I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.
Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.
The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants. I am afraid that Senator Durbin will make the calls when Senator Obama becomes the president.
Please post your opinions. This is a very important discussion. It is very important that the community see what is in store for us when the new Administration takes charge.

The sequel has revived Gandhian principles and popularized the concept of Gandhigiri- literally meaning a symbolic act of peaceful protest across South Asia and the UK.

The best way to overcome what you think is unjust, is to protest peacefully. Be nice to your opponent and let him see your point of view. Several applicants have had to call off vacations or business trips to be in the US to file �adjustment of status� applications as part of the final stage of the Green Card process. If waiting time for GC is reduced less than 5 years then this may not be needed except for persons those who are filed GC before 2004. The environment is so tough that they trashed non controversial recapture bill on 2008. So it has to be decided based on how the CIR will shape up this year.
Do not think this to discourage or anything like that...

Good question:
The idea here is to prevent people in EB3 line to come in EB2 line. If you are already in EB2 line your are not affected. If you have masters you should be able to port.
I have a small doubt here. I'm still trying to understand this porting business. Why is that those who have already applied in EB2/Masters will not be affected?
If people with earlier PD port to EB2, it will make my processing longer, no? (IFF my PD is later than theirs')

2. In a holding area within NSC. -> Waiting for IO to pick it up.
3. On the desk of an IO.
If your app is in either state 2 or 3, the response from USCIS will be "your case has been assigned to IO".
My suggestion is ask them:
1. Has my case been pulled out of the storage area? If not, could you please request that [An IO can do this and I think this was the most useful thing in my case. She said that she will make a request to the contractor to get my case pulled out].
2. Has my case been picked up by an IO or is it still waiting in the holding area? If it has been picked up by an IO, nothing you can do except filling out 7001 form. If it has not been picked up by an IO, ask on the phone if an email can be sent to him advising that your case is current and waiting.
So, broadly, your goal should be to get your app moving from state 1 to state 3. Once an app lands on IO desk, it will take between 10-30 days to get it approved.

FYI: I opened SR on Aug 4th... Yesterday I got response that my GC is approved (but the status online was still Initial review) and now today morning my status changed and I got approval email and an SMS too.
Given the above, I seriously think SR works. They must have checked my SR and then approved my GC.

My wife recently started working using EAD. The HR folks there are well aware of EAD as there are people already working there on EAD. They did not have any issues with EAD. The only thing that they were saying from the begining is that they cannot sponser H1B and also the only thing they asked is whether she work authorization in this country. When she submmited the I9 form, the HR person just remained her to send the copy of EAD everytime she renews it

It looks like atleast 75% of EB2 I with priority dates 2004 seems to be approved, this should bring down the count of 2004 less than 1000 may be little more than 1000.

House Majority leader Tom Delay has resigned and will not seek the Majority post until next year. See here:

He voted in favor of HR 4437 that is a nightmare for illegal immigration but does not address the ones already here illegally. And no, there is no mention of legal immigration facing backlogs in this bill either. Just enforcement to crackdown on illegal immigration. Voting "Yes" by any congressman on HR 4437 should not be construed as either supporting or opposing the legal immigration and/or retrogression relief.
There are 3 house members likely to seek the position and replace Tom Delay:
1. Roy Blunt (Missouri's 7th District). http://www.blunt.house.gov/
Roy Blunt has gotten poor grades from Anti-immigration orgs. However he voted to support HR 4437 that deals will illegal immigration. His views on legal immigration are unpredictable at best.
2. John Boehner (Ohio's 8th District). http://johnboehner.house.gov/

Jeff Flake is one of the saner and more pragmatic voices in immigration debate. While he wants to crackdown on the illegal variety, he also understands the other reform need in other areas of immigration.
