EB1 is the most imp for US, followed by EB2, followed by EB3?
Why should USCIS follow the approach of oldest priority first? without any regards to the EB categories?
EB categories were created for a reason, doesn't matter how smart you are. If you are in lower skill category your wait is bound to be more. I don't see anything wrong in that.

i got my 'decision' email on 10th. But after that nothing. No CPO email/No welcome email/ No LUD.
I am hoping that they didn't let my case 'drop through cracks'. Considering USCIS's way of working I wouldn't be surprised. Will give a week or two more.
You got it right.
They have thier own of operation. My CPO status was registered on Aug 5th. I got CPO email the next day. Then on August 12 it went back to post decision activity. I got the approval or welcome mail (snail) on August 12th itself. After that there is not change or update. All we can do is to sit back and wait for little bit more.

Is 28.6% india Quota??. out of the 140K
I thought each EB category could get upto 28.6% of 140000 = 40000 visas every fiscal year. So if EB1 uses up 5000 and EB2 takes the remaining 35000 and its annual allotment of 40000, EB3 does not get any spillover.

I see that you guys didnt join IV until 2008. So, you know very less about this org. The people who only can think for their own wont come to join you at any stage, it was proven many times. They will just keep writing messages here and use valuable information on the forum.

I know quite a few of my freinds who had masters, their corporate employers applied in EB3, none of them are trying to do conversion. But, i feel their pain.

While a lot of people sending generic letters on this issue would certainly bring the underlying issue to the discussion table - the lack of "locus standi" would prevent ombudsman or even USCIS from acting.
Let me explain what I mean by the above statement - every case is different and is adjudicated according to the merits of that specific case alone based on applicable laws and procedures. So, investigation and even future policy direction can be only be based on specific instances of the entire case files and detailed specific reasons of how these cases were wrongly adjudicated.
So, the service centers and even the ombudsman is right in saying - we cant help till we have actual case #s

I was amazed to hear about the development. Would Mr. Gonzalez will show a curtsey to personally reply to all the people who sent flowers, and apolozise for the pain and emotional trauma his agency has caused to thousands of legal immigrants in this country ?
BTW, couple of years ago one of my American (citizen) friend was dealing with USCIS (at that time INS) to adopt a baby from China. When she got the baby after struggling for 4-5 years and with a push from local congressman, she was agahst with the way USCIS treated her. I still remember her remarks "If they do not understand the pain and suffering of a mother, and they do not care for a suffering orphan child, I highly doubt that they have any more humanity left in them".
The name has changed but the public face of the agency remains the same. Please remember that for them we are not human's, we are just file numbers sitting and rotting at their service center's.
So when USCIS decided to forward the flowers to our soilders (which we think is an excellent idea), its not because the agency has a human touch in it, but its because they found an excellent face saving mask for their unjust action.

Also me too in the list ..... Also its better to rise a serv request , specifically make it in the req ur Courier tracking details etc. Eventhough its imp now to get in touch with respective congress men its very much imp to make this so USCIS is supposed to answer that req in 30 days if not which will add to the case.

The key here is revocation vs. substitution. Per discussions with immi attorneys, AC21 portability is not explicit on what needs to be done if I140 is substituted by previous employer and NOT REVOKED, and the applicant is eligible for changing jobs (same desc and 180 days pending). The fact is that this loophole leads to illogical scenario--2 applicants taking benefit from same I140.
Question to you and other forum members: Is there a thread on this specific topic?

Hmmm - not sure because, if the job requires that someone must have security clearance - the job must clearly mention that someone with security clearance is needed. What is the point in hiring a citizen without security clearance (unless they want you to get clearance aftewr hiring)

One cannot specifically say - I don't want EAD or GC or I want only Citizens.

But you never know, the Dice and other job posting sites, just post what ever the client submits. With premium accounts, you manage the posting and I do not think, these sites control the contents. I also surfed the company website, and looks like they do have some federal clients and based on VA. It looks more like a clerical error than intentional posting. May be, an email to the HR of the company, with supporting links that does not encourage such posting legally will educate / prevent such posting in future. Any other members with in depth knowledge on this.. post your comment. Also job websites like Dice / Monster, etc...should ensure Quality of posting rather than having a disclaimer :)

May be, an email to the HR of the company, with supporting links that does not encourage such posting legally will educate / prevent such posting in future. Any other members with in depth knowledge on this.. post your comment. Also job websites like Dice / Monster, etc...should ensure Quality of posting rather than having a disclaimer :)

Finally, we got the approval emails for self & wife.
I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-
1: The review was complete
2: Visa numbers were requested 2 months ago and all security/prints are current
3: Files have been forwarded to officers for completion.
In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.
As others have mentioned IV has played a big part throughout this journey. Thank you again.

We have no idea how many are legally porting from EB3 to EB2. I am sure many are trying but the data is not available. I dont know how you will move forward without such information.

Thanks guys .... for coming behind me .. Shane Warne or Purple Haze won't satisfy you guys .. Y dont we discuss how Kanimozhi's discontent couldn't play spoil sport for the new govt and how Azhagiri got cornered with chemicals and fertilizers (these 2 are not any interntaional fame for an american 'tunnel rat' to know abt them).
Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.

ICE has a historically poor track record on enforcing H1b/L1 rules. Only lately there has been on enforcement on the H1B rules. All that one can do is complain to USCIS / ICE
etc but they don't do anything then you may have to talk to you senator/congressman etc. Sometimes senator/congressman are also non cooperative.
Let alone L1, even B1 visa is used like a short term work permit by many IT companies including American IT companies

I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. That is not an RFE. It's a welcome notice, which is expected.
Today I got one more email (See below) and my status changed from CPO to Decision. What does that mean? Did they send an RFE?

Not sure i agree with that statement. The way the spillover trickle is reaching EB2 there is no way EB2 will become current for atleast 5 years so impact on EB3 within a year or two is a incorrect statement
If the momentum continues, EB2 will be current in about 2 - 3 years. There are roughly 15 - 18K EB2 I applicants per year and around 5 K for EB 2 C. the number will defnitely be less during later part of 2008 to mid 2010 due to Economic downturn.
The current queue for EB I + EB C till Aug 2007 ~ 36 K

First let me state that I need people like you to proceed and hence I will be happy to answer the points you rasied to the best of my ability:
We all agree that there is severe backlog. Only way the backlog will alleviate is by increasing visa numbers, which not going to happen any time sooner.
So some people (and I know around 10 of them) what they are doing is the following:
They got the chance to file their 485 last July , which is pending. They are now contacting several small desi consulting firms to file for their fresh labor in EB2 category. Once their labor is filled and new I-140 is approved, they plan to attach new I-140 to the original 485 and hence effectively convering to Eb2 category but with priority dates in 2002 and 2003 (because original I-140 had that priority). Worst, they would never join that desi consulting firm...
This how the system is being gamed. If I know 10 such cases, I am sure there must be thousand like that.Now you tell me , isn't that unfair to the people already in Eb2 line as well as the ones who do not know how to game the system
By the way: If any one is interested, I know of three such consulting firm that can do for you for a fee.
Though, it is unfair one can not do legally, as long as USCIS recoconoze the the job offered at desi consulting companies are genuine and real "fulltime permanant job". They may be gaming the system..it is their model of bussiness to make money..and it is well supported by lawyers, lobbyists and ofcourse benefit seeking employees. You cant break this strong wall before the uscis. You should have witnessed how much resistance they created when DOL/USCIS abolished labor subsitution. In nut shell, if you close one loophole, they will find another. You are in wrong forum..
