Is USCIS doesn't give a damn about educational credentials why do they they have EB2 category for Aliens with Advanced Degree, EB1 category for Aliens with Ph.D, Uncapped H1 for Aliens with US degrees etc..
Even Canadian point based Immigration system assigns more points for aliens with advanced degrees.

Democrats is the name of another group of idiots. They don�t know what they should do when in spite of all their efforts to not get elected; they are thrown into the Congress as the Majority party. One thing Democrats are good at, they know how to give up majority in the Congress. Publicly, Democrats would pretend that they care for the poor. Privately, they too would want to love you if you are a gay. These are another bunch of idealogs, who, privately, would work day-and-night for the very poor and under-privileged group of people, unless you can show them some green and then they will be your best friends. Democrats think God is scared of US Chamber of commerce, so they only support illegal immigration.
Now, most people in EB backlogs are neither very rich company/big business owners nor the EB applicants are very poor. And to add to that, last time I checked, most EB applicants are not gay, unless the recent poll numbers would suggest otherwise. So how in the world do we expect to get our issues fixed if we are neither rich business owners, can�t pretend to be very poor nor are we gay? I think we are toast�.
As far as EB-1, 2 & 3 is concerned, these categories are created so that some people, as seen on this forum, could just stroke their egos thinking that they are better than others around them. In essence, this is another form of discrimination so that people like you and others could fight on forum like these ;-).

When USCIS has so many I-485 applications, they will have to sort them in the order of PD. Your PD is older and you will have your GC first. However, its unpredictable when you will be able to file I-485.
They will be opening up dates slowly in the Visa bulletin going forward. However, they would open up 2003 PD before they reach PD 2007. You will be able to I-485 then and will have GC before someone whose PD is in 2007.

We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

Having spoken with several congressional aids I can say that such issues are well received. The specific issue that I have raised (it does not affect me) is examples of people leaving USA and having to explain to their US born children why mummy and daddy are not welcome in the USA, and thus why they have to grow up in a foreign country.
I have also given examples of one sibling being born in USA and other aging out.
However, I have only raised this where law makers are known to be sympathetic to family immigration, e.g. support DREAM.
I think that the best we can do is:
Get wait times down (and reduce impact of this).
Use this as an argument with those who support family based immigration (and may even be hostile to EB otherwise).
If we have an opportunity to address this as part of other EB legislation we can.
It is certainly not forgotten by me.
I do think that it would be helpful to have a list of people in IV with this problem (with ages of all children plus relevant dates). For the moment I'm too busy to organize this (busy with IV work -- like 4am bed times).
More active help (not just forum discussion) with IV is always welcome, so you are welcome to step up and help (e.g. compiling a list of such members etc.). Politics is personal so being able to present personal cases is helpful.

This question has been posed before but I did not find answers so am posing too: When can one travel safely to India after applying 485?
1) If EAD and AP are filed along with 485, how long will they take to arrive. Service center dates indicate that EAD and AP currently at Jan 07. Does that mean that they are taking over 4 months to issue EAD/AP?
2) There is a an Interim EAD. Is there an interim AP if AP is pending for over 90 days?
3) Is it possible to request EAD/AP at a later time?
4) My H1B is up for reneval in Oct 07. Can I get a 3 year extension on H1, apply for a H1B visa in India and travel back to US on this? Would this be a faster option?
5) When do FP notices typically come out after applying for 485?
6) What is the grace period for FP if one misses the deadline (Is it still 12 weeks? Will the new rule to remove 12 weeks on RFE/NOID have an impact on FP?
7) If you are using an attorney for 485, will all such notices (FP, etc.) go to the lawyer as well. The concern here is that if the notice comes to my home address and I am out of the country then I am liable to miss that appointment.
Please with experience/knowledge, please share your information.

Hi,
I first applied Green card through the EB3 process and my priority date is March 2003.
Since there is very little progress in EB3 category, i convinced my company to re apply in the EB2 category as i got promoted (Salary increased) so that i can keep my old priority date. They re applied in the EB2 category and i crossed the recruitment stage and waiting for the PERM to get approved. (applied 3 weeks back).
Now i am current in EB3. Now, i am not sure whether i can go forward and file for I-485 under EB3 or wait for my new PERM spproval and apply for i-485 under the new EB2 category.
Please advice.

