I think you should probably have your surgery instead.
I don't see the point in dissuading people like this. This is an example of someone who was able to adjust an important appointment because he thought that it was equally important for him to be at the rally to show his support. Ofcourse there are some things that one cannot adjust, but is it really true of everyone?

This is a good idea. See my answers in red inside your post
Pappu, thanks for the initiative. I will contribute.
No need to thank. Just show up in DC to community your GC problems to lawmakers. That is a big thank you to IV team in itself for all the time, money and energy we are going to spend organizing this event.
You will contribute for yourself. This advoacy day is for you and your own greencard. It is not a charity to IV. IV is you and me and we are only providing another avenue for each one of IV members to come to DC and tell lawmakers about the suffering they undergo during the greencard process.
I also have another suggestion. Why don't we also do a targeted campaign at partnering with corporate HRs to push for EB relief.
Yes we also want that and need your help and everyone on the forum to help us
Many corporate HRs are aware of the EB2 and EB3 retro pains.
Incorrect. How can they be aware of any pain themselves? Has anyone even approached the senior management asking for help. Raely anyone has done that. And whenever someone has done that and help was offered , we have known. The fact is HR of big companies do not know of any pain. Even if they know of any pain, they will not do anything about it unless their OWN employees tell them about it and ask them to help them by supporting IV. This is not happening and that is the problem. IV is you and me and everyone else on this forum. Not just pappu or core team. Each one of us working for big companies need to gather courage and approach the senior management. It is very easy to comment on the forum and provide big ideas and direction, but I have seen that when it comes to walking the talk very very few have the will or interest to carry out their own suggestion. IV was created precisely for this reason. People were lurking on various forums before IV and hiding behind anonymity. They were scared to do anything and could only hope to GOD , lawyers or whoever could help them. Everyone was throwing ideas at each other and not doing anything. The whole community was screwed and nobody was even willing to even go and talk to the media with their real name, go to DC and talk to lawmakers on their own money and vacation time. People would not even open up to their friends and talk to their friends about green card problems and do something together. This community had to stop living a life of tail between the legs and blaming their fate for their own problems. IV is a platform where you no longer have to complain. Each one of us on this forum has now enough awareness, has seen what we all are capable of doing together in advocacy so there is no reason to not approach our employers.
These corps rely on EB2 and EB3 folks for innovation and technology. Corporations have a lot of power in pushing legislation.
If this is true, what is stopping us try this route?
I am just suggesting to try other channels as well. Corporates being just one.
I agree. Let us try.

Address is not of any value. What we need is real humans in our community who can approach their senior management and talk about their plight. If you are really serious about your idea, contact us. We will help you. You can lead this effort by providing guidance and information to other members how to carry out this idea. If you work for a large corporation, you can first try it yourself and lead by example. If you work for a small firm, then you can volunteer by collecting interested people on the forums and coordinating this effort.
The fact is, each one of us is capable of carrying out our ideas if we have the will to do it. This will happen only if we are sincere about this effort and really want to do something about our own greencard. If we all think that simply coming to a forum and posting some ideas or arguing with others over spillovers or predictions is all they can do, then we are all wasting our time, energy and money. There are many other sites out there where you can track your applications to waste your time. Or post unlimited ideas for nobody to work on or just argue with other. None of the people benefit from such sites, except the owner of such sites that make lot of money from the internet traffic or publicity of their legal business or any other business services. What form does your brokerage firm send you at the end of the year? Is it a 1099-INT form that records your profits for the year? What if it were a loss. Do you still get a 1099-INT.
An H1B working for a single employer will have only one W-2 but he / she may have different 1099-INTs from savings accounts / trading firms etc for filing taxes. This should be ok, correct?
Investments are not reflected on W2. If you use a broker such as TDAmeritrade etc they will issue you a 1099
You will receive an IRS Consolidated Form 1099 - an all-inclusive document showing your reportable income and transactions for the entire tax year - if your brokerage account received at least $10 in either dividends, interest or original issue discount (OID) income, or had an equity sale, in the 2008 tax year.
- You will not receive a Consolidated Form 1099 for a retirement account, tax-exempt account, corporate account or foreign account.
- In addition, you may receive a corrected Consolidated Form 1099 if you held an investment trust that reclassified income after this form was sent to you.
There are 2 sets of rates.
1. Short Term Captial Gains
2. Long Term Capital Gains Taxes
Short term capital gains taxes are on stocks that have been held less than one year before selling.
Long time term capital gains taxes are on stocks that have been held more than one year before selling.
Long term capital gains taxes are less than short term capital gains taxes.
If you don't sell the stock, there is no tax on the capital gains.
The amount of tax depends your tax bracket.
The taxes on dividends are usually less than short term capital gains tax. So if you have a stock that is about to pay a dividend, get the dividend before selling, as that will reduce your capital gains.
Hope this helps

GCKarma,
How do u know that CIR is dead..? I could not any information on the link provided.
I do not know any thing like this where people on H1 (I am not forgetting L1s and others .. :) ) have come together and voiced a request to hear our problem and reduce retrogression.
I wish this goes forward .. Plan B, I think SKILL BILL (?) must be put in to thought.
Yes I read It wont come to a debate until the current one is resolved. I also read , the effort will continue until this problem is looked in to and helped.
CIR may not be completely over ... but discussing Plan B would be good.

