Indian companies like Satyam had been running these farce show of outsourcing for long time, and finally the reality is surfacing up. Not only did these companies run scam with their investors but also with their clients and employees.
As a client I see them initially low balling the real cost to obtain business and when the in-house engineering capabilities have been eliminated, they will start jacking up the prices. L&T did this with us and thankfully this month we are finally kicking their a$$ out of our facility. And we will do real engineering here in USA!
Couple of years ago, I ran into an indian at one of my visa renewals outside US consulate and he told me how, Satyam forged papers to have him slip into USA on L1 and than once here convert into H1 so he can finally apply and obtain GC. All these years he worked for remarkablly low wages.

Correction: paucity of skilled workers owing to emigration to the "more competitive" economies. It is the emigrant source countries that need to be complaining, yet in case of the US we find that most of the complaining is coming from the destination country !!! Sometimes I do wonder if the US got too much of a good thing too easily.

I think EB2 India may be retrogressed only for the month of September as most of the visas will be used in August itself. The dates will rapidly advance once again with the new quota in October. I think it is very likely that EB2 will be compensated with the number of visas that were improperly given to EB3 last year. So I expect EB2 to receive those extra visas from EB3 quota next year as DOS will try to compensate retrogressed countries in EB2 for the mistake that they made last year. If this happens, EB2 may become current very soon.
I strongly think DOS tried to compensate EB2 this year itself with the visas that were improperly given to EB3 last year after it received the directives from the US Congress. But unfortunately DOS could not compensate EB2 with the lost visas this year as there were no visas left in EB3 by the time they realized their mistake about 2 months ago as EB3 used most of their visas. This is exactly why DOS made EB3 unavailable so that they can compensate EB2 atleast to some extent. By law they are required to compensate a category that was artificially retrogressed because of their mistakes. It is highly unlikely we will see any significant movement in EB3 ROW or retrogressed countries until the entire EB2 category is current as EB2 will be compensated from EB3 quota. If EB2 is compensated with the visas from the new quota in October, then I expect EB2 including India and China to become current by the end of the year or early 2009(before March 2009) itself.
Once EB2 becomes current, I think EB3 India will get equal spill over as EB3 ROW as both the categories will be retrogressed and will move equally(as per PD) with the spillover from EB2 and EB1

This is a million dollars question on everybody's mind. Although the books says you can, I bet no body will take the risk.
Nobody can predict when July filer will get AP too.
There is a good chance I am taking this risk. But if there is any hope I will wait. Contrary to that if there is no hope I don't want to keep waiting until July next year for AP.

This new proposed rule will not matter for retrogressed categories / countries.
It will affect the lucky few whose PDs are current and can file concurrently. It certainly looks like they are enforcing (FORCING) premium process I-140s down everyones' throat now. It is a very typical dirty ploy from this administration.
Think twice before you talk about corruption and bribes in third world countries. We all know how this system 'works' now...

So that is a real publicity and that ignited the Immigration issues too. But USA welcomes immigrants more than any other country so we cannot get our problems thru the high level because its really not an issue.
Retrogression is not due to because you are from a different race. All we can do it try and make the lawmakers understand the problems and hope things will change. Atleast you live happily and no one fires racial slurs on you in United States.

However, your current Canadian address is not what you have in files on your I-485. Because, you can't give a foreign address.
So, I personally think you are beyond jeopardizing your pending I-485.

I am stuck in EB3 and want to apply for EB2. How does one find companies willing to do EB2? With desi consulting companies you can ask upfront to the recruiter but with american companies can you do the same?

My recommendation would be to build at least 6 months of emergency fund. Open an account with ING Direct or HSBC where they pay decent interest rate on a savigs account. Build the emergency fund first.
Once you have sufficient foundation, then I'd say start building investment foundation. If you employer has 4o1K plan, then start putting pre-tax dollars upto the maximum contribution at employer matches (generally it is 6%). If your employer doesn't have 401K plan, then open a ROTH IRA and start investing in low cost mutual funds or index funds. Vanguard is generally the best place to get low cost, no load funds. Once you max out both 4o1K and ROTH IRA, then start looking into opening a taxable individual investment account.

My parents will be here for more than 184 days this year (on visitors vis) and I want to claim them as dependats on my tax return for next year.I searched through some old threads, but the info seems to be outdated.
* Can I claim them as dependants on my tax return?
* Has anybody done this successfuly before?
* What is the deduction amount per person/dependant?
* What is the process? I know they will need an ITIN etc.

Greencard and H-1B expenses should be paid by the employer. Anything else is illegal. I am requesting admins to close this thread.
I think H1B expenses must be paid by employer. However, GC fees need not be... as GC is an optional element (employer is not required to process GC for every H1B employee).

At this time we do not have any one assigned member by IV to lead the chapter. However in the interest of getting things started I request the chapter members to organize a confrence call.
