Sunny and Rolling came out as selfish to the majority of the members because they just focused on their issues first and identified some of the root causes for their long wait.
I think we should all atleast encourage them in their pursuit for justice. We have nothing to lose. When a specific group works on an issue which is affecting them most they would do the best to get that fixed.
This would motivate other smaller groups with other issues to take up theirs seperately. The more this happens the more heat it will generate on these 3 agencies DOL, USCIS and DOS.
Then we as a bigger organization can work much faster on getting the bigger issues resolved which in turn will fix lots of these smaller things in the system.
These kind of initatives are a win win for everybody. Every small step would help us go move towards our goal instead of trying to take one gaint step and getting bogged down.
PS: Waiting for miracles is onething for people who trust in God
But acting on ones own issue can get them closer to that miracle

Hi I am not exactly in similar situation but still relevant in the context. I have labor and I-140 cleared but my wife is working in India and she may not be able to come back in order to file I-485 within a month or two. If I file I-485 for myself can I file for her later? What will be the consequences and what are the timelines? I have a valid H1 Extension till May 2010. Can she still get this extension stamped and return on H4 visa?

Got CPO email around 10.45 am today for both me and my wife. Big thanks to IV. Big thanks to Pappu, Jay, Aman, Anu ad all my wonderful IV friends. I will also continue supporting Iv and activities time to time.
Congratulations, Chandu! You've been very helpful on these forums, especially when it came to those goddamned wrongful 485 denials. So I'd like to thank you, and wish you the best for the future.

For the benefit of all. There is another way to know receipt number and it is valid only if you have given your own personal checks to USCIS. When the check is cleared from the bank, they make image of check available on their on line banking web site. The image shows front of the check; page down here and see the back side of the check. You will find all your receipt numbers on the back side.
I found out all my receipt numbers even before my attorney knew about it.

It is not popular to say so but I have this doubt too.
Currently at least there is no requirement to notify and you only need to prove you still have a similar job OFFER (not necessarily working) if and when there is an RFE.
Only good thing happened to us in last decade, as far as I can remember, is AC21 and concurrent filing.
All these immigration laws are designed to keep us indebted/bonded to the employer. They might see this as a liberating provision and try to chain us back. This may or may not happen, but just my paranoid reaction,.
Hope AC21 don't go away like labor substitution has. :(
That is naive... AC21 is not an administrative decision of USCIS... It is a law... AC21 = American Competitiveness in the 21st Century act!! It was passed by congress and the only body that can revoke it is congress.
USCIS cannot revoke AC21.. only congress can. Please dont be paranoid. The most USCIS can do is refuse to change their current stance on same/similar job.
Gurus, correct me if I am wrong.

I pity Gonzales now, may be Chertoff called him up and said why on the earth is he responding to flower campaign? Or may be Walter Reed Soldiers refused to accept mourning flowers. LOL....
I smell something fishy... is it just me???
If that is a case then maybe Chertoff needs some flowers

We all know that IV is not Indian. More Indian!=All Indian. Lets not worry about it and most importantly I request IV members from all countries to ignore it as a reporter mistake as they script stories in their fashion to elicit more coverage. It is almost impossible to edit the story that has been distributed by Reuters/AP. Once its gone, its out of their hands.

I have direct responses from Murthy and Rajiv Khanna now . Plus 2 other american lawyers I know. The answers have variations. I'm going to do my own research and would encourage others to do the same before coming to a conclusion on this.
If you have asked this question to your own lawyers about multiple I485 filing, please post them here.
Members can then look at all the information and make their own decisions.
I work for MSFT - I am a dependent on my husband's process (he works for another company), and I also have my own process filed, where he is my dependent.
When I asked if we could have 2 processes, the lawyer answered:
"There is no problem with you pursuing I-485 applications through the two companies since you and you husband have reverse roles in each process as principal beneficiary and dependent".
Hope this helps other people on the same situation.

