I agree with Bob here, as I've shot with both Nikon D1's and F5's from back in the day, to the latest stuff. I've done the same with Canon through the 90's and the current crop.
I feel like Canon has the upper hand on Nikon currently in both bodies and lenses.
Bob did label his opinion, most likely without thinking about it -- with the IMHO, to avoid attacks as such. Everyone is entitled to their opinions and none of us can 100% say that Canon lenses are better than Nikons.. No one here does bench tests, price comparisions, etc.. It's just field use and preference that determines this.

Back to the topic at hand.. I think the Nikon is probably her best bet because of the build quality and apparently the kit lens is pretty damn good. You can pick up the D70 w/o the kit lens for $999 MSRP, which is only $100 over MSRP the 300D. So maybe the first question is, decide if either kit lens is fine for you. Then determine the build quality, and lastly determine which lens system you might want to grow into.
I don't think you can make a bad decision either brand you go with. We can all be happy with that. Competition is good.

They will reject your application without medical exam. Before USCIS officers had instruction to favor RFE, meaning denying as last resort. Now they are instructed to deny any incomplete application and accept only if everything is OK.
Get the list of the doctors from USCIS web site and find one, drive/fly to them.
More likely you are not a from large city if the doctor is problem. In LA there are hundreds and I had an appointment the very next day.
This is so serious. I'm mentally going down the list over the things I sent with my application. :(

In Minnesota, the driver license is usually valid for 4 years. But for non-citizens (and GC holders) they print a red colored status check date. And the validity of the license is then until the validity of the visa. In most cases for those under retrogression it would be anual renewals of the driver permit and the validity date coinciding with the EAD validity.

I am a typical EB worker and have all the insecurities of a person working on EAD/H1 in a distant land. Though gainfully employed seeing job losses all around makes me anxious. There is no back up if i lose my job as being on EAD/H1 does not give me any unemployment benefit, no breathing period though i have dutifully paid SS taxes without a break for last several years. With stock market tanking i dread seeing my 401K statement. Selling my House to move somewhere else might be very difficult, if not impossible.
Any setback on GC would hit me both financially ( money to spend on MTR, pay pricey lawyers , look for not so cheap health insurance, and biggest of all - loose the steady pay check )
as well as mentally ( to look for a new job, worry about same/similar classification, move to new place, unable to service my mortgage , put up with not so pleasant working conditions etc ).
I am away from friends and family so no psychological support as well when needed.

call ur airport, I remember a friend got his I94 extended based on new I797 at the airport.
BTW- if u have an approved I797 and an expired I94, u are not out of status....when u travel next time out of country...keep current docs with u and when u reenter...the POE officer will give u i94 based on ur latest I797..

That's because my current 797 was valid till Jun 2007 and he said he can only stamp the date that is on the current 797. I guess it depends on the POE officer and in my case its unfortunate that it got messed up. Someone in the forum mentioned that he got it for 3 years. I think its very very YMMV :confused:

This is correct.......once the employer revokes H1B, that is a red flag for the immigration officer. Officer may or may not ask for evidence. Be prepared to show a same or similar job offer.

I received RFE on my 140 on nov 15th. I came to know about this when i checked the status online. It says on Nov 15th we mailed you a notice requesting further evidence . I-140 Receipt date is dec 11 2006. I do not yet know what the RFE is about. How many days does it take for the RFE to arrive normally ??

Though this can be the case but this is relief to those who have been stuck in NC for years ,so in that retrospect six months is far far better . I think many people can see the things to their interpretation , my take is that you never get everything right on the first time, u revisit and make changes and correct special situations that were not taken care of intially. It is a start atleast now we dont have poeple who are waiting in NC for years and asking about WOM.

I am giving USCIS a fair chance by using words "Doubt" and I have tried to research the subject but am not getting much authentic articles on net for the same. If somebody (Authentic article/lawyer/Sr. IV member) is saying that "Yes 6 months is from 485 receipt date".. Then I am fine otherwise it will be a missed oppertunity as we had a chance to have more clarified text from USCIS while it was writing a new memo w.r.t that law suite.

