Feel like crying..Can't control.poor my wife waiting for EAD...This is sick....Wasted so much time and money to get this done..waited for 3 years to get to this place..now back to trash chute...life sucks..

here is my theory.
DOS and USCIS played a tactical move by making all the visa numbers current in anticipation of the CIR bill so that the legals wont complain to the senators about retrogression.
Once the CIR went down the drain, they are panicking about the outcome of their tactical error and trying to undo that move.
Again, just my theory...:confused:

Same here, i got a similar response too... If they are true to their words abt under review, we shud b fine...
But the problem is, they mite b stating this under review for all cases to avoid repeated requests and hence the issue..
Is ur case also at NSC?
How has ur luck been with the POJ method? Have u always recvd the same informn from all IOs?
I always get a different response wen i talk to an IO at NSC...

If you can restart ur app in Eb2, you should be fine dates wise. Unless CIR messes it up.
Approximately 2 months for PERM and then you can file 140+485 concurrently.

I am still trying to talk the old employer. Is it such a big deal that they cant even write a letter of future employment for me? i told them that they are not obligated to hire me but they are scared that they are trying to show that they are in losses and that by filing for a GC and promising a future employment they will not be able to show that they are suffering losses.
Why is it so difficult and complicated?
I am losing hope in it.

It really is amazing how much hot air has been generated on this thread over a well established transit visa requirement.
The reason transit visas are required in the UK is that many passengers with an intention to transit the UK have stayed. The transit visa was introduced as a way of making sure (as much as possible) that the passenger has the intention and the ability to transit the UK and to enter a third country.
The list of nationals that are required to have a visa to transit the UK represents a list of countries where there has been a particular problem with over stayers. It is not race based, but merely an effort to target the problem.
It really does not matter what anyone thinks about the transit visa requirement because it is UK law. Everyone has a choice whether or not to transit the UK. Going back to the original post, to book a ticket without researching visa requirements and then trying to deflect personal responsibility by blaming the visa requirement is ridiculous.

I received the same thing. A canned reply asking to use their phone lines for inquiries. They returned my original envelope as well as my letter :rolleyes:

I sent in the four letters 2 weeks ago and this week I got a mail from TEXAS Service Center. They returned my letter in original and they also wrote a big one page letter.
I don't have it with me right now but in it, it was mentioned that "Please call us at our inquiry center if you have any inquires or you can check your status online as well as the recent processing times.
Don't know if others are also receiving the same returned mail but I wanted to let you guys know this as an FYI.
It does not seem like the letter reached the person to whom it was directed to.

Well, all the jobs you mentioned in your message now falls in Zone 4 i.e. Eb3.
Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.
Job Zone 4 does not automatically translate to EB3. Even though the title maybe EB-3, if the requirements exceed normal requirements for jobs in Job Zone 4 then after a (successful) business necessity audit the candidate maybe able to file in EB2. After all I don't think DOL is that brain-dead (yet?) to say that somebody with 15 yrs exp is the same as somebody with 1 yr exp although they have the same job title (E.g. Software Engineer title at Google generally has more experience and education than a software engineer title at a desi consulting company even though both fall in job zone 4
Solar power here has inadvertently opened Pandora's box in the process of trying to solve a genuine cause for concern. For most IT people it is going to be very tough to get EB2 classification (especially if you are just out of school and have decided to apply for a green card). It is better for them to look out for research positions and apply under Computer Scientists as this will atleast enable them to apply under EB2. Is this a good thing: If you are non-IT yes, if you are IT no as it just convoluted the process even more.

I am surprised that all other threads are getting updated quite frequently. People are posting question related to their RFE and as usual once they get answer to their problems, they vanish. People are posting jokes on IV, but when it is their turn to call, we've to "bump" this thread and send e-mails to members. So pathetic.
I felt very sad when I read 30000+ members donated some 4000 dollars in last two months. I felt my donation of about 1000 dollars since 2006 is being wasted to answer questions of or to solve the problems of these free riders &/or one question members.

I have EAD from an EB3 application and I applied for labor in EB2 with same company but different position while working in the new position on EB3 EAD
My eligible date for ac21 is Jan 2008
so are you saying I should only interfile 485 in Eb2 in jan 2011?

My lawyer advised me as I mentioned before. If your case is simliar to me and if you might have hired the same lawyer he would have advised you the same as what he advised me :). The key is the "wait period" and letter from employer " To show readiness to promote based on skill progression for 2-3 years". Technically "real promotion" should occur on the day of interfiling or immediately after that not before the interfiling.

But now i think its not stuck due to PIMS..it could be anything ?? some admin processing ? some security check ? some name check ??
How do we differentiate what are our passports held up for..COULD THIS BE CALLED 221(g)..i read in forums..221g can take forever ??

what is the meaning of staff augmentation case? He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.