I got the same audit and Lawyer, Employer and me have to gather all documentation.... For business necesity they asked me to prepare a letter for this with all the skills needed for the job and support why a person needs XX years of experience and XYZ skills in the job.
I received an audit as well. DOL needs docs as below. How long does audit cases take to process? Seems like my attorney missed some docs or is it common audit as he said it is a random audit?
1. The documentation listed on the following attachment supporting the
attestations made on the application
2. A copy of the submitted ETA form 9089 with original signatures in Section L(Alien declaration), Section M(declaration of preparer(if applicable)) and Section N(employer declaration)
3. Proof of business necessity as outlined by 656.17(h) if the answer for question H-12 is no, the answer for questions H-13, H-15 or H-17 are yes, or the job duties and/or requirements are beyond those defined for the job by the SOC/O* Net code and Occupation Title provided by the state work force agency.
4. Documentation required for live-in household domestic service workers as outlined by 656.19(b) if the answer to the question H-18 is yes
5. Notice of filing documentation as outlined in 656.10(d)
6. Recruitment documentation
Any suggestions?

that the current application processing range is 6-10 months after filing. Given the current economic conditions, it would be beneficial to see the application approved rather than worry about delays.

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

It might have been answered before elsewhere, but I'm wondering about the logic on how the spillover visas are allocated. Would have been nice if the spillover visas are allocated to oversubscribed countries instead of categories, this way 10k spillover visas that EB2-I is getting now will be distributed equally between EB2 and EB3 ... I believe that's one thing IV is going to or has taken up.
Looks like parents did a good job of taking both the sick kids to hospital, but the doctor treated only one kid saying that the second untreated kid is not good as the one getting the treatment :D ... if the 2nd kid survives thru the period of time the 1st kid recovers without any treatment, then the 2nd kid will get the treatment.
LOL, why am I extending the topic ...
I for one would like to know exactly what IV is planning to take up for the cause of EB3 before contributing.

Folks, sorry I have not been in much action, with other stuff taking priority, but I would definitely like to know what it takes to do this? I have completely lost fitness due to bad lifestyle, long commutes to work, working spouse, small baby, and other tensions and I like this idea a lot.
Nolaindian - can you briefly explain how this marathon works? Does every city have a marathon to which we register, is it a community? Who sponsers? Do we do it as IV? Do we all form a group. Are the rules set by us? Do we pledge????

There are just too many fond memories to share in one post... but I do want to specially thank leo2606 who drove 70 miles to pick up myself, venkygct, vsraja and punjabi at the Dulles airport and then took us out for breakfast, then to the rally venue, then for lunch, finally to a hotel room we had booked for a quick shower, basically... like a shadow he was with us wherever we wanted to go! And... whenever we thanked him (and gdhiren who co-ordinated pickups/dropoffs for many ....
A Special thanks to the Lets Partner to Increase Thread. I am proud to say that I am a successful graduate of that thread. Three members including Abhijit found sponsors for my ticket and thats how I was able to represent Texas in the DC Rally.

There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Deadline = April 30th, 2011
Goal = 5000 votes on survey (see I-485 filing w/o current PD thread) and momentum to continue with this campaign.The survey is a platform to gather and push for launching action items. Based on response by 04/30/2011 - IV will decide whether to even proceed with initiative or not.

As suggested by pappu/starsun, this supporting thread provides impacted members with additional information and tools to help the initiative.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Then please send an email to ivcoordinator@gmail.com (starsun) with subject - "I485 filing without current PD - Impacted Member". Include your a) IV username b) Email address c) Phone #, d) State of Residence e) Priority Date - so that grassroot efforts can be coordinated
2) Print out below Flier and circulate at all asian/indian malls/groceries/theaters. Forward the flier to your friends/co-workers and ask them to do the same.

3) Volunteers have created a facebook community and an Immigration Voice WIKI page to spread the message about this initiative. Please circulate these links among your friends/co-workers who will be helped.

hellomms Could you gather all such people who are facing this issue and want to join the effort to fix it, at a single place on an IV thread. Once we have a sizable number of people to take initiative this effort can be successful. It is difficult to divert attention and resources for a single person. Each immigration issue that our community faces is important to the person suffering from it. IV is a place where people can get together and do something about fixing it.
I am willing to take the responsibility of gathering dates of people that are stuck and waiting for a reply.:)

Good to hear this....though I am :mad:.......i am really happy that i have my lovely wife...kids....home...etc.....nothing wrong in my life....if i have the gc i will be more happy....

Difference between genius and ordinary is the former will understand without experiencing. Latter needs to experience to realise.
Having a perfect health, family and yet looking for this materialistic paper to make you more happy. Beats me.
How about this?. I will trade my GC to you , would you chop one of your legs for me?.
Health is the biggest wealth. Be happy with what you have. Focus on better things which will improve the life of your family and make them happy. Focus on things in your control.

Started new process with same employer in September 2010
Applied PERM in Jan 2011 and got approved in 10 days
Applied I-140 in April 2011 and got approved in one week
Priority date recaptured and I-140 has the old priority date (Sep 2004) and same A# as previous one
Opened SR with USCIS in first week of May 2011
Informed customer service that my Priority date is outside normal processing time
Received an e-mail after couple of days "There are no visas available to process your I-485 application. Your priority date is EB3 September 2004 which is later that the cut-off listed on the visa bulletin for your preference. Thank you for your time. This inquiry will be considered closed."
Any ideas or help is much appreciated.
