Do you guys think it make sense to buy a Flat/Single family house in India , I am going to india in Mid october. Should i take the lunge and buy some proerty there...This would be the first home..so no Home equity Loan..It will be on 12% interest Rae from some indian bank.

Right, but employment and family are further broken into sub categories. Which group is FX (F1, F2,etc) and which one is EX(EB-1,EB-2,etc)? I see these two categories that are generally not in the visa bulletin I see on the state gov's web site:

Now when they see a chance to push for Schedule A worker visa increase, we start pushhing for visa numbers.(1-485 gone now)
Think for a while that there might be so many organizations supporting illegal immigrants that has plenty of money and are unable to pass anything.
They protested on the streets..president pushed for a reform and what happened. Most lawmakers do not have any Idea about legal issues,
so these law makers can and will only attach our reforms to the comprehensive bill.
Why can't people think in a broader prespective.
So why we bother now and say we are pushing for this ... that ... and when we could not get any results we hear from IV that the text of the bill is decided way in advanced.

For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!
I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.
Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.
THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.

Even reading this discussion, NOT ONE PERSON has attacked the argument on a legal basis. INsults are aplenty though.
Legal arguments were already dealt with in the other thread, there is no basis to sue, as the porting is well established law. So is the requirements for EB2.
Regarding the EB3 to EB2 shafting EB2, well, you already know that most people will not be able to port because they are not willing to change jobs, or that the company is bit too strict about playing with immigration laws.
Also, a point to be noted when you say EB3 has had the opportunity -- you too had similar opportunities. You too could have been EB3, gained experience and converted to EB2. Instead you decided that it was in your best interests to follow your dream of getting a PHD -- a choice, I dont think you are be ruing, but for the fact that you find yourself placed behind all the guys who did not do PHD.
Plight of EB2? I think not. Even with EB3-to-EB2 porting, priority dates are well ahead of EB3 (even without the current jump, EB2 was around mid 2004), and now, I guess when it returns to normal, would be around 2005. So while not exactly current (like EB1, shouldn't they be "similarly entitled" to have a superior lead times), the wait times for EB2, compared to EB3 hardly justifies it to be called "plight".
But then again, to each his own. EB3ers other EB2ers waited almost 3 years for our LCs, people with 2006PDs did not even wait 6 months for it (both EB2 and EB3) -- and worse still are people stuck in BEC (who waited 4-6 years). And yet people in 2006 complain that they have "horrendous wait times".
EB3s saw tons of people getting through substitute labor, people who have no right to cut into the line ahead of us, significant portion of these cases (including EB2 substitution) are fraught with fraud, however the law was weak, and there was nothing that we could do to prevent such things. Lawsuits are useless for us to weed out such applicants, or even question their earlier PDs because they are protected by the then current laws.

@snathan oh no he never got me any interviews , he was basking away in the sun with his wife on the hammock with him, these were all my efforts of trying to find a job somewhere by posting on job sites, calling up companies, using my friend's reference, but i realize that even doing that companies here follow a longer process or some no process to actually keep the candiate informed about the status. This was way different in my home country.

I think we should emphasize HR 5882 and write to:
1. The President ASAP
2. Immigration Subcommittee
3. All CHC members
The intention is to bring this bill to the floor this year and make sure it is passed.
I think people with PD 2001, 2002 and 2003 should definitely write as they have a better case than the 2006 or 2007 filers.
This is our last opportunity this year to let go.

AC21 doesn't contradict any law. AC21 memo is a real memo. It provides guidance for areas that are not clearly defined. So no point in comparing AC21 memo against the latest illegal memo by USCIS.
Memos are for interpretation of laws by USCIS. Any memo is advisory in nature and does not have force of law. These memos, unless challenged and turned downed by court or withdrawn, are valid.
Your saying that memo is illegal does not mean anything more than your personal opinion.
H-1B petitions have denied in past based on employer-employee relationship, unable to specify duties at end client, and self employment cases. If you are interested, let me know, I will put links here.
PS: This does not mean that I personally agree/disagree with the memo. This is just to show the legal aspect of it.

Yes many employer will open a new company but given a choice to follow the law or open a new company and start from scratch; I am sure most will follow the law. Also how many new companies will they open. If everybody files a complaint every time someone is exploited the employer will have to either stop exploiting or stop doing business.
Just because your employer is willing to steal your money does not mean you let them do it. Just because a person is ready to make you a slave does not mean you should become a slave. Let them do what they want to do, we all should do what is right and what we have to do.

Just because your employer is willing to steal your money does not mean you let them do it. Just because a person is ready to make you a slave does not mean you should become a slave. Let them do what they want to do, we all should do what is right and what we have to do.

Does it includes dependents too,any body knows it,I am not sure but my guess is it includes dependents too,thay too have to file a 485 correct me if I am wrong.

Right.But in your case, the guy who recieved your packet..might have mistakenly stamped the postmark date as the RD date . If so that is definitely their mistake. Wait a week or so to see what happens and if you dont' hear anything, take an infopass appointment to sort it out.