You can file as many I-140's in any category (EB2/EB3/NIW) as long as you have a certified labor for a bona fide position with a matching education and company has ability to pay for those positions. These I-140's can come from one company or different ones it doesn't matter.
In your current situation:
1. Don't even think about doing anything with pending I-140 and AOS. There is a definite delay in I-140 approvals at both NSC/TSC so waiting is the best thing to do. As long as your qualification matches the LC description you will get your I-140 approved. If your I-140 is pending 30 days past the processing time and you haven't received an RFE, it might have been stuck in security check. Your lawyer needs to open a service request to find out what is going on.
2. For the labor that is expiring in Jan, go ahead and file an I-140 petition right now, there is nothing to worry about two I-140. If nothing else this petition can be used for 3 year H1B extension in case the first one gets stuck.
3. The second I-140 that you are filing can't be used for your pending AOS if your priority date is not current. Check the Pearson Interfiling memo ( from link below). If your priority dates are current and will remain current (EB2 ROW) file for an new AOS application when your second I-140 gets approved. If by this time your first I-140 is approved you can simply toss the second I-140 in the office shredder.

Guysssssss N Gals , I got it (I-485 approval) 10 minutes ago!!!!!!!!!!! NO RFE. Recent Luds were on I-140 / I-129 / I-131 ( Luds occered on 10/29 & 11/4) . Been in USA (F1, H1) since Aug 1997.

Our FP were sent back to USCIS the same day - 10/1/07.
What does this mean. The lady didnt have any information on name check. Seems like there is no way of knowing anything about name check!:mad:
Yeah sadly, there is no way to know. Even I am desperate to find out how one can know if they have cleared name check. I happened to know this from my friend - Get an infopass appointment and maybe an immigration officer might be willing to help you. I don't know how far this is possible since I HAVE NOT TRIED IT. But could be one of the options. More discussions from other experts might help.

Only My wife has got a medical RFE.
It talks about going to original civil surgeon and getting a TB test again and a Xray.
Did you face a similar situation as ours?
If yes can you throw some light on how to proceed.
I cannot go to the same surgeon since I live very far now.
Also worried why they have generated this RFE when I had submitted everything properly!
Anyways any guidance provided is much appreciated.

Yes we have received a similar RFE and can no longer go back to original civil surgeon. USCIS is very anal about TB test so if they don't get correctly documented result they issue an RFE. As per my lawyer many people are getting this type of RFE.
We went to a local civil surgeon and got whole test redone. Our civil surgeon did a physical but was able to get most of the vaccination records from last medical test. My suggestion will be to check with your local civil surgeon how he is willing to proceed. Most civil surgeons are not comfortable with signing documents for which someone else and would do the test again.
From what I learned from others is getting whole test done and submitting is fine. I am still in process of submitting my paper work for RFE so can not tell you USCIS's reaction for the same.
Bottom line is don't worry too much about this. but hurry up in getting an appointment with local civil surgeon as they have limited availability. :)

I got a letter saying they can not give me my job back dated 5 days after my approval.
I show up told them I was approved, they say sorry we have not sold anything on those 3 months, we are doing bad, cannot take you back.
They dont have any problems with it and I can wait 10 years to become a citizen if that is what it takes.
I think you are good so dont worry too much. I understand your fears and frustration.
Try to get an appointment with a good immigration attorney to see if you need any more documentation.
Please continue to support people like us who are struck in the process forever.

I did not understand the "time of filing I-485 (that means that visa is immediately available) minus time that I-140 was pending with USCIS" part.
My situation is as follows - My I-140 is approved and judging by the current situation my child will be above 21years (currently on H4) when visa becomes available.
My questions are - Will I be able to extend my child's H4 beyond his 21 years, assuming I continue on H1? And will I be able to adjust my child's status when visa becomes available?

As I have applied for 140 before she turns 21, she is safe for GC, but will loose H4 status when she turns 21. As per my lawyer's advice I have applied for her F1 so that she can stay and continue her studies in US. When I become eligible to apply for 485, she can be included in the application - but, not as a dependent of H1B holder.
