Thanks for the replies everyone.
In response to some responses, i am not "overly concerned" I was just wondering what their status was.
If the older core members who have received their GCs are indeed enjoying the fruits of their hard work, God bless them and there is absolutely nothing wrong with that. My intent was never to start a hot debate. God knows we have tons of drama on the forums daily!! ;). (Soon the April VB will be released and more drama)

PMP can take you to Project Management, and with experience higher up in the sr management.
With MBA from a good school you can start at serious management level.
It doesn't have to be vs, you can do both.
What you guys think about On-line MBA ? Is it worth doing ? Any recommendations for on-line MBA or on-line M.S.?
Your inputs are appreciated !

reasons...
I have seen many of my friends doing H1 for their spouses..... while their spouces have no experience what so ever..... employers help them cook their resumes..... in these cases employee has something to hide.... so they pay
H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......

>> AC21 memo is a real memo.
Wow, what an ignorance. May I ask, what do you mean by "real memo".
Read previous post and get enlightened. I can't believe that you guys even don't have distinctions about law, CFR, and memos.
AC-21 is law.
Hope it helps.

Not a legal advice.
Correct. It is a bill that was signed into a law. Though USCIS follows AC21 in form of Memos, the law is binding and that's why we see that AC21 always works . It cannot be compared to the new h1b memo.

And ofcourse, EB-3 ROW would oppose such a move.
Read the term "Not to exceed 28.6 percent plus"That plus means EB3 total can exceed 28.6%..
No.... USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....

To Everyone...
DO NOT PANIC. These notices are usually sent when you have any H1 transfer pendings most of the time ( at least in case of H1). By law, the employer is supposed to notify USCIS whenever any employer has left the company.
The re-opening of case is a letter from USCIS to the previous employers to confirm that the employee no longer works and is usually sent to the attorney.
So chill and don't sweat.

I think the memo everyne is refering to is Cronin memo. Here is the link. https://www.shusterman.com/cronin51600.html. I-94 date after using AP is one year from entry date, at least in my case.
Can you please provide a link to this memo ? My attorney said, if I want to continue on H1 after reentry, I must get H1 stamped and enter in H status. If I use AP for reentry, I should change to EAD at work. This memo will help.
I know there is a memo about continuing on H1B after filing I485 (dual intent) in the context of AC21 , but I am not aware about one that deals with entering with AP and continuing on H1.
Most of the answers above talk about transferring/extending the H1 after the reentry to get a new I94. How about if you want to continue with the same employer and you already have H1 valid until 2011 ? Do you still apply for H1 extension ? If so what basis ?
Do they enter a validity date on I94 when we enter using AP ? If so what date would that be ?
What is the significance of this date on I94 when one wants to use EAD and never goes back to H1 ?

I realize that there is no point in telling you guys anything. When you don't have an open mind, you can not accept the facts. It's like banging your heads against steel wall. When you are not even ready to diagnose the disease, there is little hope you will be able to cure it. Denial is a beautiful thing.
So I apologize for my comments.
Here is something you will love:
Congratulations IV and the core team! Keep up the good work.
Please dont bang your head on the wall. The wall will break. Please dont apologize. If you really mean it can you please start actively participating in activities which will help everybody.I dont mean that you have to be with IV forum.I know that you are disillusioned with the IV forum. You can take some responsibility and start educating the law makers and people who are in your area. You can do this on your individual capacity you need not represent any forum. This will benefit everybody including ,you ,me and lot of other people who are undergoing this pain.
We have to all work together to achieve our goals whether you are in IV forum or not.

Anything you could contribute is great, but yeah passing on the message and encouraging others to contribute will be most helpful and that will generate more contributions.
I haven't seen any other movement as big as this and as productive and valuable as IV core team is doing for immigration community.
I hope other members will recognize this and donate generously.
Accept my $50 contribution now. More on the way...
My other contribution is forwarding the message to all my friends.
Best of Luck for your work.

it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.
Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.
I see there is a very common misconception in these forums
First. EB2-I being current does not help EB3-I -- at least not directly. The numbers after EB2-I being current will not rollover into EB3-I. It goes to the general EB3 pool, from where first the 7% rule is applied, so unless EB3-World becomes current, EB3-I does not benefit from the numbers.
2nd, yes, the reclamation will help, but again not to a great extent -- at least not directly. All of the numbers so gained will go based on the 7% cutoff, so while we will get some extra numbers, but does not mean EB3-I will go ahead by leaps and bounds, that is until all the rest of the categories are current.

