Any number lesser than 800,000 is good for us.. doesnt mean all is well.. we have to continue in our efforts with IV and we could have a better breakthrough..
Anything less than 800,000 is good... even a few hundred thousand less :) There's still a lot of work and patience required but a good news is a good news nevertheless.

I just started this thread to learn how other members are considering option to transfer EB3 case to EB2.
- Please let us know,
- Is it worth trying?
- Is there any issue if you have tried? Success or failure.
- If you got success, let everyone know.
Thanks,
Samir.

I also met several American citizens who were passing by and were curious about the rally. Me and JazzbytheBay explained and they listened patiently. One hour later I saw them marching with us holding flowers that some of our volunteers were distributing to passer bys. One gentleman was a school teacher.
IV needs grassroot support from half a million people stuck in various stages of green card process. You can be from any country. We welcome and invite members from all countries and communities to join our efforts.
Additionally, one of our best friends can be American citizen who understand the issue from economic, personal and other perspectives. If they become part of our voice we will become more effective.
Each one of us has to become "IV brand ambassador" and present our issue in right perspective to counter so much misinformation floated by some vested interests. Yes, you can do it. We can facilitate.

The guy in black shirt/pant is he a IV member? Next to him is definitely an american Kid. If they indeed are american citizens that listened to our cause and joined the rally, hats off to them.

This is something that's doable without legislation. It would be done for employment based visas.
I've been reading the posts all day since yesterday. The most plausible "PERMANENT SOLUTION" has to be this. Please read the msg from IV
1. No change in July bulletin
2. No change in August bulletin
3. Well in that case it has to be this. It would be least controversial.
Please avoid all this sensationalism in your thread headers! You don't seem to know squat and are claiming something without any reference...the red dot/square seems appropriate...why I am replying to this!?

are sure it is 7 years? i thought .. it is 3 years.
I think its more than 3 since I got a notice about my 2003 state taxes in 2007 which they said they never received and I got stuck with a penalty ( although I was getting a refund ). I paid the penalty since it would have been too much of a hassle to go through 2003 records and then duelling it out with the IRS.

Thanks for your kind reply. Yes this income of 40K is after my employer deducts taxes via withholding everymonth from my salary.
I am confused because I read that you have to declare any foreign accounts held. In my case I dont have any NRI account, I transferred the money to my parents account in India.
I am not sure if I fall in the category where I have to declare all this. Thanks again for your help.

There is an official way to file a complaint against CBP individuals, see this link: https://help.cbp.gov/cgi-bin/customs.cfg/php/enduser/std_adp.php?p_faqid=1160&p_created=1257459854&p_sid=uJzYJiSj&p_accessibility=0&p_redirect=&p_srch=1&p_lva=&p_sp=cF9zcmNoPTEmcF9zb3J0X2J5PSZwX2dyaWRzb3J0PSZwX 3Jvd19jbnQ9MTQ3LDE0NyZwX3Byb2RzPSZwX2NhdHM9JnBfcHY 9JnBfY3Y9JnBfcGFnZT0xJnBfc2VhcmNoX3RleHQ9Y29tcGxha W50IGFnYWluc3QgQ0JQIG9mZmljZXI!&p_li=&p_topview=1 (https://help.cbp.gov/cgi-bin/customs.cfg/php/enduser/std_adp.php?p_faqid=1160&p_created=1257459854&p_sid=uJzYJiSj&p_accessibility=0&p_redirect=&p_srch=1&p_lva=&p_sp=cF9zcmNoPTEmcF9zb3J0X2J5PSZwX2dyaWRzb3J0PSZwX 3Jvd19jbnQ9MTQ3LDE0NyZwX3Byb2RzPSZwX2NhdHM9JnBfcHY 9JnBfY3Y9JnBfcGFnZT0xJnBfc2VhcmNoX3RleHQ9Y29tcGxha W50IGFnYWluc3QgQ0JQIG9mZmljZXI%21&p_li=&p_topview=1)
I request all affected to file the complaints here and request the revocation/reconsideration of their visas (especially if they have been subjected to deportation).
We should have this link in IV wiki.

if you are on EAD and they pay you...you will have to declare it on your taxes...so you will have to pay upwards of 33% tax on it...which is far far more than the 4% charge currently

