I think of these solutions...
1) Exit and Enter the country to match with your 797 dates.
or
2) Talk to your employer ,find a temporary employer to switch your h1 and switch back to your current employer. ( do premium if necessary ).

Isn't it a relief? if the officer calls you for interview, checks your documents and says approved but no GC till PD current? I can live happily with it for couple of years atleast without thinking of GC. The feeling of getting GC in future 100% is almost equal to having GC today. You can change jobs on AC21 without fear and use EAD and AP full force and forget about renewing H1b's

Been with Ron Gotcher for over 5 years now. Never ever had a problem. The best thing is you can talk to him or his son anytime regarding any immigration issues. I had lots of H1 issues with my current employer and he was gracious enough to talk to my employer several times and help them out without charging me a penny. I would highly recommend him.

While its a good idea to write to the president, Obama himself says he gets 40,000 letters per day, so its a rain drop in the ocean, no offense intended.
We need to do a coordinated strike by all members of the IV
1.Everyone send an email or calls the Congressman's office on a particular date
2.Call or email their senator on a particular date.
3.Write letters to popular TV talk show hosts on a particular week saying legal immigration is ignored in the immigration debate.
4.Send an email to the president on a particular date
5.Organize peaceful rallies in their respective cities on a particular date. This way no one has to pay for traveling in terms of flight tickets or pay for hotels
This has to be organized by PAPPU and TEAM as everyone respects their work and commitment.
PS Don't start of the donate campaign thread now, people will donate once they see action and not just words. Only #5 needs donation for flags, posters etc( even that content can be brought by folks themselves)
For a start, can we all just do one thing: Take an appointment with our local congressman/woman's office and do a presentation. No need to do it on one particular day. Just do it in the next month.
Both ideas are good; coordinated and targeted efforts will get the attention of a few. We need guidance from the IV team on this matter.

Anyone can throw light into this one. Can we track APs now for NSC.
NSC is receipting late and also their AP documents are mailed very late. Please let us know when we receive our AP document after getting the receipts? for eg. 10 days, 20 days etc..
It will help lot of us who want to make some travel plans.. [some like us are eagerly waiting for past 4 yrs!!!]

A few days I called Comcast to disconnect CNN and CNN headlines from my cable. The Comcast representative was surprised as to why I want to cut CNN. She transferred me to her supervisor. The supervisor noted down my complaint and said that he will get back to me in 3 business days. Next day I got a call from Comcast that they will block CNN entirely from my cable. I thanked them as I will not have bigotry coming into my house anymore.

I applied my first H1B extension through my company in June 2008. On 11th Feb, I received REF. I am very much tense about it. Since I am out of project. I got cleared my I 140 with this company in July 2008.
I applied H1B transfer(Normal process) also in October 2008 to other company . This one is still pending.
I am very much tense about my status. Please suggest me what to do?
Is it better to answer to RFE for first company?
or
Can I do PP with second company? or else any better thing?

months you are out of projects? if its more than 60 days then even though if you transfer to other company they will ask for pay stubs..... which you may/may not have......

If your Attorney says it’s okay then probably you don’t have to worry.
However, your current Canadian address is not what you have in files on your I-485. Because, you can't give a foreign address.
So, I personally think you are beyond jeopardizing your pending I-485.

And, I provided my cousin's address in Detroit where I lived temporarily. Subsequent to that, I moved to Windsor, Canada, because it is a nicer place to live.
I did consult with my attorney at that time, and she suggested that it is fine for me to live in Canada.

Yes you can include your spouse to 485 when dates are current and is not dependent on H1B transfer.

My parents will be here for more than 184 days this year (on visitors vis) and I want to claim them as dependats on my tax return for next year.I searched through some old threads, but the info seems to be outdated.
* Can I claim them as dependants on my tax return?
* Has anybody done this successfuly before?
* What is the deduction amount per person/dependant?
* What is the process? I know they will need an ITIN etc.

You should be able to claim them as dependents in your 2007 taxes if they pass the "substantial presence" test. You can get 2 additional "exemptions" for them in your return. IRS looks to issue new ITINs only during tax filing (so when you mail your return next year, you attach their W7s with your filing). Or your parents can open a savings bank account and if they have any "income" in the US, they are entitled to an ITIN any time of the year.
I have just applied for ITINs for my parents who spend 6 months every year with me. They pass the substantial presence test and I plan to file amended returns as soon as I obtain their ITINs. Hope this helps. Good luck!

I started the US immigration in 2006, PD-September 2006, by CP, EB3ROW. DS230 renewed 3 times since then... a couple of months ago I applied to Canadian PR, now I am waiting for my interview date. So I have two processes parallel - US GC & Canadian PR. My question is : How these two immigrations can jeopardise each other? :confused:
Logicaly I will attend the Canadian interview first, will they ask me about US immigration? should I tell the truth? Will they deny the PR because of the GC process?
Presume that I have successfuly done with canadians and have landed in Canada with my PR in 8-10 months from now, and suddenly, I,ve got an invitation to the GC interview... :eek: Does the fact that I have a Can. PR will kill my future GC and at the interview the will deny and cancell my case? :confused: Or The interview will be successful and I will have my GC, but somewere in the future there is a point where I should refuse one - GC or PR? :confused:
I should mention that the GC is the choise No1 , and PR is a plan "B"...
I believe that my situation is not unique, but now I am out side the US and in my country it is difficult to find a competent lawer. So I hope that somebody from this forum could answer my questions.

The idea here could be to give tough time for people who do not have valid visas. If they cannot get drivers license because they are on expired visa they cannot drive.
Illegals will anyway figure out a way to drive. They may even drive without a drivers license.
We are the ones who have to bear the brunt of all these illogical rules.

How come DMVs can ask our immigration status for drivers license ?

Last time around exactly the same time in 2006 CIR took off like crazy because of the tremendous backing of Senate Judiciary committee chairman Arlen Specter and Senate majority Leader Bill Frist (who actually gave a deadline for a the bill to be introduced to the senate floor, to speed it up) and president bush supporting it as well. In spite of all these it took the senate from Feb-march 2006 to around September 2006 to get it passed.
Now to the present situation, Harry Reid, the current majority leader never ever publicly spoke one good word about CIR, the present senate judiciary committee chairman, Patrick J. Leahy has not displayed even 1/100 the urgency nor the interest in CIR, president Bush though still supporting CIR is a wounded president licking his wounds and has truly become a lame duck president (most unfortunately for us).
Having considered the above facts what are the chances of CIR happening? Its very painful to say that but I think very low. Even by a miracle (a very big miracle at that) if something happens it will be November or December 2007 before it passes.
As if this not painful enough there is a 60 day waiting period from the day the president signs it before it becomes a law. I think there is some confusion on this 60 day period (I am not 100% sure on this). In addition to it if I remember correctly there was a strange condition which was something like there would be a 6 month investigation period to determine the effects of CIR before becoming a law. If you add all this nonsense up I think in the best case scenario January or February 2008 before CIR becomes law and worst case scenario July or August 2008 to become a law. just my 2 cents. I can only pray and hope I am wrong.

Basically, if the White House were to direct a few more raids by ICE on some meat packing plants and some construction, that's all it takes for the House to be shamed into doing something about a widespread problem unless it wants to be called a do-nothing congress.
Now we cannot predict if the above course of events will take place. Its impossible to predict. Some people (on other sites) have laid out percentages like 20% chance this will happen, 80% chance that will happen. That's really laughable.