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?
It very well could be deliberate, no rejection notices mean, the lawsuit will be weak.

bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)
Ehh! Perspective. Do you think you can make a case for that?
You asked all of those who are making their case with the US Congress or doing some sort of advocacy to get a life. In other words, in one single sentence, your perspective is that all of us who are working towards improving the system do not have a life. Wow! Did I start off by saying that you dont have a life because you chose to go canada and not India after 6 years of stint in US? NO!. Saying "Get a life" or other catchy phrases is easy. F Y I, hear your ears blared" WE DO HAVE A LIFE". We heard your perspective. Now this is not your evangelizing ground for your perspectives. Damn it! Aren't IV's objectives clear? What harm has IV's objectives caused you? You dont believe them fine. Do what ever you want.
You chose to go to canada because US GC system sucks and you are saying that we are all hypocrites. Got some sense? What are you trying to say? We should all follow your lead and go back to where we came from while you preach one thing and do the quite opposite. Still be a turn coat to your home land and be a boot licker (your own idea of immigrant's not mine ) to canada. Perspective ehh?
You argue that immigrants are treated like dirt. I tell you what, look at the president of United States and say that one more time. As a kid born here out of the main land and raised in the most populous islamic country in the world, he went on to become the president of united states. You are one of those who do not want to become the change you want to see. you just want others and system to change and you will take that change. Go figure Mr Slime. Oh B T W there is no one such as American, except for the native american. You showed your 10 fingers in your mouth with your basic lack of understanding about the country and how it formed.

you argue that three countries will dominate immigration. how ever you dont point out the fact or cleverly ignore that all these people were not limited by the system through which they enter but limited by the system only after they enter. Hey we, those from those three countries, are already here. lets implement the country caps through out the high skilled immigration or get rid of them. Enough of your disguise as some one who is logically and rationally for country caps. There is no rationale or logic what so ever in your argument. Perspective. Ehhh! forget that word.

Congratulations on your Citizenship desi3933!!
Whom you gonna vote? Obama or McCain? I think thats the
only difference between GC and Citizenship. Ofocurse if you do
something bad you will goto jail and no deportation :D
So you gonna start some company? I could give you some tips :D
Good luck.

Thanks Babu.
>> Whom you gonna vote? Obama or McCain?
Not going to tell you that.
>> I think that's the only difference between GC and Citizenship.
Incorrect. There are LOT of differences.
1. Visa free travel to many countries
2. No need to maintain GC status, even if I spend >1 year out of US
3. Can work on jobs that require Security Clearance
4. Can sponsor GC for Parents/Siblings
5. Be part of School PTA
>> So you gonna start some company? I could give you some tips
Thanks for your offer, but it is little late. :D I already have a company. Just because I never mentioned it (Like you did), you assumed that I don't have a company. Tip - Never assume anything. In case of doubt, please ask first.
Have a good day!

sriramkalyan,
Good thoughts. I also agree it will be a small change in code.
Discrimination on the line of payments will only lead to more mess....and more complaints...in the end people with common problem distance from each other. We all are in this together...we must solve it together including those that did not contribute a penny so far. All we can do is to convince those people to donate for the cause. You know our folks are not the best ...when it comes to donations:).(Not the religious)
It's just that some contribute more and some less...and there are some like IV core who contribute a lot more than others. Just the shear number of 25000 is a strength to IV...I agree that it may be only 100 who actually dedicate themselves to the cause. Decreasing the number would only mean...leaving some of our own people back.
On the same line of thoughts as yours...I think it is ok to ask the user/questioner if they would like to voluntarily donate couple of bucks...if they think the answer they got is valuable enough and if it served their purpose. On the same note as the user posts a question....depending upon the urgency and the importance of the question...user could have an option to put a 'Value' of donation that they would make if that question gets answered soon enough.
Thanks!

