And that's never gonna happen. All Green Card seekers have stopped filing in EB-3, they are somehow managing to file in EB-2 by hook or by crook. So until congress changes any Law, every single spill over visa will be consumed by EB-2s and EB-3 India is not going to get a single spill over Visa...

This is in reference to a thread about feeling depressed by retrogression or labor backlogs to stuck FBI namechecks or whatever it is that depresses you. Not criticizing anyone in particular so dont aim for me.
Yes, and a lot of people know that there are highly skilled people who are depressed and that takes a toll on employee productivity.
After all, if 90% of your time is spent on thinking about BECs and visa bulletins, imagine if that time was spent on doing the job they've hired you for.
Some employers(like Microsoft) realize this and want to do something about it. Its not just about keeping the best and brightest here in USA. Its also about keeping the morale and productivity up.
As to how to deal with this...try this.
Call your local congressman's office(Find out info about that from House.gov, with your zipcode). Get an appointment with congressman. There is an Easter recess coming up when they would be back from DC.
Then talk to him about all issues you have. Take all the material you need from the "Volunteer" menu item of this website.
Doing something about the problem is the best therapy there is. I am not saying this because I want to coax you into meeting your congressman. No. That's not the objective. But I think action is the best remedy for this problem. And there is actionable stuff to do about this. If you are suffering from terminal cancer, then you really cant do anything about that. This is not such a problem. This is a problem for which the solution is out there.
Somehow, after landing in this country, people lose the appetite for risk and adventure. Before they are in here, they would move mountains to score an H1 or an F1. After coming here, they hunker down, heads-under-the-desk kind of approach. What I am talking about is nearly 200 people right now, who have read this post, but havent logged in. They wouldnt log in. They wouldnt give their real email address if they sign up. They would never contribute. WHY? Because they are afraid. That they will be deported. For no reason. Everything we do is legal, including raising funds and spending it on lobbying. But they are afraid. They are also afraid that by talking to congressmen, they will make them mad and the congressman will pick up the phone, call USCIS and then get their 140 cancelled. Yes. People create their own fastasies and become afraid of them..

After paying taxes, after following all immigration laws, after getting all the education in the world to become "Highly skilled", the highly skilled cant bring themselves to stand-up with a straight spine, thump their desk and talk to their lawmaker.
So at the end of the day, if we are depressed that legals dont get attention, then you know where to look for blame : the highly skilled who are highly educated and too afraid because their education and skills make them think too much and analyze too much, and they are afraid all the time.

I know the post was entirely wrong and foolish.
But I feel that I am in the dark about IV activities for the past one year.
I am one of the silent IV Supporters and long time (from the beginning) monthly contributing IV Member.
It would be better to have a special thread/monthly bulleting page from IV to tell the members to know about IV activities or progress.
After the last year July fiasco issue I have not seen any posting about IV activities on the web site other than lot of threads and could not able to figure out the work IV is exactly doing.
I strongly believe because of IV core team only we were able to come through successful in July 2007 Bulletin issue. But do not know what else is IV doing for the past 12 months.
The Flowers, Letters and Phone Calls is not working as we expect. I do not know about other activities other than sending letters and phones during every congress session.
I believe IV need to do some thing different. There is no media reports about legal immigration issue (not for IV) for the past one year.
My perspective is that we need to find a way that Media and Public will aware of the issues we face every day.
I am not questioning the IV Core Team. It would be great if the IV members know some details about IV activities every month in a bulletin or thread etc.

We have to understand that there is a myriad of laws; INA, CFR's; USCIS policy binding memos; internal memos; appeals decisions, court cases, precedent aao decisions, precedent legal cases.
Now; the ac21 memo is a memo that uscis officers have to follow. However; the memo is not in accordanc with INA 245 or AC21.
INA 245 states that a valid and approved 140 is needed for a person to get lawful permanent residency.
ac21 says that a person can change jobs after 485 has been pending for more then 180 days.
The above two things are the law.
In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
USCIS in their memos realized that ac21 law would not have any meaning if the employer still controlled the 140 if a person was eligible for ac21; therefore, they issued the memo (memo is not law but binding; memos can be changed; however, there has been nothing public about any possible change).
Memo is clarification which they have been following for many years and as far as I know still binding.
If we look at all the denials on 485 - when 140 is revoked the officer quotes "INA 245" and when MTR is filed - the case gets reopened stating AC21.
It is clear that AC21 supersedes the INA 245 rule.

Listen we are giving our hard earned money to this group, we beleive that they are the only ones fighting our cause. Can you please name one more org/group that is doing the same. The industry that includes esteemed Bill Gates wants more H1bs, no on talks about our releief. What open mind are you talking about? Get a reality check. We are not a frat house here that we are applauding each other. We want constructive criticism... e.g. if you think you are a better leader step up and say you can do x, y, z.

Sent in my contribution, even though i havent started my green card process yet .. and may never get around to starting it if the GC status quo continues. However, this is a just and commendable cause, and I believe we should do all we can to get favorable reforms passed now .. strike when the immigration iron is hot.

I am also in same boat. I have been keeping myself busy with studies, I was able to complete MBA and as well PMP. However, I would like to caution people on study front. Please give lots of thoughts on what do you want to study. One of the problem which I am facing after my MBA degree i.e. I am more frustrated being stuck in current position and doing something for which I am over qualified.
I would be interested in knowing about prospect for folks like us in Aus. I would appreciate if someone on this thread provide some clues on Aus.
I went to India couple of months back and there are lots of opportunities. But, I am not convinced if Indian market will be able to sustain this momentum over long period of time due to infrastructure problems and weak governments.
It is good thread and we should keep sharing our thoughts.

I recently went to South Korea and entered the US on the AP since I didn't feel that I had enough time to wait for my H-1B stamped in my passport at the US emabassy in Seoul. Before leaving the US, I consulted with my attorney on this issue and she assured me that my H-1B is valid as long as I file the extension and maintain terms of the H-1B visa.
Per your attorney, you need to file an extension. How soon does one have to file? Do you have to file one even if the current one is still valid for more than 6-month? Have you done so since your travel? Thanks in advance.

Most of the people on Immigration Voice come here for legal advice regarding immigration, what if IV negotiates a good rate with 3-4 Immigration attorneys and recommends those attorneys to members? Attorneys would get business due to IV recommendation, IV will get referral fee ($100-$200) per referral and members will get discounted rates from good attorneys.
Do you think this can work?