Thanks, updated the number of Robert Scott to (202) 225-8351
I spoke all the the reps that someone posted not on this list.
To add to the list of sponsors/co-sponsors, Congress Debbie Schultz is a co-sponsor for the bill (so don't call asking for support, but you can call to appreciate their efforts).
I think it would be better to keep it brief. They don't have time, and we can't spend lot of time, or else we won't be able to call all of them. It took me 30 minutes to call all of them.
I read somewhere that Steve King is not supportive, infact he's opposed to this bill. So it would be wise not to call his office. I don't he'll change his stance 'coz he's part of numbersusa/other nut cases.
Also note the phone number of Robert Scott is wrong, it shows the phone number of Adam Schiff. I realized only after I called twice. but luckily I realised before I could go through the whole talking points.
Pls everyone call before its too late. we need to get this passed as this is our only hope. PLS CALLLLLLL!!!

Look at this looser.. Don't have a job and typing such a long long prose stories get over his career failures and projecting his impotency as some elses fault... This bloody racist is out of job because of his such a rude behavior... But we have a job... so it is waste of our time talk to this bloody...
Hey fool Hunter.... you are a bloody illegal in this country get out of here if you dont know history ask your grand father. First do some thing about your illegal status and then talk about India. You are cultured less brut, I repeat cultured less brut. Its damn real that your youngsters are doing only three things drinking, sex, crime...
Thank you for admitting most of what I stated here true. Actually all of what I stated here as skills are based on my experience in IT management over the last decade. If you suddenly found my post to be stereo typing, you were blind to the stereotypes propagated in this forum for a long time.
You are wrong here. Do you know that companies like TCS/INFY/Wipro offer blended rates in the range of $20+/hr for keeping over 70% of staff offshore? Client directly benefits here. I have seen hypocritical companies that took tax benefits from local governments like cities and counties (which came at the expense of property taxes paid by residents of those localities) for job creation and then turned around and outsourced the very same jobs that they were supposed to create to TCS/Wipro/INFY etc., often dismissing the existing contractor pool/employees which involved people of all nationalities including H1-b workers like TN Man who couldnt compete with the $30+ rates for the on-shore workers even if something was available from these vendors. Now to dump people at $30/hr rate, even though talent is locally available - like "TN Man", these vendors will abuse H1 and L1 by securing as many of these visas as they can( which were intended to bring the best and the brightest for american companies), causing Bill Gates to advocate for unlimited H1-bs when in reality, what he needs is a few thousand H1-bs which should be available in normal circumstances, had these companies not been poaching those visas.
So these offshore companies circumvented the prevailing wages through an industrial practice that should be considered dumping, where they dumped green-horns for the greedy clients, because the green-horns dont have to go through any interviews in exchange of the very low rates. In this case, the people dismissed from the company/contractors were a lot more skilled, yet managers like me would be forced to start from scratch with the new pool, often resulting in delays for strategic initiatives at these companies, but the bean counters at the top never care, since their horizon is the next quarterly earning release, not what the company would do 2 years down the line (and some of these companies are the culprits behind financial crisis today with their very myopic thinking, just a sample was illustrated above)
The only jobs that were created in those localities due to such corporations in exchange for tax credits often were Indian Grocery shops opening in that locality to cater to those folks from offshore vendors. :D BTW, I don't have anything against them, I like Indian food.
I have worked with companies where I managed a 50+ member team to execute a project which at another company employing local workforce may have been done with a 12-15 person team (I have managed it both ways and hence I know that as a fact). Now the company employing the 50+ member team will often massage the numbers to show that they saved $x differential per person* 50 for the bean counters and would have secured bonuses for the higher ups because of those paper savings.
Now I think as a result of people like me interacting with US law-makers, they are getting the true picture of the abuse going on with the current processes. I understand many of you here are concerned about your own career and eventually settling in US, but once you become a permanent resident or US Citizen, you are going to face the same realities. I have seen Indian-americans who went through the GC/Citizenship process becoming some of the the fiercest critics of the current system, because (like "TN Man"), their livelihoods also are threatened by the current process. They suddenly understand that it has nothing to do with the so-called "skill" or "talent" shortage, it has everything to do with what your hourly billing rate is.

