3 options
1) file H1 on Apr 1st and if H4 is not approved by then withdraw pending H4
2) file H1 on Apr 1st before the current H4 expires and hope that H4 is approved before H1. H1 should be approved after H4 to have the H1 status. If H4 is approved later, H1 status will be lost
3) Request PP of extension and 99.9% of time 539 is approved along with 129.
I will add more info as I find.

Does any one know how mant days it takes to get denail notive .I-140 denied on April 22 and says notice mailed but didnt recieve yet .Both emploter and attorney havent recieved any thing yet .Is this Normal ?
Talash, this is not normal. Your notice could have been lost in the mail. Ask your attorney to contact USCIS and explain. Also employers can request a courtesy copy. So also ask your employer to request one. USCIS will not entertain any request from you, since I140 is a employer filed petition.

Well H1B can bring their spouse using H4 .. so I guess GC holder can not bring their spouse .. I guess this is a hole in the system.
H1-H1 couple can support status of each other (H1-H4 or H4-H1)
H1-F1 couple can support each other (H1-H4 or F1-F2)
But
GC guy can't support status if H1 spouse lost job and became out of status
GC guy can't support status if F1 spouse becames out of status
GC guy can't bring spouse from home country
UNLESS SPOUSE/Kids goes through complete F2A visa process (several years)
It can make life of GC spouse miserable (of course GC guy also). Imagine GC-H1 marriage, H1 out of status after loss of job. After loss of status, H1 spouse has to return, but GC spouse will try to remain in USA for own status and in hope to bring spouse back after getting citizenship.

Hi,
I self e-filed my EAD application and the Receipt date is 6/7/10. They called for Biometrics which is done.
I got an email saying that they have sent a RFE. Waited for 10 days, still no signs of RFE. When I called USCIS, they asked me to wait for 15 days. When I called after 15 days, they created a Service Request to re-mail the RFE. Now they say, I have to wait for 45 days. When I asked them if they will extend my deadline to reply to the RFE, she said she doesn't know.
Has anyone been in this situation ?
What kind of RFE will they send for an EAD extension.
I sent my 485 receipt and a copy of my EAD when I e-filed.
How many days do they usually give to respond to the RFE ?
Any feedback is appreciated.

Update:
The Doctor admitted his mistake.
He completely forgot to mark the TB test earlier.
He was ready to back date to avoid more inconveniance to me.
But I told him to be sincere in all aspects.
I basically forced him to give my wife a TB test again and also the x-ray.
Now the plan is to submit all this information with a nice letter which states that the doctor had forgotten things last time etc etc.
Hopefully they will mark the case as - resume processing.
I also had some issues with my medical exam. Lesson learned is to have civil surgeon verify and double verify
the information entered in the exam.

My sympathies with your situation. If u can't go to India can't u use a service like mymaninindia.com to get you marriage certificate?
Also the best person to consult would be your lawyer as to whether u might get an extension to file your reply.

Based on Assement in this article, it almost seems that the chances of STRIVE are dead even before it goes to House Immigration Commettee. I am not trying to be negative or something but the article has such a tone. I can understand that Pelosi did not schedule any timing but what concerns me most is the fact that
"California Democrat Zoe Lofgren, who chairs the Judiciary Subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law, will hold hearings before marking up any bill"
Now we all know how one sided these hearings are and how long they take. In nutshell these hearings give chance to any tom, dick and harry to express his opinion and create melodrama. We already worry about melodrama of people such as Sen Sessions in the Senate. Add this drama, and it can easily eat the short window we have to get the relief. I really hope I am wrong here but I have a bad feeling about this :(:mad:
