I am in serious trouble, please read and comment if you can help.
- Spouse (Primary) and I filed I 485 in June 2007. (PD March 2004)
- Spouse Application is approved in July 2008
- Spouse changes employers after approval
- In October 08 we write to the law firm that initially filed the I 485 to withdraw their representation.
- In Nov 08 the Law firm incorrectly writes to USCIS to with draw the I 485 application.
- In March 08 I get an email from USCIS stating my application is withdrawn.
I obtained the notice of withdrawal and the notice says
'As a result of your request, your application is considered withdrawn, and it will recieve no further consideration by USCIS. There is no appeal to this decision.'
Neither I nor my wife have authorized the attorney to withdraw the application, we only wanted them to withdraw their representation (I have the letter we wrote to them and it clearly states it.)
what can we do.
Is it possible to reinstate our case?
Can we refile my AOS again, even thought the primary applicants green card is approved more than 6 months ago?

As IV grows maybe this is a help IV can extend to all its donor members and help them if they get in such extreme distress situations. This is one of the ideas we are thinking for our members in the donor group.

Well USCIS withdrew the Q&A they posted on their website for revision.
I hope they don't plan to screw the remaining name-check sufferers again.
They have been approving some of them in the past few days (and neither according to PD or RD, basically no FIFO, just based on officers whims)

Things like legislative changes take time. We may think that the debate on illegal immigration has nothing to do with our issues but the corrupt Senators will always try to sneak in some reform related to illegal immigrants into our bills in exchange for their votes, ultimately derailing the entire bill.
We sincerely need to work with the law makers--the guys in the immigation committees, in particular. Please, desist using 'corrupt' senators. Debates in democracy are always healthy. We must emphasise our points, gather support from aila our employers and beneficiaries and respect a system.

Folks,
Just now i called up USCIS (1-800-375-5283 Option 1,2,2,6,2,2,1) since my App was mailed more than 4 weeks.
The lady who picked up was nice enough to explain me the revised ETA for receipting from 4 weeks to 60 Calendar days. She also said that they generally receipts in 2 weeks (not even 4 weeks) but because of this rush that ETA is set to 60 days. She appreciated all of our anxiety and re-assured me that i dont have to call after 60 days because the receipt will be definitely with me ( if everything is filed correctly as per rules )
One thing i found funny - she explained me that this Rush is just for avoiding the 'Fee Increase' - She has no idea about the Retrogression and stuffs like that :)

so you don't see a difference in how a private organization and a non-profit organization operates. Well here are some:
1. In your office, you are actually working for your boss and you are getting paid to do what they want you to do. I don't remember getting any pay check from IV. In fact, I have written several checks to IV. This doesn't mean I can post whatever I want but as long as I am following IV guidelines, I shouldn't get harassed by folks like you who think that their post is the only important post.
2. If you don't do what you are told at work, they'll fire your a&& and you wouldn’t know how to pay your bills next month. That's why the CEO or your boss don't have to send you a one liner before they take any decision.
As far as I know, IV is just a group of people coming together to address a problem which is shared by all members. I know that some people have worked harder than others and some people have contributed more than others but everyone has contributed one way or the other. So for you to come out and say that you are the only one doing all the work and others are just doing nothing and some how you are the CEO of this organization is just beyond my imagination. May be it's time you wake up and smell the coffee.

Now that you have green cards, you may have considered/thought about reentry permits.
Can you get multiple reentry permits i.e one 2 permit followed by a second 1 or 2 year permit?

Don't worry. Most likely, it is USCIS error. Check why after 140 approval, they sent to DOS while you are in Adjust of Status? May be USCIS entered wrong in system and creating issue.
I would take INFOPASS and contact local Congressman.

The bill goes no where after the hearings unless there are enough co-sponsors and CHC members are ok with the bills. Then the house speaker will decide to let the bills be debated and voted on the house floor. If it goes through House then Senate will vote on it and then the Prez signs it off.
So the most important thing is to participate in the phone campaign esp the one targeting CHC members.
I think bottom line is MAKE CALL ASAP . MORE YOU CALL MORE CHANCES WE HAVE..

Because you are a man and you are from Mars. Men are that way .. they always live in future and somehow completely forget that its the present that they need to live fully and enjoy to the maximum extent. Women live more in present and that's why you will see very few of them stressing themselves out on these forums.
My wife always reminds me this. According to her, its ok to read forums and keep yourself updates with what's going on ... but don't get to much into it, otherwise you will loose your peace of mind.
So I have found my own way ... I am completely into these forums and no matter how hard I try I can not escape from it (you remember.. I am from Mars ... worrying about future is my nature ... so after I get my GC, I will find next topic to worry about ... may it will be abut the US economy or may be how my son's future shapes up), but at the same time I try to convert my frustration to a positive energy by thinking new ways to solve the problem, and contributing them to various forums at IV.
I think you have reached to a state, where you feel disturbed. I would recommend that contribute to IV in a positive manner .... it may be ideas, money, support, organizational work or any other thing. I think this is the only way you can recover from this GC Depression.
Now wait, women dont worry about future?. Good to know there is something they dont worry about

Dont ask me when you get an RFE for your skin test. I believe I read it on these forums that a couple of people were specifically asked about their skin test.
Even the doctors are supposed to give you a skin test and then the x-ray. If you have taken a skin test before, I think you can just take the x-ray now.

Most people from India will have PPD test positive as they have received BCG vaccine in childhood. PPD test in not mandatory. Negative chest xray is sufficient to prove that you are free from active TB (you may still have dormant infection but that doesn't matter at this point of time). Plus USCIS/CDC had published a guideline for civil surgeons instructing how to perform the Medical exam for immigration purposes and it clearly says that applicant can choose not to have PPD test and negative cxr will be sufficient.

Discover does not issue a credit card if you are not a PR or citizen..even though you have good credit history..

I understand...those that are calling USCIS have no other way of finding out if their receipts were issued, their Lawyer / EMployers may not even let them know...
So they call to see if USCIS may be able to lookup their case by Last name or something......
