Let me tell you I am as anxious and frustrated as you all "July 2 filers, no action yet" are. But I am thinking about it a bit calmly, rather than thinking of doing something so that I feel that I have done something (i.e. complain, write to congressman, etc.). Expressing my anger by saying they should have done this or that, does not change the situation. I believe USCIS is working, as expected, with the capability/attitude of a government worker, treating our filings (which are so important to us) just another government office paper work. Best is just to wait for another 10 days, and if nothing is heard by then, take action as per procedures.

In principle, I agree with you that we are responsible for what we 'sign up' for and shouldn't back away from that. But, your example is a little bit off as in nobody is asking back money from the mortgage which is already paid (akin to the difference in gas prices that you mentioned), the interest rate could change and we are liable to pay the difference in the mortgage payments due that fluctuation - the thing here is the base value of your asset. As a hypothetical example (because vehicle prices always depreciate, so please ignore the reality), let's say you bought that Gas guzzling SUV at 50k and now suddenly after 2 years, due to whatever reason, you go and try to sell the same SUV to the same dealer and he quotes you 5k. Wouldn't you fault that dealer for selling you the same thing at 50k when the actual value of the same asset 2 year back was 5k (but he sold you at 50k and you have only paid back 10k in monthly installments until now). Who is to blame for that 35k deficit? You? Forget the monthly payments here and concentrate on the actual asset value.
As mentioned above, I do agree that we are liable for what we do in life and one has to stand up for his/her deeds - but at the same time, and I again argue the same point, that the greedy people on wall st. and lending institutions are largely responsible for this mess - imagine if they had never sold you the asset for 50k, which is a bloated amount for that particular asset and the sad part in this is that the lender lends out the money knowing all this.

Also, my 401K losses should be returned back because it isn't my fault the stocks are loosing value. This is my case in brief:
I resigned from company A (who sponsered by RIR LC, and I-140) about a year back.
Filed I485 using approved 140 of comapny A in July 07, in the485 application we mentioned the details of the current company I am working in. Got EAD and AP approved. (Company A's management is co-operative and supports me to take back)
Also got 3yr H1b extension approved for current company based on the approved I140 of company A.
Now Iam traveling to India. Had an appointment in Chennai consulate . My previous H1B visa expired in 2004.
Will there be any issues with that much gap 4yrs, in getting stamp?
Is it an issue not working for GC sponsoring employer?
If I use AP what are the issues?
If asked at PoE (Newark EWR) why not working with company A? what should be better answer?

I got your point and I difffer with that. Your point is-only defective items should be returned and I am saying it doesn't need to be defective. As long as you are not completely satisfied you should be able to return it and price is an element in customer satisfaction. That's why stores do price match so you don't need to return their merchandise. Stores that don't do price match deserve their goods to be returned.

I have a few theories on this. This is meant just to open discussion.
1) The USCIS and State department are not communicating at all. This is not at all uncommon within gov't agencies as we all know.
The State Dep't released the bulletin perhaps without realising the full ramifications. Having heard from the USCIS..........hey hey hey what the F&^% are you doing? They may have realised over the last few weeks what a mess they have on their hands. Now they are trying to undo it.
thats possible. I thought the Ombudsman also said something to this effect. that these three (DOL/USCIS/DOS) dont talk to each other as well as they should. Also, apparently visa dates are set by ONE person who does all the number crunching. that seems to be weird. There should be a more transparent mechanism of doing all this.
2) Another possibility I can think of, is that this is a grand plan(heck I almost said grand bargain) concocted by the USCIS to get 485s OUT of the system as much as possible while minimising those that can get IN. Hence you might see in the coming few weeks thousands of approval letters all dated the 2nd of July. That will allow them to clear their backlogs of pre-approved, approvable cases and clean the slate fresh for the new fees structure/new quota in the new year. Some of you might remember they retrogressed to unavailable around this time 2 yrs ago. They do these weird things in the 4th quarter.
the U two years ago was apparently because USCIS somehow used up more visas than they should, and ate up all the numbers from the next quarter. Apparently that was the only year they did not waste visa numbers.
I guess hte only reason they dont want applications IN the system is because it looks bad on them (# of backlog cases); otherwise whats the harm: take the file and stick it on a shelf. As the applicant keeps coming back for EAD/AP
keep milking them for money. win-win.
3) Of course the last option is their brains have the same IQ as that of any common critter that messes up your garden.
Pick your poison, it is all the same. I feel for everyone whose hopes were raised so high. It is truly inhumane of them. If they planned this, they should atleast have delayed the release of the July VB.
I would think its #1. The miscommunication across these govt. bodies. We pay the price, there will possibly be a lawsuit (which will be quickly settled) and some heads will roll.

