    If your argument is that after holding a US Masters , OP will not be a legit EB2 applicant, even you are not legit. Go get some education

    As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.

    While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year – over a 44 percent increase in the number of cases pending more than 33 months.     The backlog appears likely to get worse, because a USCIS fee increase -- slated to take effect in July -- has prompted a 50 percent rise in new naturalization applications so far this year.     Just Thought

    There is 200k application without 140 approval, this is including july filers.

    there is lot of chnace for those who got their I-140 approved, even their PD '2006.

    you can see people getting approved PD'2005 EB2 cases, even then VB says now 2004'apr for EB2.They are not processing based on PD now and in future also i gues.Since we have already filed.PD will restrict only to File I-485 in future.

    TSC approving old PD I140 first and that is suffient for demand supply ratio. no approval possible with PD'2005 EB2 cases for contries like India.

    1. If you are in IT field, you don't even have a grasp of software development lifecycle and the part QA plays in it. A good QA cycle is essential for a good quality product. It is your ignorance about software development cycle that makes you say good QA guys are not an asset for a good product and they are not smart as developers.

    Well I am not a software engineer but I do understand the role it plays so I do know im not dumb. Thank you for your words of wisdom.but I wouldnt agree with the fact that people have to be flown in from other parts of the world for this, yes there are corner cases in every product validation cycle which needs really talented people the vast majority do not do that

    A tenth grader with enough common sense can do good software development. India produces lot of people with good common sense and analytical thinking. That is one of the reasons for India's software boom.

    IMO if you don't have a patent in your name, you are not high skilled enough.



    2. How many consulting companies do you know do charge their candidates for filing H1 ? I haven't come accross any. It is illegal to do that. If someone is doing that, ICE is after them.

    i asked the exact same question to my lawyer... she had no evidence or past precedents... i doubt if any lawyer will have it...

    the thing to note here is this: more often than not, your 485 will get approved (if your case is approvable) without any issues in the normal course... the question of denial comes ONLY IF there is an RFE and then ONLY IF IO is not satisfied with your RFE and he calls you over for an interview and then ONLY IF he is not satisfied with answers you give in interview. Taking a wild guess, we are talking about maybe small percentage of folks going to the RFE stage and fraction of that going to interview and a fraction of that actually getting denials... if people have other complications such as basic legalities in their business/self-employment or any other issues such as no pay for long time etc... then i suspect they may get denied whether self employed or not.... but if all is clear, then it should be very minimal...

    GREAT I SAY! What do you think?

    Do we have any conclusive evidence of these cases? Have we seen prior cases being approved using this approach?

    Thats just too much bull for one day. Just when I thought that it was enough for 2008, you drop this bomb called "God's protection over this land" and made me read those illogical ideas. So this is what I have to say -

    Can you prove the existance of God? Who is God? Where does he/she live?

    You see, down the ages mankind have been told to think in a manner such that - anything that we cannot logically explain, we just come up with the rationale that "God did it". So for the things we can explain, we looks towards that knowledge, but for the things we cannot explain, we still try to explain to ourselves & others by saying - "God did this". And this is how the author is processing information, and this is everyone reading it will understand.

    And this behavior is not a fault of anybody alive. We have inhereted these genes through thousands and millions of years. And those genes in us are designed to make us "blame or credit God" (whichever way you look at it) for everything we cannot explain. Now there will be some who will tell me that I am WRONG for saying "thousdand and millions of years" by arguing that Adam and Eve came just 2000 years back and earth was created in 6 days, and human beings were created some 2000 years old.

    Human mind is extremely inferior. and for own inner sense of inferioirty, we want to tell everybody and our own ego that we know the reason for everything. And for the things we cannot explain, we explain such events to ourselves by using the argument "God is the reason behind those events". We cannot just accept "I don't know how/why it happened". Humans have to explain everything and a lot many times in a day, we explain events by telling ourselves - God did it.

    One more thing, often times, unknowingly, we give more weightage to the writings from people who passed away as compared to the writings by folks who are still around. I think we should question everything told to us, everything feed to our brain - and we have that moral responsibility towards ourselves to question specially the things which are thrown at us with the message - "just accept it without qustioning", because religion and different version of the description of God cannot be questioned. It must be accepted the way it is.

    I think that the greatness of America and its history is not because of the "Religion" or "God", but inspite of it. The fact that "Religion" or "God" is kept out of the Government is the only reason for the progress you see around. For millions of years religion was the center peice of every government, and so our ansestors lived in backwardness. Almost 99% of all inventions have been made in US, where State is "independent" of the "religion", although there are lot of nuts out there who wants to change this. As per the "religious folks" God will never protect a nation that intereferes with the work of religion, right? So why would "God" protect this land?

