As you said I 485 filed + 180 days. So you are out of danger.
1. You can check if your I 140 was revoked using your LIN number for I 140 if you have one
2. To safely use AC21, find out your job title, job description and salary mentioned while filing your I 485
3. Your I 140 should be approved
4. then you can use AC21 with H1B transfer or with your EAD. I would advice to use AC21
5. your sponsoring H1B employer should mention the same job title and job duties as it is mentioned in EVL (employment letter) while filing your 485
6. If you have hired an attorney he would then send a AC21 letter(just a formal letter) with your new offer letter, with your 485 receipt number and 140 number (if you have).
That should take care about your AC21.

But the only thing is my lawyer did not file any job offer letter while appling for my I 485 as i did not had any as i did mentioned we had a disagreement and the employer is not willing to give me any letter.
but my current employer is a best person to work with and he is ready to help me at any extend he will not mind doing anything which will help me getting my green card.
Please advice if this could be an issue not having the employer letter while filling the I 485.

In response to my query to my attorney about the FP notices see her response below. And this is from an Attorney with 20+ years of immigration law experience. Anybody else in the same boat??:(

After nearly 22 years in this field, and thinking I had pretty much seen it all, this is a new one."

Yes there is an action item - Phone campaign to gain support for HR 5882, 5921 and 6039.
HR 5921 (removing country quota) more specifically will provide EB3-I more relief.
HR 5882 (recapture of unused visa's) will make ROW EB3 current and the additional visa's will rollover to EB3-I

For a moment, leave the IIT/merit/experience arguments aside...fact is US graduate schools get taxpayer funds...and one way or other students graduating in US get benefit from those taxes. Senators do not want their tax $$ investments to leave the country...that only is the reason they did something for US graduates in H1...this separate quota may or may not fly...as there is no direct benefit for US...stay on H1B and pay taxes good for usa :cool:

The application finally goes to the service center who has adjudiciated the 140, if one's 140 is LIN the AOS 485 will go finally to NSC, it will stay pending over there untill the visa bulletin becomes current for that Priority Date.

getting a seperate quota for Masters from US has some teeth. The Congress passed a legislation for additional 20K visas for people with US masters. To match things up with the EB visas, there is need for additional numbers. We can thus argue for an there needs to be additional numbers for EB masters quota.
I think this might resonate with the congress. Unless everyone is just waiting for something big.

Just curious, why would any one file again just because they did not get the receipt for the first one (unless there is a legitimate concern like no Fedex/currier tracking for the first one , change of conditions like have second/better LC etc)?
What guarantees the second one will be accepted ? Just improving the odds ? Then, why stop at filing two applications ??

Its a good thing, hope this will lessen the abuse of the visas by these Indian companies. As I mentioned in another thread, I have seen that H1 and L1s who come from India dont get a very good salary. Not good.

The United States today indicated that it was willing to consider setting up of a joint technical working group to address the issues coming in the way of finalising a totalisation agreement with India.
New Delhi, on its part, has made it clear that it is not agreeable to the US stance of linking the requirement for a social security net as a precursor to finalising the agreement. India also made clear that it was adopting a calibrated approach to further opening up of the retail and financial services sector.
Indians working in the US have to mandatorily contribute to social security benefits but are unable to repatriate the same when they leave the US, in the absence of a totalisation agreement between the two countries.
The issue was discussed at a meeting of US Under Secretary for International Trade Franklin Lavin and Commerce Secretary G K Pillai in the capital. Commerce ministry officials said the Indian side pointed out that New Delhi had signed totalisation agreements with countries like Belgium and France, which had not set any pre-conditions.
�It was pointed out that India, which is a developing country, effectively gives a grant of $500 million to the US in the absence of a totalisation agreement. The US has indicated that it will soon have a video conferencing on the matter with senior Indian officials,� an official said.
In response to the US demand for further opening up of the financial services sector, the commerce ministry pointed out that India was adopting a calibrated approach on the matter.
�It was pointed out that the Reserve Bank of India has finalised a road map for the gradual opening up of the sector by 2008,� an official said, adding that New Delhi raised the issue of absence of a level-playing field for financial institutions in the US.
�A foreign bank wanting to open more branches in India only needs to obtain the permission of the Reserve bank of India. However, an Indian bank wanting to open up branches in the US has to go through the American federal system and then a state regulatory system,� an official said.
Banks like State Bank of India and ICICI have long pending applications for opening more branches in the US.
India also raised the issue of extending protection to its traditional knowledge under the patent regime in the US.

This suggests that a country with heavy family based demand, but light employment based demand, could use more than 7% of the EB or FB quota as long as they remained under 25,620 overall. This is wrong. The 7% limit applies independently to FB and EB. A country could have no demand in one area, and enormous demand in the other and the side with the excessive demand would still be limited to 7% of that quota - not 7% of the combined quota.
Also, I think that their estimates for China and India EB2 are too pessimistic.

The question I was asked by the Congressional staff repeatedly was - 'If so many thousands are impacted, why are we seeing just 4-5 coming to DC asking for help? Why aren't we hearing about from our constituents? Why is it always 'the outsiders' approaching us? Why aren't they visiting us? Why aren't they writing letters to us?'. So many questions with no answers!

-USCIS controls our economic freedom, movement, where we work and reside, and if we "rock the boat" our file might be "deep-sixed" and we would have no recourse. Who knows, a petty officer could browse a news group, read this and sick Home land security goons me. I would never know why. We don't all have the resources to hire powerful lawyers and fight for a couple years. Did they take 120 days to renew my EAD because I visited my congressional representative's staff? Maybe.
-"Transparent" and "accountable" are words not often used to describe USCIS and her parent Homeland Security. But they do have complete authority over our lives. Kafka could write a book! (Oh, he did.)
-Many Americans are now afraid to join political protests for fear of being arrested and hence losing their job, etc. Why should immigrants be more politically active than Americans? They are publicly targeted by politicians as causing all the problems in the land (Tancredo for example) with out any serious rebuke. In my country Tancredo saying things he's said would have been considered a hate crime.
-There are many Americans (even level headed ones) that do not believe that immigrants have any right to push for change in US policy. Regardless of whether it is change for the better, and there is no other constituency to demand improvements. The argument goes that regardless of the request, if you don't like it you should go home. (Of course the answer is to flip it and say: should Americans be treated poorly when living in my country? Sheepish looks ensue...)
-Depending upon your level of risk aversion, it is often rational for the immigrant (who's stay is tenuous) to stay home and be "good" which means pliant.
In summary, the US scares the freak'n crap out of a lot of people. And so they "behave" as best they can. This should not be a revelation to the staffers.
I don't agree that we should be pliant. We should be in their face because they deserve it.
As for me, I've come to the point that I think being kicked out of the US would be like getting fired from a crappy job I didn't have the guts to quit. :D

I am glad to see the light at the end of the tunnel. I saw a welcome e-mail from USCIS today in the morning. Took 6 years to get the GC with a total stay of 10 years.

F1 is not an option. To get an F-1 you have to prove intent to move back once your education is over. Being married to a permanent resident its almost impossible to prove that. This is a very tough situation. H-1 and L-1 are options but that depends on her educational background and line of work. One thing i would recommend if you plan to continue your stay in US is apply for her visitor visa before your marriage if you have enough time before your wedding. Atleast she can come visit you if she gets a multiple entry visa. Once you are married you can kiss good bye to the visitor visa option too.
It is not advisable to lie in your application about the wedding. If they find you of comitting fraud they can give you a 3 to 10 year ban from entering united states depending on the seriousness of the fraud.