I am speaking from experience. Download the forms needed for filing 485, EAD and AP. Then when your attorney send you his/her set ( normally they do this in 2 stages - one they will send you a draft copy to verify and correct all info - some have online questionnaire; stage two - they send the final forms for you to verify and sign again - this they may do paper copy or online PDF - that cannot be edited - not fill able forms).
So, here I am providing links to all forms that I know are needed. These from uscis.gov site are fill able. Weekend is coming. Fill them, and print and keep them.
When attorney sends papers, compare yours with their and do corrections in theirs ( usually it will have stamps of the firm)

Medical Examination of Aliens Seeking Adjustment of Status - I-693
There is a supplemental 693 also for vaccination records.

Folks,
I got a call from the Ombudsman Office today morning was told that my case is in "transit". When is asked her what it means she told it is going to be reviewed by an IO. I got the similar response to my SR that "your case is pending adjudication by IO" so don't know what to make out of it in the sense that its been removed from the shelf and sitting in some pile and IO will get to it when he/she can?
Did any one get their GC approved after their case was in transit? How long did it take?

The authenticity of that case is not clear. Someone claims his friend had issues and we do not have any details.
I used AC21 few months back and went through the NOID ordeal.
Our volunteers working on this effort are in the process of identifying authentic AC21 cases that got denials though they did everything to the law and are in process of filing MTR.

A simple calc to find out how much EB3-EB2 porting going on as of today:
If you look at Demand data released last month by DOS, It lists
Prior to January 1, 2007 , EB2- I pending : 13,200
In my opinion Demand data includes EB3- EB2 porting as well since Demand data reflects overall demand for one category.
Now if you look at inventory data released on Jan 5 ,2011 ,
EB2 India Pending Prior to Jan1st 2007 : 13,516
But if you exclude all the data prior to May = 13,516 - 1,110 - 103 - 133 - 74-108 = ~ 12K
EB2 I demand from the inventory btwn May - Dec 06 = 12K
But Demand data says EB2-I demand is 13,200
Diff : 13,200 - 12K = 1200 ( This number has to be porting)
We know EB2 - I dates have not moved since Oct ,2010 .
So India regular quota for the last six months : 2800/2 = 1400 .
Since dates have not moved, I am assuming 1400 should also be considered towards porting.
so my conclusion is so far 1200 + 1400 = 2600 porting already took place. (though only 1400 really got GC)
EB3 Porting could use up to 8K though, and new filing could be 2K
and EB2 I/C pre-07/2007 still have about 34K at the beginning of oct/2010
So it is even at most...
There are lots of uncertain
1. EB1 is now the biggest uncertainty
2. EB2 ROW
3. Porting
But EB1 and Eb2 ROW, EB2 I/c new fling (ppl who missed 07/2007 w/ PD before 07/2007) have to file in May to get it approved by Sept as processing time is 4 month.
So After May, from June to August, it is all spill over game for EB2 I/C
That is why i guess Charles is saying the trend is now, and will start use the numbers in May

EB2 I demand from the inventory btwn May - Dec 06 = 12K
But Demand data says EB2-I demand is 13,200
Diff : 13,200 - 12K = 1200 ( This number has to be porting)
We know EB2 - I dates have not moved since Oct ,2010 .
So India regular quota for the last six months : 2800/2 = 1400 .
Since dates have not moved, I am assuming 1400 should also be considered towards porting.
so my conclusion is so far 1200 + 1400 = 2600 porting already took place. (though only 1400 really got GC)
EB3 Porting could use up to 8K though, and new filing could be 2K
and EB2 I/C pre-07/2007 still have about 34K at the beginning of oct/2010
So it is even at most...
There are lots of uncertain
1. EB1 is now the biggest uncertainty
2. EB2 ROW
3. Porting
But EB1 and Eb2 ROW, EB2 I/c new fling (ppl who missed 07/2007 w/ PD before 07/2007) have to file in May to get it approved by Sept as processing time is 4 month.
So After May, from June to August, it is all spill over game for EB2 I/C
That is why i guess Charles is saying the trend is now, and will start use the numbers in May
