I�m July 2nd filer application reached to NSC at 9.1 am and signed by R Mickle
Till date my checks have not been cashed. When I Called service center yesterday they gave me Receipt Number for I-485 (LINXXXXXX) but again she told me that�s its Invalid then she put me on hold and checked something then see verified my address, Social security number also My Attorney�s Name and address. After confirming this information she told me Receipt Number of I-485 is yours but its Void in our system let me check it online and online it shows case received and pending.
Now she said its weird its showing Valid in online system and in our internal system its Invalid. Then she asked me did you file 131 and 765 along with this I said yes then she said let me check it and found nothing.
She has created one service request for me and asked me to wait another 45 days.
Meanwhile I told this matter to my Attorney and he told me not getting receipt is normal and I could have asked you to wait till October 15�th but you are there in the system and why they have stopped processing you applications looks strange to me also applications is not been rejected. So he told me that he will write letter to USCIS director to investigate this issue and assured me that as long as we are in their system so don�t have to worry but he told me that if Director don�t respond in one month�s time then we will go to court but he is optimistic that situation may not go to that.
If anyone of you in similar situation please let me know.

I think it would be fair to split the leftover numbers the same way they split whole year quota.
50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?
I'm wondering why you ask this question. It's not your or my perception of "fair" that will drive the DOS or USCIS but the letter of law. The law is not easy to change but the interpretation of the law which shows up in the US Code (USC) can be changed. Therefore the DOS changed their interpretation to match the INA better and my or your perception of "fair" will not change anything. On the other hand it will only lead to heartbreak and destructive discussions that lead nowhere.

how can it be free..when you pay 25/month?
I have vonage service since two years and i am paying 24.99/m since two years for unlimited US, canada and europe. They just added india in the international calling list so isn't it free? I am not paying anything extra for calling to india. I have been with vonage for quality and it is personal choice about which service you use and how much you pay for that. It all depends on usage and how much we spend on calling cards or calls to india. If you spend more than $25 on calling to india than this is a great plan if you have internet connection at home.

I do not know how many times this topic was discussed accorss various boards. Because of INA and amended provision in Ac21 act, all the unused visas from Eb1 goes to EB2 and if anything leftover in Eb2 goes to EB3. This is the law. This hurts badly EB3, as demand in EB2 is so high to consume the all the avialable Eb2 numbers. Moreover, country quota is not applied in each employment based preferece catagories seperatly /exclusivly, if the demand in each catagory is less than the supply. So, most of EB2 numbers consumed by India and China as worldwide demand for EB2 is very less than supply. There is no confussion in it. This is the law. Though it is unfair to very old EB3 folks (in their view) One cannot do anything to change it. unless congress rips of the AC21 provission by passing new law.
It is difficult to accept that a EB3 guy in 2001 pd stll waiting and 2006 guy gets gc. But this is what law is, USCIS/DOS can't do anything. If we talk unfairness, there are tons in US immigration. For example, a nobal prize winner gets GC in EB1 catagory has to wait 5 years to become citizen. However, if a stripper marries a US citizen has to wait only 3 years to become a citizen and there is no numarical limitations for a spouse of US citizen become LPR. How fare it is?...

And yeah, don't get lost in statistics, just because laws in US are designed to encourage corporate fraud in variety of forms doesn't mean corruption is any less. The only difference is low grass-roots level corruption which is direct result of differences in population density.

Those that have been effected by this EAD discrimination, file a complaint with the govt. Otherwise why are we here in IV asking for multi-year EAD?
So what if EAD has to be renewed. GC also has a expiry date now. Next we will be asked to provide medical history to make sure we do not fall sick at work. EAD renewal is an inconvenience that the employer need NOT worry about.

I just contacted my senator's local office .working on the letters now .Thanks IV for coming up with this wonderful initiative..I hope our community gathers around and works together to make this a success , please put bickering and cynicism to rest for sometime and work pro actively on this new IV action item..
