I am renewing my passport at Houston and sending it via mail. I was on F-1 originally and changed to H1-B last year. I do not have a H1-B stamp yet. What visa document or visa photocopies should I attach? Do they have to be notarized?
I have only have the new I-94 showing my H1-B status.

Hi All,
MY LC (PD May 2003) is still stuck in DBEC. So I may or may not be able to file withing Aug17th.
My question is regarding the procedure used by USCIS to process AOS applications. It would be great if someone could explain this to me.
These are my questions:
1. Is the AOS application processed by RD or PD?
2. Once USCIS starts processing the I485, do they check PD at any stage, or is it just used as the initail "gate " for allowing I485 application submission?
3. Suppose Tom with a PD of July 2006 applied in July 2007. Then Harry's case gets approved by BEC in August 2007 and he applies in October 2007. Who will get the GC first?

let me try to answer your question the best I can. Answers in order:
For all purposes: lets assume 2 examples. Person A PD July 2006 and RD of July2, 2007 and Person B PD April 2006 and RD of July 2, 2007.
1. AOS is processed by a "combination" of RD and PD. As per the current Bulletin BOTH A and B can apply. The Service centres are currently processing September 2006 applications. When they reach July 2, 2007 processing dates, both applications will be picked up and then "thoeretically" they should ask for Visa number for A BEFORE asking a visa number for B as A has an earlier PD.

3. If Harry's case gets approved in August 2007 by BEC he WILL NOT be able to apply for I-485 as the July Bulleting is valid only for applicants VALID in july. Guys..
I paper filed EAD renewal two times...took 2-3 months to get card in hand..
This time I tool chance and did efile...in 1 week (yes one week)..I see card production ordered status online..
There is no doubt about address etc..u get address on the receipt...
Hope this help..
Only catch is that I have seen status online...will post once I receive card in had..

ETFs (simple definition) are a hybrid of mutual funds and stocks - they are similar to mutual funds in that they represent a basket of securities (for example stocks or bonds) but they trade like stocks (i.e. they can be bought and sold throughout the day and their quoted price changes as they are traded throughout the trading day .. mutual funds on the other hand are priced only once at the end of the trading day).

I am in a similar situation. My wife who is on H1B did not worked till date.
Is it possible if she carries the vacation letter from the employer and go to India for H4 stamping? My wife do not have any paystubs.
I have also contacted my attorney and waiting for his response. I am running out of time due to the GC priority dates being current. If the attorney does that while she is in the country, it would take around 4-6 months. By then, the priority dates might be retrograted.
I believe you have a answer. Please respond.
It will be very difficult to argue unpaid vacation for > 50% employment time. There is alawya a risk of getting Change of Status approved without I-94 and could result in I-485 denial if out of status > 180 days.
Out of Status is NOT an issue for H4 visa stamping.

One other option you can pursue is to just go out of the country (Canada/Mexico) immediately after quiting your job and get H4 stamping and come back on H4....I would advise to talk to a lawyer regarding the first option.....Good luck with your MBA...

I am not sure if a letter is going to help. I was going to suggest an SR but in your earlier post you said that your SR didn't work either. But if you are going to send a letter then I would suggest sending it to NSC. Your lawyer would have the address.

So I read that the amendment for recapture has been removed from the funding bill. Guess we are back to the start again? This really makes me to start hate the fact that we are held as the hostage of illegals

EB1-I get their GCs in about a year.
EB2-I get their GCs in about 6 years.
EB3-I get their GCs in about 8 years.
SO WHAT IS THE BLOODY PROBLEM??? Wait your turn patiently like everyone else, or upgrade your skills and education to apply for EB2 jobs. Stop bitchin' and moanin' and trying to find shortcuts in life. There are none.
Do not write negative for EB3 people. A lot of Eb3 people had master's degree, But their companies are not willing to file EB2 instead of EB3.

Definitely agree with herd mentality and haste, but can't blame them also. What if the dates go back again next month. So its a catch-22.

What i am trying to say here is firstly reaching congressman should not be on the first day itself which some of the folks are doing, atleast wait for a a couple of weeks. and then regarding opening SR i would say atleast wait for around a week or 10 days at the minimum if you are scared of dates moving back. And yes i am not pointing fingers at any individual so don't take it personally "gc_on_demand"

I am also struggling to get my GC. It is my 9th year in H1B visa. My intention is, atleast we can reduce the period for waiting to get the citizenship. It can also be considered as a good benefit for our community. Just my thoughts...

There are certain rules that govern PR & Citizenship statuses ( of all countries)and only land mark & ground breaking edicts can alter such law’s , and that too very slightly. To put it were tersely "this is a bullshit suggestion" and is really wasting the purpose of this forum. The only reason so many people have responded is that it is "THAT RIDICULOUS"

Pattern seems to indicate - ND and no complications, leads to approval! PD does not seem to hold any relevance as long as it is current! All of those who filed in 2007 and are current - will likely get it this month! Those, like me, who filed in last year's window can hope to get it by next year!

Yes, since H4 is tagged to your H1, you should receive your H1 approval too...Yes, you will be receiving a I-94 too along with the approval notice..The I-94 should be attached in bottom right corner on your approval notice. If you dont see an attached I-94 to your I-797 approval notice, then you will have to leave the country before your current I-94 expires and re-enter by getting a visa stamped..
