I agree I too have never seen H1B only ad's anywhere even body shoppers never post this kind of ad which is blatant discrimination. .

The link is related to the fingerprinting background check. Almost 100% of the time the automated system returns an FBI record (an existance or not of a "rap sheet"). Only in rare cases when the finger prints are not clear USCIS sends a new FP notice.
The issue here is the FBI name check which returns less than 68% in the automated response. Around 32% of cases (485/n400) are delayed of which less than 1% really may have a negative record most of which are reported by IBIS and finger print check.
FOIPA only provides main file check report (not reference file report) which in any case is worthless for most applicants who have never committed a crime but are stuck in the name check due to a flawed soundex alogirthm that is applied for both roman based and non roman based names. I was absolutely pissed off with the "local" ppl that got greedy and dragged the whole economy with them. Seeing that there are ppl like you (one of us) who are pretty much the same, i am seething with rage. Because of idiots like you, people with a pristine credit history of more than ten years and some saved money cant buy a decent house in the bay area (and elsewhere) and have to see their hard-earned money go down the drain in 401k and stocks.....I wish ppl like you rot in foreclosure hell and no one ever lends credit you, ever again!!!

So since you haven't bought house, you don't have negative equity or declining value home.You haven't foreclosed so you can still get loan at decent rate and buy house at much cheaper price. All the people with money in the market are affected by recent downturn. So relatively speaking you are doing much better than a lot of other people ....
BTW I am in the same situation as you are and waiting for good opportunity to buy house at cheap price. Do you see the positive side ? I hope you do .....

So USCIS will never see the flowers becoz they are boxed.. and they will never get delivered becoz they are being routed from the airport itself. No major news media covered the few deliveries at USCIS.. What was the point of the campaign again?

What happened
We were at the loading dock by 10 30 am ( Delivery estimate was between 11 am and 1 pm) and DHL appeared to
have already delivered around 50 boxes once around 9 am. All the flowers we sent are boxed . The visuals will
be boxes and not flowers in the evening when the youtube video will be uploaded. UPS delivered nex. We got the
video of the whole delivery and so did the CNN-IBN/Voice of America folks. There were around 30 boxes or so from
UPS. Next Fedex delivered and there were around 10-15 boxes coming out. While we were doing the recording one of the
officers politely told us not to capture federal buildings and we told them that we were only capturing the delivery of
flowers. After this what ever truck was coming in, they were reversing and pushing back into the dock so that the
delivery cannot be taped. CNN-IBN reporter asked for permission to go inside the loading dock and she was promptly
denied any permission. Then We had a down pour for almost 20-30 minutes and we had to leave the place.
It appears that the S&H dept now knows that most of the flowers are being delivered by DHL/UPS/FEDEX, they are taking
care of the diversion at National airport it self.
In the future if any one wants to do a flower campaign, Please select 2 local florists
(only two florists, in that particular city) and have people call and place orders/online. That way
we can talk with 2 florists and track their delivery easily for picture/video. Every one who tried to call
FTD/proflowers had alot of trouble getting any thing out of them. Actually, we cant blame them because they
are not doing it locally,instead they are putting their orders via national carriers.
Where do we go from here
If people really want to go out and get the main stream media attention, DC is the perfect choice. How ever,Don't plan on a weekend. If we do it right, we could be live on TV and the whole country will ask whats going on, along with the law makers. That will offer a platform for solving the issue at its roots.If you really want to do this, Dont come up with reasons like I dont have time off for a day or I have a project due. I can understand if 1 or 2% of our active members say it, but when 98% of our active members say that I can understand what it is. May be its time we figure out whether we prefer anonymity and pontifical verbatim on the online forum to expressing our concern/disappointment openly. Do not get offended and start flaming me. Just my thoughts.

Hey mind your business. You don't know a thing about India and I am sure you wouldn't have even visited once in your lifetime. If you have problem with individuals, companies, sue them find legal ways to stop their wrong doing. It is good for everyone. Dishonesty is not a patent of any country. DOS has alloted most unused visa # into EB2 category this year, and EB3 was stuck due to no additional unused EB1 visas.
Visa Bulletin mentioned they did this in according to the requirements of Section 202(a)(5) of the Immigration and Nationality Act. But actually this might be a misunderstanding of Section 202(a)(5) and Section 203(b) - There is NO words in the act on how to allot unused visa # to differnt categories. Even the country limit and category limit would not apply if there are unused visas #. The allotment Mr. Charles Oppenheimer did horizontal spillover caused longer and more backlogs of EB3.
Congress has a concern on the backlogs and Bush's administration promised to reduce backlogs as much as they can. If Immigration and Nationality Act allows the government to spillover the unused visa # to EB2 & EB3, and a more humane and fair system should take care of early priority date first and do whatever the government has promised, should we ask Mr. Charles Oppenheimer to think about alloting some unused visas to EB3 so it can move forword a little bit?

First: Priority Workers: 28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.
Second: Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employment-based preference level, plus any umbers not required by first preference.
Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to "Other Workers".
Based on the above EB1 spills over to EB2 first.....Eb3 gets unused EB2.
EB3 gets EB1 only if it is not used by EB1.
I'm EB3-I with Oct 2003 PD and I understand your frustration. There is hope only if a legislation change happens. Based on my calculation, there are about 50K to 60K EB3-I pending before me.

DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.
Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?

OK, DOS buffer issue.
A. LAW. If there is no inventory in EB2 I/C (meaning demand). Theoretically DOS should make EB2 I/C CURRENT. DOS/CIS are not that dumb, or at least as dumb as before. I would say, they are very competent now and we should appreciate their work, pre-adjudicate, publish demand data (DOS), inventory data (CIS) processing time (DOS). THEY know, from PERM, I-140, there are at least 2K demand permonth from EB2 I/C. SO they will just safely move a couple of month of PD to make sure there is demand >2800 for India/China, so they don't have to make it CURRENT (per law)
B. LOGISTICS. There could be denials, RFEs, although most (I believe almost all 100% pre-07/2007 EB2 I/C) should be pre-adjudicated now (THANK DOS CIS specifically did this so no processing time, and no waster numbers hopefully). That is why DOS has to consider that in their demand, and CIS has to consider that in inventory numbers
C TIMING. Charles is shooting a moving target as well (his job is not easy as he cannot predicate future 100% and has to follow law, and use all visa numbers, we should appreciate that). Charles has no control on CIS number accuracy (I am sure CIS is trying hard as well), how fast EB1/EB2ROW/EB2I-c pre-072007 could come in, hey even some CIS employees need vacation in summer. So he has to make sure things can be done before August, so August could be only a month for fine tuning, not massive approvals, new applications (CIS wont look at them any way but takes man power), to use up all numbers and have some new applicants to keep the inventory (demand) at decent level.
I am July 2007 PD, and we all have hopes, dreams, life, etc, can can distort our judgement. We can discuss, but may to suppoert each other, and those warriors in DC. But hey, things could happen against our best intentions, wishes, anything can happen. SO life it short, live once, enjoy the ride, love people, appreciate love, and HAVE a great weekend, have fun.
I too had similar thoughts.. why would CIS/DOS stop keeping buffers? Is there any particular reason? Once they complete all 7/2007 applications I think it makes sense to move the date for a few months so they can accept applications. Also, remember there will be new monthly quota getting allocated to all categories. So to use those numbers should they not be progressing dates?

Charles has no control on CIS number accuracy (I am sure CIS is trying hard as well), how fast EB1/EB2ROW/EB2I-c pre-072007 could come in, hey even some CIS employees need vacation in summer. So he has to make sure things can be done before August, so August could be only a month for fine tuning, not massive approvals, new applications (CIS wont look at them any way but takes man power), to use up all numbers and have some new applicants to keep the inventory (demand) at decent level.
I am July 2007 PD, and we all have hopes, dreams, life, etc, can can distort our judgement. We can discuss, but may to suppoert each other, and those warriors in DC. But hey, things could happen against our best intentions, wishes, anything can happen. SO life it short, live once, enjoy the ride, love people, appreciate love, and HAVE a great weekend, have fun.
I too had similar thoughts.. why would CIS/DOS stop keeping buffers? Is there any particular reason? Once they complete all 7/2007 applications I think it makes sense to move the date for a few months so they can accept applications. Also, remember there will be new monthly quota getting allocated to all categories. So to use those numbers should they not be progressing dates?

Thanks ... normal options in USCIS asks you to call ICE.gov ... BUT ICE.gov doesn't seem to have a local office.. please let me know if anyone out there has gone this route and any update regarding what all documents we need to produce to prove our case. Since its a Billion dollar company they are bound to fight the case (hopefully). Any information regarding the same is appretiate.

I have had couple of LUDs on my cases (9/10 and 9/13) and nothing after that. The last time I gave my fingerprints were in Jan 2009, so I am sure they have expired. Should I proactively get the biometrics done (by taking an infopass and requesting biometrics notice) or wait for them to send me the notice?
Not sure if this will help if I open up an SR or take an infopass. Anyone got their 485 approved while their biometrics were expired?
My lawyer received a letter from USCIS asking for verification of employment and whether the position is still available and being offered to me. Once they respond, hopefully the approval will come through.

"Alaway complain" is the best policy. I got In-state tution for my wife and fought with the university for 4 months. Their rule said - You have to be a resident alien to get in-state. They assumed (because it brought more money) that only Green Card holders are resident aliens. I proved to them with documentation that H-1B and H4 are "non-permanent resident alien" for immigration status and resident alien for IRS tax purposes.
After 4 months university called me saying your wife would get in-state. They never gave it in writing....they still charge out of state to H4 candidates. So that you know, it is 3 times higher than in-state.
Only problem is ---after 7-8 years in this country I am getting tired of fighting these useless battles. I want to put my energy somewhere else, something more creative.
Like someone else suggested, I would never tell that I have EAD. Just say, I am authorized to work for any employer.

You can put any clauses in the contract as long as they are legal and the renter accepts it. But as 'albertpinto' said, beware of the people with bad credit and bankruptcy or people going through divorces - you may not want to rent them your property as it is very difficult to remove somebody (yes, even from your own house); it can take anywhere between 3 to 6 months and in the meantime, you are still liable to pay the mortgage if your renter defaults.
IMO, Only rent to people with good credit history.