you have a sound logical argument
Ok, among the many replies to what i wrote, a few have been rational discussions. A healthy argument is always encouraged. However, I will dissect the above post line by line to pinpoint exactly why some people completely deserve the treatment that they get. Here I demonstrate how a healthy discussion is hijacked by imbeciles and that is why IV is doomed to failure.
"Till now, i used to believe that USCIS is working hard and eventually they will clear all the backlogs and give the GC to everyone. but by seeing your post, i think i am mistaken, they are doing a big mistake by giving a GC to people like you. "
DOES THIS EVEN MAKE SENSE?? WHAT DOES USCIS BEING HARDWORKING AND CLEARING BACKLOGS HAVE TO DO WITH MY POST ON A RANDOM FORUM?? YOU SIR, MAY BE MISTAKEN ABOUT A LOT OF THINGS AND MY POST MAY BE THE LEAST OF YOUR PROBLEMS.
"Once you become a gc holder and then a citizen, you will question a lot of other things, like giving social security/medicare to poor people who have not contributed and will also question the tax cut(1000$) given to each child when claimed as dependent , as you will argue that , i was doing my second Phd and others who dont have anything else to do, made children and are now claiming the cut. "
LET ME GUESS, YOU THINK MCCAIN IS GREAT, RIGHT? BECAUSE YOU SEEM TO HAVE A CRYSTAL BALL WHICH CAN PREDICT WHAT I WILL DO YEARS FROM NOW AND NOT ONLY THAT BUT FROM A ISOLATED POST ON A RANDOM FORUM, YOU HAVE CREATED A COMPLETE PICTURE OF MY POLITICS?? THAT IS THE BEAUTY OF THE INTERNET, EVEN PEOPLE LIKE YOU WHO CANNOT FORM A COHERENT THOUGHT HAVE AN EQUAL SAY IN ANY DISCUSSION.
"All i am saying is that american people are in great danger by allowing people like you to get the GC and citizenship."
SOMEONE PLEASE GO AND WARN THE AMERICAN PEOPLE OF THE GRAVE DANGER !! NOT ONE WORD IN THIS ENTIRE POST OF YOURS CAN EVEN PRETEND TO BE PART OF A LOGICAL THOUGHT !! WOULD YOU CARE TO EXPLAIN WHAT THE DANGER IS? WHY IS IT SPECIFIC TO AMERICAN PEOPLE? YOUR PREVIOUS PARA SEEMS TO IMPLY THAT I AM ANTI-IMMIGRANT, NOW I AM ANTI AMERICAN??
This is precisely why IV hasnt achieved its goals till now and probably never will.

First of all Congratulations desi#### and thanks for continuing to support IV.
Interesting discussion going on. Yes, I agree that most of us here are waiting for our GC and some of them go on to become US Citizens.
I believe that becoming a citizen of any country is a person's choice, so let us not give desi### a hard time here.:o
But I certainly do not think it is an 'achievement' to get a US citizenship, just because it implies indirectly it is an 'achievement' to let go off Indian citizenship. Nothing meant to offend you desi#### but it hurts when one reads such a statement somewhere deep inside the mind. But hey, as I said earlier, to each his own and noone should be judging others in their decisions.
And it is not only Indians becoming US citizens every year. There are others too.
Personally, even with all the advantages as stated above of being a US citizen, I will never let go of my Indian passport. Even if the authorities give it to me tomorrow in a lottery;) Never.
Why? Because my identity, my rich heritage, my family roots, my parents, my culture everything is Indian and am proud of it. There are lot of sentimental and emotional attachments. I was going through the OCI articles today after reading this discussion.
It is not exactly a dual citizenship. Some clauses are no voting rights! No Indian Passport!
Getting a GC is another thing, but when I decide to go back after a couple of years, I would definitely want to retain my voting rights. ! I rest my case.
I totally understand the emotional point of someone being want to be a Indian Citizen but I have to stress there is no other country in the world like U.S.A. This is the country where every human being is treated with utmost respect (don't try to show me exceptions - U.S. is a country where most of things are close to being perfect imaginatively), have freedom to say anything they want without getting intimidated and U.S is a country I believe will be the last bastion for humanity when terrosists/fundamentalists spread their tentancles and take over the world by force or other means (if not now probabbly in the next 100-150 years). Hypocrisy is relatively less. We Indians live in a dream world nurtured by the Indian politicians, who try to inject doses of patriotic non-sense into the masses while they themselves stove away million of dollars in Swiss banks. 70% of Indian population lives below poverty line and the educated masses of India think that their country will become a super power by 2020. Politicians like Mayawati play caste politics and dream of taking the top most post while our liberal media, without a wee-bit of shame, extends its highest support for them. Corruption is part of our daily life and we are part of the everyday corruption but we still find no fault in our society. Our population growth is beyond control while not a single politician is concerned about the stress it is going to create on our natural resources in the future. Our education system is in shambles but our great politicians fight for increasing the reservation system to different castes just for the sake of garnering more votes. And the list goes on. AlasGod help India.
FYI: I am a Indian and haven't even started my greencard process, for the same emotional reasons you mentioned, intending to R2I soon. Given a choice and circumstances, I would have opted for U.S.C as "I have no hope for this world neither do I wish for it" - quoting Bhagawan Krishna from Bhagavad Gita.

Ok, if advertising is too far-fetched, then hold some cultural events and make money on those. Brainstorm with members to find other ways to make money. People are not going to contribute. That is the writing on the wall. There is lack of trust and lack of faith in IV. IV will have to figure out ways to generate cash from other things than member contributions. If I remember correctly, people contributed nearly $200K and have got nothing to show for that.
These suggestions are because you think money is the issue. I don't think it is. It's the lack of good leadership. That is my opinion and it was point of my original posting. Lack of money is being blamed wrongly. But may be I am wrong.
Attack my ideas and not me. Then we can have a debate conducive to achieving our goals.
