
You can ask PCP to give all the shots as part of yearly physical or mention that your immunizations are not current and you need those shots to be current.

Folks. I am planning for India vacation this winter.
I have a quick question. Please let me know your opinions.
My H1B stamp expired a few yrs back. I have an approved I797 valid till April 2008. Can I travel on this AP and come back and be on H1B? Do I have to use EAD(once I come back from India) if I use AP?