    Anyways, I want to write for another 200 pages, but, I got to do this job and earn for my family, otherwise "God" will be angry with me.

    How can you judge God's intentions when you don't know Him? Can you prove that God does not exist?

    We can also look at the possibility of mass drive towards bone marrow doner registration, Blood donation drive, Eye donation, etc.
    Also possible is continue with Youtube videos. I think the reason for low response a) laziness b) doing alone may not be exciting and motivating enough.
    Suggestion. We do the youtube videos in groups of three/four. It would be fun activity and will help to build bond amongst IV members.

    I agree with you, i think he is in deep s.... and the whole trying to type broken English thing is also fishy (in my opinion its on purpose)!

    This guy has been in the country for more then 3 years (at least - based on his h1 being valid till 2011 which means recently extended)) on a work visa and cannot communicate a simple fact that they were fooling around and he didnt intend any harm (if that is the fact).... HE must be really really good at what he does at work for his company to keep him!

    But to give the benefit of the doubt and innocent until proven guilty - I wish him luck!

    I really hope i m wrong in judging you... and seriously I wish you all the best if you are being honest about the whole thing.

    I believe sanju is right to a certain extant. However, I believe it depends upon how much of a close relationship you have established with your clients or per say other clients. Have you done good networking...check out LinkedIn, if not. I can guarantee that if you were to go alone...you could easily ask for at least 110-130/hr, however you may not be able to get the $180/hr, since the companies like IBM, Accenture, Deloitte have an established brand name.

    This is something these firms have developed over the years. You will be competing your skills and your relationships versus their combined skillsets and knowledge database, their legal backings, their relationships (not just money) and their history. People are ready to pay for a Cadillac because it is a brand name, while for a Ford they willl not pay that much money.

    The key is the relationship and the trust that your client will have with you, rather than your current company....if your company has a bigger and better relationship, you will have a herculean task of removing that and replace that with yours, by proving that you are worth the money. Once you establish the brand name and expertise and the legal backings...you too could get may be $140 or so, but will never be able to reach the $180 level.......This is the industry.

    I tend to think a point system is better than what we have now. One thing though is that the points should be allocated "properly". For example, more points should be given to people with higher education, who earned a US degree, who have worked in the US for more years, who have paid more taxes, etc.

    Someone mentioned a good point is about the visa number limits. If the per country limits are not eliminated, the points system won't solve the problem. Of course, they should also give more points to people who have passed Labor and I140 and allow them to adjust status right away. Otherwise, we will further get stuck in all the backlogs. Poor us. :(

    I think if all the above issues are solved/cleared, probably a point system is good for us (i.e., EB based immigrants who are now stuck due to backlogs and retrogression). :p
    Once you have a point system , a whole lot of people will be qualified, many more than currently on H1B from other countries , it will again clog the system, remember for canada the waiting time in india is 5 years now for skilled people who have enough points.

    Again it goes to the basics how many skilled ot semi-skilled people they want in this country.

    Like I said earlier I pretty much feel the same way as you do. I want my spouse to be able to work for a couple of years before I think of moving back to India. But in reality having waited so many years do you think either you or myself will move back 2 years after getting the GC? Don't you think you will be tempted to wait 3 more years get the US citizenship and then move back? I have a few friends who are pretty much just waiting to get citizenship to move back. their argument is that we waited several years to get a GC and we don't want to just throw it away.

    As for making H1B more humane I think it will never happen.

    Most H1B holders get very good offers when they move back to their home countris after say 10 years. But the H4 spouse who spent al these years rotting in the USA again have to continue rotting....Their prospects are dim. So I want to get my GC. Let my spouse work here for couple of years and move back to my Own country.

    So why not H1b made more HUMANE ?;) ;) ;)

    I got an e mail from customer service this morning stating they had forwarded my letter to upper management.


    It(this issue) definitely got to their attention loud and clear, and hopefully it will have an impact of both sensitizing them to this separation in the future as well as prompting them to give our issue more coverage going forward. Perhaps I am being optimistic here, but one can only hope.

    Did you or someone you know experience such questions at POE for an advanced parole? Or are you just posing a hypothetical?

    I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.

    Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.

    If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.

    Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.

    What is the point of having an early 485 filed, if you are not going to use EAD and AP and be at mercy of consulates for restamping and be at mercy of employers who will need to sponsor you to hire you?

    Can we get License renewed using EAD and not having H1?.