Dude, I was under the impression that coming on Sunday is enough. Are we going to have a call (at least at a state chapter level) before the event?

i met a guy like this last weekend. came to US 2/3 yrs back. has masters in India and has 5 yrs total experience. not doing any research. He is actually a contractor at a client. the employer, applied his GC under EB1. he got GC under 1yr. I was amazed.
he says, his employer applied for few of his other colleagues too, but rejected. most amazingly, for one of his boss (1 or 2 levels above him) also they applied under EB1 but his app was rejected. unbelievable stuff. i guess the EB1 verification is random.
If you think any fraud is going on or there is a law being misused you must complain to USCIS and Ombudsman. Unless it is reported nobody in a position of power will know about it and nothing will be done to stop it.

I guess, it is the 13th ....such an unlucky number..Just kidding..When all of us are so anxious about this..I can't even begin to imagine what our EB-3 friends are going through. Especially to whose who have been waiting for almost a decade (or more) and still stuck..
I guess, we should take all this news with a pinch of salt..
Cheers
It looks like November 2005, Jan 2006 and Feb 2006 priority dates are somehow lumped together. Of course mine is December and far be it from being even considered :)
gbof and anilkumar... I think this is the hardest wait for us. I hope the two of you and all others get approved soon enough.

Thanks to the core members and volunteers for working hard on this immigration issue. Hopefully there is light at the end of the tunnel and hope it's not a never ending tunnel :)
I have asked a few of my friends to contribute, but as somebody else has mentioned, it's extremely hard to convince people to contribute. We can't force them :D
Go Immigration Voice !!! Let our collective voices be heard loud and clear ;)

Hello IV:
I happened to surf upon the NumbersUSA website and the general outlay of the website clearly establishes their objectives and motto. Although IV is fighting for a niche stage in the legal immigration process, a stage which almost all non-immigrants have to pass through, it is my perspective that this is never clearly communicated. The NumbersUSA website is visually more informative.
Most probably, NumbersUSA has a much larger pool of money. Some persons believe in their cause by making contributions. They may have full-time employees and/or professional support.
Most persons stuck in EB retrogression want service at NO COST. Most others want service at negligible cost.
IV appears to be having a hard time getting contributions even they beg for it.

I have the birth certificate from my 10th grade. The one we got after the 10th grade board exams. Is that ok. I don't have any other cz I was born at home :o
Will that work?
I don't think your 10th grade certificate will work. The birth certificate should be given by the Muncipality and it should indicate the date your birth was registered, your name, DOB, Father and mother name.
If you don't have this kind of certificate, you need to submit a non availability certificate with two affidavits.

My wife and I went for the medical examination 1.5 years ago, when we thought we'll be eligible to file shortly. We still have those sealed envelopes. However, the time passed and I understand we need to undergo the exam again for our June filing, correct?
The first time around my wife had a positive skin test (immunized in childhood) and negative Xray. Back then she was advised to never do the skin test again, as it'll always be positive. So, she'll need to go for an Xray this time. However, she is pregnant, and they don't Xray pregnant women... Is she an exempt then? There gotta be a provision for something like this, right?
Thanks.
Vlad
My wife and me went for the medical test today. We had a baby boy a few months back. They didnt do the immunization and skin test for my wife but did the HIV test. They said they would mention the same in 693 document that the test were not done because she is nursing a baby. But this doesnt mean that she is exempted from immunizations and TB test. She would need to come back and do the immunization after 3 months and the doctor would keep a record of it and INS would varify it later with doctor about the test results.

Hi Summitpointe,
I think you can take info pass appointment and show them EB2 approved I-140 with priority date as Spt 2004. Last year I also converted my EB3 to EB2 but my lawyer filed I-140 and I-485 concurrently around Aug 2010 and USCIS rejected the application saying priority date is not current for the first time. My lawyer filed is second time with old fees stating that when application originally filed with old fees they again rejected and finally 3rd time with new fees they did accepted applications. For my case they approved my EB2 I-140 and 485 just same day....... and got my n my spouse's green cards... after painful immigration journey....
All the best !!!
I would like to take this opportunity to Thank Immigration Voice Forum... Its a great place to seek help for any issues related to Immigration ...

Finally Greened. It's an amazing feeling.
Just checked my MAIL (Saturday) and it had my approval mail as well as Physical Card. Strangely both came in together.
Thanks to IV, I am not a donor but time and again I keeping making one time donations. This forum provides so much knowledge that money support is the most trivial thing that one can do.
Few more notes that might help other folks who are current in May and waiting to be Green
First I have email and mobile alert on for my 485 but got none and the status on my portfolio still says Request for Evidence Response View. Last LUD is still Aug, 2010.
Second I had an RFE in Apr 2009, General RFE asking for work details from my employer.
Got FP just once.
My PD Jun12,2006 NSC
I have not changed my company but my company had been bought and name changed and all this year I have moved and changed roles and profiles. Also I am on EAD though never changed jobs.
I was anxiously waiting but didn't opened any SR or contacted congressmen. I was planning to do that next week.
By the way I am still waiting for my spouse's GC.
I added my spouse on my application in 2008 (last quater when dates touched Aug 1,2006 before retrogressing)
I am going to party this weekend for my GC and next weekend for my spouse's :-) Only advantage of not getting both GC's at same time.
Congratulations to all that got their GC this May & Good Luck to all those who are current in May and will become current next month.