Bush deems guest workers key for economy
By Joseph Curl and Stephen Dinan
The Washington Times, February 1, 2006
http://www.washtimes.com/national/20060201-120444-3544r.htm
President Bush last night called for 'stronger immigration enforcement and border protection' even as he told Congress to move forward with his plan to create a guest-worker program to fill jobs that no Americans want.
He also seemed to challenge those in his party who oppose a guest-worker program, saying the nation needs immigrants.
'We hear claims that immigrants are somehow bad for the economy -- even though this economy could not function without them,' Mr. Bush said in his State of the Union address.
The only way to keep the United States competitive is to create an immigration system that 'upholds our laws, reflects our values and serves the interests of our economy,' he said.
'Our nation needs orderly and secure borders. To meet this goal, we must have stronger immigration enforcement and border protection,' Mr. Bush said. 'And we must have a rational, humane guest-worker program that rejects amnesty, allows temporary jobs for people who seek them legally and reduces smuggling and crime at the border.'
The president pushed for his guest-worker plan in his past two State of the Union addresses as a way to help employers, but this year his focus on border security and immigration enforcement was much clearer.
'There has been continual movement on his part because he recognizes the Congress and the American people aren't with him, and we're going to fight him,' said Rep. Tom Tancredo, Colorado Republican.
He and other Republicans took issue with Mr. Bush for not differentiating between legal immigrants and illegal aliens when he said the economy could not work without immigrants.
Rep. Lamar Smith, Texas Republican, said U.S. workers would be hurt by a guest-worker program.
'Studies show that competition from cheap foreign labor depresses wages and takes jobs away from American citizens and legal immigrants alike,' Mr. Smith said.
He also said Mr. Bush's plan is unenforceable, because those here illegally cannot be expected to return to their home countries voluntarily.
In the official Democratic response to the State of the Union, Virginia Gov. Timothy M. Kaine said Mr. Bush does not have a rational immigration policy and that the result is a 'confusing patchwork' for states and localities to handle.
He shied away from a specific call for a path to citizenship for illegal aliens, even though most party leaders in Washington have endorsed that.
'We should welcome those who seek to lawfully join and contribute to our American family,' Mr. Kaine said. 'At the same time, we must ensure that our homeland-defense efforts begin with consistent federal action to protect our borders.'
In the Spanish-language Democratic response, Los Angeles Mayor Antonio Villaraigosa specifically called for 'comprehensive immigration reform' and for giving 'hardworking people who play by the rules a greater opportunity to realize the American dream.'
Sen. John Cornyn, Texas Republican, said Mr. Bush was right to call for action on the border and for his guest-worker plan.
'The bill I've introduced strengthens our border enforcement and comprehensively reforms our immigration system,' Mr. Cornyn said. 'We need both stronger enforcement and reasonable reform of our immigration laws.'

I am sure you will get it. Response to a SR takes about 10-15 days. I opened my second SR on Aug 30th and got the response today. I was approved on Sep 7th.
Things i did from Aug 1st:-
Congresswoman (Zoe Lofgren): Her office helped me getting the PD correct in the USCIS system. When i made requested Zoe's office to enquire about my case they told me that PD is Feb 2007 instead of Feb 2006. I gave them my I140 and her office contacted NSC and NSC corrected the PD.
Ombudsman: Sent Email on Aug 10th and got a reply on Aug 11th that they will enquire with USCIS. Got a call from USCIS that my case is in transit.
AP approved on 08/26 and Soft LUD's on 08/27 and 09/02.
Attorney made a enquiry on August 25th about I485 with USCIS and was told to waiti 30 days.
Sep 7th: I485 approved.
Check to make sure your category and PD are correct in the USCIS system. Just to make sure.

Kaiser started this new rule to not hire folks on EADs as of last week.
I thought, this may be the work of various vendors who fear of losing lot of their employees jumping to the Client as Full time employees. Dont know actual reason yet.

I'd be surprised if Arnie is anti-immigration considering he is an immigrant himself.
I am not sure about his public position about legal immigration but I think he made it difficult for immigrants (Legal and Illegal) to get driving permits in CA.

I'm at a total loss here. My dates became current in June and I was ready with all the paperwork - even filled all the forms myself. Company and their attorneys took their own time and sent the application out only today for Monday delivery... I kept on reminding them what USCIS did to EB-3 other workers.. but all for nothing....... they can just say 'oops sorry' and out lives are screwed!!!
