I am trying to find out more about the priority date porting - any pointers to details on how/when it is allowed? From various threads it appears that some of these are successful, but in other cases, some attorneys may not even pursue PD porting.
If the I-140 is approved with the previous employer (for over 2 years) but I-485 has not been filed, does PD porting require that the new GC application have exactly the same job profile as the one for which the original Labor was filed and I-140 approved?

I wanted to get an idea how many EB2 guys would be willing to visit DC to meet lawmakers to help out our EB3 brothers. Unquestionably all EB3 should be willing to visit. This is the chance to show that IV is indeed one.

You are absolutely right abt the excerpt.
You need to send the EAD according to where you live (with pending 485 and Q16 answered with C9)

I am not saying we shud do anything forcefully. I am saying, that if we have to show IV's face as being multicultural and since we Have members from all over the world sharing ideas on here anyways, might as well show the media that aspect.
In my opinion, if general public/law makers see faces from all over the world complaining about the GC system, it would have more impact.

This is just a humour but has a meaning underneath if you try to understand. I am comparing USCIS to a product selling company. If USCIS was a TV selling company what would happen to the customers the way it acts ?
You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
The credit card will be charged once, may be charged twice or a valid CC may get rejected.
Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company
There would be an online survey after you buy it which would never get submitted 99% of the times.
In case it did get submitted, somebody will read one out of 10,000.
After reading it he will throw it in the trash can.

I look for a help in terms of clarification for birth cert,,
1. Born in 70 but my birth was registered in 2005 when I wanted a birth certificate, BC issued in aug 2005 and says registered in 2005. Is it ok I use them or I need an affidavit also from my parents?
2. There is one letter written wrongly in my name.. can i send or get a new one??
I would greatly appreciate your advise on this

1st question). As per immigration rules,if ur birth is registered on or after 1year of ur birth till date,u got to submit two additional sworn affidavits along with the birth certificate as proof.
So in ur case since ur birth was registered in 2005 and got a new birth certificate in 2005 u need to submit the following :
Birth certificate(which u have now with u..issued in august 2005)

Two sworn affidavits from any two blood relatives(mom,dad,siblings,aunt,uncle) older and get notarised
by any attorney/magitrate.The following is the format.

AFFIDAVIT REGARDING BIRTH
I __________________ (name) being the _________________ (relationship father, mother, sister, brother, aunt, uncle), to ______________ (FN name), reside at ___________________ (address, including country), do hereby solemnly affirm and state on oath as follows:

Can you let us know know why you cudn't get it corrected at the CBP? Its clearly a mistake by the POE officer. Try other CBPs till you succeed. thats the best option you have. I've done it myself. First time, when I called them to get an appointment they said it can't be done. I called them again and got an appointment without any problem (obviously it was somebody else who attended the phone). Went in person and explained it clearly and the officer accepted the mistake and apologized on behalf of the POE Officer. He gave me a new I-94 and struck out the new number and wrote the old I94# on it. He also updated it in the system.
So, please give it a try before trying out other options. HTH!

My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?

You have already violated your F1 status. You can not have a company apply for PERM & i140 while on F1 status, period. All that stuff of "it�s for a future position" or "you did not authorize the company to apply for I 140" is B.S. The only thing that matters is that F1 is not a dual intent visa, and initiating a immigrant process in your name (yes the PERM and I140 applications have your name on it meaning you authorized it) means you violated F1 status. You need to consult an attorney before you file for H1.
Your answer is incorrect as far as I know. Please do a little research before giving such answers.

Without any changes to the current system, How many of us will be in a similar position in 3 yrs time?
I am only asking this question since we all know how many of us are in the queue with PDs in 2001-2004 range. If 2800 per country EB category get out of this queue then, absent relief, this could easily be us in 3 yrs.

My 485, EAD and AP application received in NSC on AUG 2nd. My personal checks are not redeemed yet. I haven't received receipt numbers or EAD or FP.
But the USCIS receipting times states NSC is processing receipt notice for AUG 8th.
I don't know what's going on....
Do they transfer my case to TSC??? Because I am living in TX???
My employer office is in Illinois and my lawyer office is in Michigan.

I am in eb3 with priority date jan/2007 and working with EAD and 485 pending.
my sponsered employer willing to promote me with my position and i was having thought of filing a new case in eb2 and port my eb3 priority date. my company has different sister company working in different areas, can I file my eb2 application from other sister company not from the company where my eb3 is filed?
Also I have 3 years degree and 1 year pgdca plus 10 plus years of experience. I wanted to know if you know anybody who filed eb2 with 3 years degree and 1 year pgdca? according to my research i may have trouble at 140 stage?
if my eb2 gets denied, what happens to my eb3 case?
Please advice.

It is good idea. I discussed this my lawyer and according to him, nowadays USCIS is very strict about it and trying to match the requirements of EB2 against the candidate's credentials. If it perfectly matches only they will approve. It will be an option for those guys with EB3 with PD past 2005 and with enough EB2 credentials, primarily a masters degree and if it from US, then great.
Please do not go into this option just by stating that I have 100 years experience with such and such company. I will say, if your are a masters degree holder (from US the best) and is employed with a major employer for more than 3-5 years, then only attempt this. Do not try it if you are employed with some Desi company. This is harm both the candidate and the employer.
