While the old world afforded the luxury of years to rectify imblances and imperfections in policy constructs, the new world leaves little room for inefficient alignment of policies.
The need to fix a broken legal immigration system is as much an economic reality as it is to address detrimental effects in womens' rights (spouses' rights), labor rights and free markets.
Folks, Sorry, The petition can't be changed even if it has 1 signature. It has close to ~700. I plan to stick with this. This petition is about that particular show. You are free to start another petition highlighting general issues with Lou Dobbs.
Again we can have several petitions and send it to CNN. If we have enough numbers there will be ample pressure on Lou to state the facts.
As far as CNN hiring H1-Bs is concerned it is an example of exposing the double standards within Time Warner Inc. I believe this petition is going to make the intended impact. You are free not to sign it.

Employment based VISA numbers should not have country quotas, it is purely based on individual talents and skills when one gets selected for the Job and Green card sponsorship.
Lets say they have quota system to avoid the concentration of 1 country, then they should have some flexibility to adjust the country quotas based on the backlog too, certain % of EB numbers goes to clear the backlogs each year, that way everyone will remain at about the same level of retrogression, EB-2 RoW current and EB-2 India @ 2006 level and on the same line EB-3 RoW @ 2005 and EB-3 India @ 2002 level is ridiculous and just plain insane. This is like a punishment to People who are born in certain countries and no matter how talent and skills the individual have, the law is punishing him/her or rather discriminating him/her based on country of BIRTH.

I think it is 45 working days, not counting weekends and holidays, that gives us 9 weeks of time to file for 140, that should be enough in most cases.

I know there was a long discussion about this a while ago. My PD is in 2005 in EB2 category.
Any guesses as to how long it will take without any reform? Is there a good guess on the total number of pending LCs in the queue? I would like to take that number and divide by 1400 (2800 for EB2/2).

Sometimes, the fears arise from watching too many movies. Like the movie "Enemy of the State" where some govt agencies hunt down Will Smith and unravel his life apart. Remember? Firstly, its a movie. Secondly even if its true, what's there to be afraid of??? If you talk on the phone about legal course of action to lobby, why would you be afraid of.
Like I said, you have to give some credit to the Irish. They have the chutzpah of going to lawmaker's offices in DC and say "I am an illegal...I broke the laws and overstayed my visa...please change to law to make everything ok again for me please...". And our community thinks that someone is listening to their phone conversation about how to raise money and lobby for the legal immigrants?????
There is a big difference when you are Irish and can blend with the americans.

Since this discussion has been going on for 5 pages, i thought ill add my 2c.
Firstoff i haven't gone through all 5 pages so if someone already mentioned this, please don't jump on me. You can create an SBI account called SWIFT account. They will give you an account number and a SWIFT code for the bank.
You can then initiate a wire transfer from any bank in the US. They charge a flat rate of around 35-45$. The good part is, you can have the money sent in $ to your local account. They say it takes 3 days but it never takes more than one day for me.
The money is saved in FD as dollars and earns you interest if you leave it for 11 months. If you need to convert it any time, you have to forgo the interest (as with any FD) and you can get the closing exchange rate of the previous day.
This has many advantages
1) one simple fee of 35$
2) In case you want to bring back the money to the us, since it is kept as dollars, you can transfer it back without any hassle. (To keep it in dollars , you may have to provide this as a special instruction)
3) Folks back home have control on exchange rate, they can cash it any time it is high
4) Takes less than a day in most cases.
If you do the math, you will see that this is better than icici when you are sending 4000$ or more approx. icici does not take fees upfront but they always give you almost 50p less than exchange rate.
I have used this 4 times so far and its very reliable.

The response is expected. Unless IV core members support nothing will move. Many similar threads came and go in past. IV is giving critical updates only to Donor members. So only donor members will know what is happening. Others will not know anything and will not have any direction. That may be one of the reason for poor response for these kinds of polls. If majority of the members are donors then that will be effective.

This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.
I say why stop there. Why not remove this entire nonsense of EB1 vs EB2 vs EB3 and go with a points based immigration , like they have in Canada? US immigration law is made unnecessarily complex just like their tax law.

One of my friends(who was in my company earlier) got his old H1 case reopened. He is not that worried as he already has left the employer and joined someone else.
This is little strange as USCIS is digging the dead.
I am keeping a close eye on my case which got approved in 03/2005 and has LUD of 08/2006. Seems like they opened the case earlier but I didnt notice it.

Meanwhile, my lawyer today emailed & confirmed that the h1b will be valid even after using AP to travel and one can also renew or transfer the h1b. Even after the current I-94 expires obtained using AP, if one has still valid EAD or H1B I-797, he/she will be in status. However she also said that this is tricky situation and she could not find any CIS memo.
HOPE THIS WILL STILL SOLVE MANY PEOPLE'S DOUBTS.
Now I see no reason why anyone should NOT use AP to travel. Why should ANYONE waste money and time for restamping and take a small chance???
However as "Ramba" said in post# 27, it is still a small chance as no one knows what is exactly the CIS rules.
