    I am writing to the local congressmen, to request USCIS to apply the spillover visas to EB cases with older priority date first (irrespective of it's category or country). I hope this will help, if lot of these local congressmen/women contact USCIS to handle this spillover in a fair manner, allocating to older priority date cases first irrespective of category or country. All EB3 folks please take some time and do the same writing to your congressmen about this issue.

    i guess desi3933's chart has 7 Day EMA, 14 Day EMA, & 40 Day EMA (on closing prices) on indicators (based on annotations on top of charts).
    You need not stick to desi3933 strategy, get well-educated first about markets (equities, options, futures, forex) & indicators (MACD, EMAs, Sto etc) and do some paper trading/virtual trading - like vse.marketwatch.com - and then you would need to come up with your own strategy based on your level of risk, time you can invest etc.
    Again based on desi3933's risk level, he chose futures - based on your risk level you may stick to ETFs SPY (S&P), SDS (inverse S&P), SSO (Double S&P) or options on these ETFs.

    Is there a reason why you choose e-mini as opposed to etf's or stocks. BTW, I am not knowledgeable on e-mini. I couldn't even find the symbol in TdA. Looking at your chart, it seems you trade full time ??

    You seem to have some misconceptions. I am not a client of the lawyer mentioned, don't owe her anything and asked you for another suggestion. I don't know why you are being negative on this one.

    tonyHK12 appreciate your inputs. We are already united. IV has several thousand members and has conducted several campaigns. The leaders are very capable persons also. You have put forward a general idea but this has been debated a great deal. What is the purpose of even a poll when it is absolutely clear that everybody in this group would welcome a bill solely for reducing backlogg? The question is how can we get the legislator to write and introduce such a bill and then how to get it to pass. Who will support such a bill? Your desire is similar to everybody else in this group but until there is a definite strategy which is different from what has already been tried there is no point in just creating discussions foccussed on desires.
    First think out a strategy and put it out. Others will then coment or join it.
    Putting out vague goals like "we need a bill" is of not much use. the question that you need to answer is "how?"

    You want to bring a bill without lobbying. So tell your plans. Let us all see.

    You created your new ID, started a thread and you think that is a good start. I need to see something real in an idea than believing in your idea.

    Well I had called a NY congresswoman when I was stuck in a H1 name check. I found them open and willing to help. She even contacted the FBI.

    Well I am just an ordinary person, and the same as everyone here, and not saying I will do everything myself. There are persons who are better skilled at this and know the immigration law better.

    Also don't rule out lobbying, I just said we also need something else that should justify our case without a lobby. I'm asking for suggestions or ideas.
    I may be new here, If you see my post on the other forum, I'm asking for the creation of an organization with skilled people who will create a new campaign among legal immigrants. Kind of like Grass roots movement.

    Dude,

    I am not sure which point u did not like. For me they help every one in the line waiting for gc.
    Having a tolerable time ensures that USCIS processes all the applications they receive in reasonable time. Eliminating renewals reduces lot paper work, money, time and energy. If this is considered as unacceptable I do not know what one should expect. I just wrote what I think is meaningful. If have a better idea, please feel free to comment. But stop commenting on other. That will only spoil the good spirit of the members in this thread


    I am not saying that I don’t like your suggestion.. They already started issuing 2 year EAD. Where are you all these days...

    The Maryland Department of Labor, Licensing and Registration (DLLR) announced in mid-December, 2001 that their office is logging in and issuing confirmation of receipt for cases received on April 30, 2001. A remaining 1,500 applications received that day await the logging-in process.

    As MurthyBulletin and MurthyDotCom readers may be aware, April 30, 2001 was the deadline to file for INA Section 245(i) eligibility under the Legal Immigration and Family Equity Act (LIFE Act) of December 2000. This provision allows individuals who are out-of-status or who entered the U.S. without being inspected at a designated INS port of entry to adjust to permanent residence, if they are otherwise qualified. In order to benefit from this provision, the individual must be the beneficiary of a labor certification or a family petition filed on or before April 30, 2001. For this reason, extraordinary numbers of cases were filed nationwide on or slightly before April 30, 2001. According to the information released by the Maryland DLLR and other states, local DOL offices did not receive additional funding in connection with the LIFE Act filings.

    With respect to case processing, the DLLR reports that they are processing RIR cases received April 5, 2001 and non-RIR cases received March 8, 2001. Of course, these processing dates will be further affected by the glut of cases filed on or immediately before the LIFE Act deadline.

    These time frames are similar to those experienced in most other states that are attempting to catch up on the huge volume of cases filed on or before April 30, 2001. We will share information with our MurthyBulletin and MurthyDotCom readers as and when released by other state labor agencies.

    why would EB2 retrogress to before 2003? It was at 2003 for a long time (8 months?). The only people still with PD of EB2 2002 are the ones just getting out of BEC, there cant be too many of them...

    Yes, I agree. For the same reason, there may not be much EB3 2001 and 2002 cases left. Hence Eb3 would move to 2003 soon.

    BTW, my PD is not 2003 :-)

    Just checked again and the last 2 approvals are

    PD 3-15-05 RD 6-12-07
    PD 10-21-04 RD 6-29-07

    So they are past the June 8th date, looks like they are still processing pre PERM applications though.

    PS pappu, I updated what I know exactly (PD RD of I 485), my lawyer has the rest.

    Yes, that would be me. Mine was approved at NSC. Got the email at 11am PDT.

    Looks like NSC is also approving I-485's. Not sure how long this trend is going to continue, guess all depends on how much visa numbers gets trickled down from other categories to EB2 India / China. Hope and wish they are many.. which would helps many people waiting in line and PD not getting pushed back for FY '10. I feel bad for EB3 folks though, seems like nothing going to change for them at least in near future, untill there is some congressional action. Hopefully the next VB gives some indication on how things are going to move. Good luck and wishes to all who got greened, especially with older PD's who have been waiting for years. Think nothing changes much overnight with GC, but certainly gives a peace of mind and helps execute long term plans with much confidence.

    Again, post your field of work. I somehow see reluctance here on the part of posters. 2 to 3 have done so, but the rest have not. If it is only IT for the major part, we have to analyse and see why IT is being targeted for audits... ?

    I think all the fields are getting targeted. I am not from IT. As per my attorney, current situation is that PERMS for EB2's are getting 100% audited.

    I am waiting since last 9 gruesome years for this to complete.

    PD Date : December 26th, 2001

    Labor Approved : October 11th, 2006

    I 140 Approved : February 17th, 2007

    I 485 Receipt Date : September 13th, 2007

    Waiting since then and currently my date has become current and following the instructions from dear friends like you folks, i have created Service Center tickets.

    Years we have been told priority date establishes your place in the queue.

    We have spurned job offers and declined the new PERM process to hold on to the priority dates.

    Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.

    People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.

    Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

    Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

    My advice to you is to beg, borrow, steal or kill but find a way to file for the I485. The benefits of filing for AOS - specially if you have a spouse who cannot work - far outweigh any short term struggle you may have to endure.

    I guess a good solution could be. Have a cap for Non-US Masters H1B
    and unlimited numbers for US Masters.
    This way IEEE gets their way in getting US grads to stay here.

    The "5 year clause" is definitely a blow to everyone who has been waiting in line forever.

    I think this is the right time to not only run with this but also work on modifying the text of this bill. IV Team, could someone please give some feedback as to what you think?