Dude - think practically. If the billing rate that the company is going to get from the client is $70/hr and they keep only $5/hr then they have to give him $65/hr. If they have to keep him on the payroll, they will have to pay 7.45% in payroll tax, which is employer's portion of Social Security Tax and Medicare (reducing their rate from $70 to $65.1575). This means they will be making 15.75 cents/ hr (translates to $315 for a year assuming that you work for 2000 hrs - the remaining 80 hrs go in holidays - for which they may or may not pay). Even if they are outsourcing payroll, do you think that it will cost them less than $315 a year to pay him? even if it costs $0 - who would be willing to keep you on their payroll to make only $315 a year? Would you? and if you take unemployment insurance and liability insurance into account, the company would make a loss. If you owned a company would you follow this business model? If you are - you might as well just give your money for free to all your employees.
The only way you can get a company to keep $5/ hr and give you the rest is if you agree to a 1099 (and you cannot do that on a H1B - you need to use EAD for that). On a 1099 - there are other tax implications - now you have to pay both your share and the employer share of payroll tax (14.9%). And now since you are an independent consultant (which is what a 1099 is), you have to get your own Liability Insurance. To prevent people from suing you, you will need to form a LLC or some other type of corporation. You might want to get a good CPA to setup your company so that you can setup the right kind of company to benefit from the right tax deductions.
There is nothing wrong in making more money - just like you want more money, the corporations are out there to make money too. No one is in the business for charity. As long as the relationship between employee and employer is symbiotic, all is good. Once the equation changes, it is either time for the employee to say good bye to the employer or for the employer to off-load the employee from the corporate bus.
I have seen many posts in this forum complaining of "blood-sucking" employers and how they exploit employees. To me, that is the same as:
- programmer's guild complaining about us stealing their jobs or
- people losing their home and blaming the banks "for not disclosing terms"
- anyone who is blaming anyone else for their troubles
If you are being exploited, it is because you are willing to be exploited. Don't blame the employer. Blame yourself. If you don't want to pack your bags and go home when you lose a job and cannot get another one, don't blame the employer and tell others that they are "sucking your blood". Everyone is here to make money.
I understand what you meant..i forgot to mention in my post that if i expect the employer to keep 5/- only then i will take care of running payroll(means pay ADP to run payroll). I will pay employer to keep my h1b status.
I do understand there are expenses incurred on the employer side too.
Also i will work with the vendor on EAD but on W2. So no worries about liability insurance. But thanks for your informative post. I need strong information like you gave so that i dont take a wrong step..

Thanks to the existing rules, I have seen friends/ relatives either sacrifice filing for their AOS, or worse, try to get married in 15 days (or even worse, though I have rarely seen someone do this... get married after filing for AOS and spend years away from the spouse)!
I believe, Sen. Clinton was pushing for this during CIR, but the amendment was rejected.

SThe letter must indicate that job is permanent and full-time.
[/COLOR]
I've been thru many jobs here, and none of the offer letters mentioned that the job would be "permanent" (whatever that means). It's especially not possible to have that written on job offer letters for contract/project-based jobs. In any case, UDCIS does *not* require you to mention that on your EVL.

USCIS is already aware of this. They have been notified through AILA and our letters are also working. IV has also been pushing for more broader AC21 regulations for a few months now.
Our request from IV is to keep sending the letters. Please send letters in thousands - not like 50 to 60 letters.
Everyone must take initiative and push other members. It is a very importasnt campaign.
It is very much possible that a lot of you may be a victim of AC21 denials. It is your call.
Please take responsibility and everyone must come forward and bring others also into this campaign.
This is encouraging. chandu, I read somewhere (mostly on murhty) that CIS will be publishing new AC21 soon and it is expected to be more stricter. Is this just the speculation or any other indications are received?? any idea? I am afraid that what will happen to people who already have used AC21 by following what currently exists???????

this is mainly due to July VISA Bulletin fiasco and thousands were allowed to apply for their I-485, due to USCIS/DOL July 2007 VB.
one moe reason lots of Citizenship petitions were also filed in July 2007 to take advantage of old fees structure.
All countries of chargeability and employment categories were made current, since Dol was frustrated with USCIS's slow processing rate for I-485 and had Dol not made the VB current USCIS would have wasted few thousand VISA numbers as usual.
Silverlining is that we were all given freedom of using EAD and get new jobs or promotions using the AC-21 provisions...but the long term side effect is the slow moment we are seeing for the processing dates.
NSC is slow since lots of high tech H1-B employers are from CA and WA states and they applied truck load of I-485 versus the folks in Texas Service centre.
We are all hoping that once USCIS is out of this naturalization processing pressure before the elections, they would start processing the July-aug 2007 I-485 petitions.
