Consulare processing means, you have to go out of the country to your home country and over there you have an interview for an immigrant visa. If approved you come to the states with that visa and receive GC here. If denied, consular processing CANNOT be appealed. The decision is usually final. When you do I485, whcih is adjustment of status, you stay in the US and if gets denied you CAN appeal the decision. To be eligible for adjustment of status in the U.S. one must show he/she never violated non-immigrant status until the I485 was filed(since last entry).
If you file I140 while being on F1, that could be taken as "violation of non-immigrant" status. It is advisable to change to a dual intent visa before filing for I485. Such visas are H1 and L1.

There was a problem in the first two of seven D70s I've used. The focus calibration was off by about a tenth of a millimeter. This means that your images will not be focused on your subject, but instead on something somewhat behind your subject. Don't confuse this with the common mistake of having selected the wrong AF area or otherwise pointing the AF sensor to the side of your subject. Nikon of course will adjust this under warranty if it's a problem. With common f/3.5 and slower lenses it's not much of a problem, and at regular shooting apertures of f/8 or so its completely invisible. Some people incorrectly call this the "backfocus" problem.
On the other hand, if you have fast lenses that alone cost more than the complete D70 kit and you shoot them wide open you ought to check your camera. My $1,700 28mm f/1.4 lens (http://www.kenrockwell.com/nikon/2814af.htm) wide open at f/1.4 was useless on two cameras, but of course OK at normal apertures. You won't see this through the finder. You have to look at the images at 100% on your computer. It's simply the image being focused on something just a little behind where it should have, which is usually invisible if you have enough depth of field, and of course Nikon will stand behind it if it really is a problem. The samples I've used in May 2004 now seem AOK and mine is perfect, even at f/1.4.

Testing this is simple. Just go make at least a dozen photos with your lens wide open and look at the results at 100% on your computer. See if the camera really focused where it should have. This miscalibration is the reason some people think their D70 images are soft. They aren't soft; they simply are focused on the wrong thing!

On the other hand, I respect his innovative spirit and it's this pioneering spirit which makes him an honorary American as far as I'm concerned. Please use a real Allen wrench to make these adjustments, and remember that Nikon will do it correctly for you for free under warranty and probably clean your camera as well at the same time!

I think the new name check change, will help the system work FIFO.
This is what the system is intended to do.
Also, as time goes by, this will make the PD more transparent, so instead of having dreams and making wild guesses, there can be somewhat logical guessing.
I know it is not possible as it is USCIS and anything can be true.
But i am really happy for people with older PD's who have been struck with FBI Name checks.
Please help IV with the letter campaign and also lets get together and try to make the system more transparent and open.

Can we see some material that you have done. I personaly would not even attempt to do a pay job just yet, you have to know AS HTML PHP XML XSLT by heart and you have a Deadline, I do not sugest that you attempt it, but if you HAVE to you could try to pull one off during the summer.

1) Degrees from non-accredited colleges cannot be used for any immigration purpose (or for any other purpose for that matter)
2) A Post Graduate diploma is not enough for EB 2. You will need to do a Masters from a accredited US University. Remember, many online universities (including Phoenix) are accredited too.

Wait a minute…. You guys have a problem if someone else is getting GC even though you guys very well know how much difficult it is to wait for the long process to finish. I am completely stunned to read some of the posts on the forum as these posts are always looking for parity with this or that group. Some posts say “why undocumented are getting GC after paying 10K as we have been paying taxes for years”, some posts simple whine as to why L-1 get to file in EB-1 etc etc. Is there an end to this unnecessary complaining and this urge to always looking for parity, sometimes with the privileged and sometimes with the under privileged? Some posts are always looking for “fairness” whatever "fairness" means to the individual situation, and then, blame the rest of the world around for delay with their green card process. I think we ought to grow-up and stop complaining about someone else getting their green card. We ought to stop complaining about all the wrong things that may be going on our lives and we should get serious about making phone calls and meeting with the lawmakers. I do not intent to start a flame war and my intent is not to offend anybody either, just trying to point out that we could be happier and effective if we stop whining and complaining. It would also help to create a more positive and constructive environment on the forums.

My 2nd I-140 which I wanted to use for interfiling was denied based on A2P - it is under Appeals now which will take forever; so I'm not a candidate for interfiling for the time being.

I agree with what thomachan72 says. You are better off sending only the necessary documents to keep your case crisp, instead of confusing the adjudicator with reams of paperwork. I don't think you need to write a letter explaining non-availability of experience letter. I certainly DO NOT recommend bringing up the bond and other disputes with your previous employer.
Like you discovered yourself, your case got an RFE because of the missing document. With all the affidavits, paystubs and offer letter you have a clean case. Don't mess it up by giving too many unncessary documents.

I would love to take the lead with this project. I have done a fund raising initiative for Arthritis Foundation of America when I ran the Mardi Gras Marathon in honor of my mom. I raised $1,100 in a 6 month period for the AFA. The idea I have is that Team IV members will participate at their local events and we should pick 3 national events such as the Chicago Marathon/Half Marathon, the Breakers 10K (is that San Diego?) and even the Crescent City Classic 10K right here in my hometown. Team IV should be well represented at these 3 national events.
Team IV members can set up an e-mail support group when training for any events. There are numerous on-line training guides which we can use. And I can also look into the idea of an on-line training coach.
I already have the committment from 4 friends, all of whom are US Citizens, to join this Team because they support our cause.
This is great NolanIndian and I wish you guys all the best!!! Unfortunately I am going to have to watch from the sidelines so to speak as I have ongoing bursitus from marathon antics in 2006--Go IV and watch out for those joints and tendons ;)

I double checked with my attorney , either or AP or EAD usage will change your status, ie H1 is no more valid.

Did you file a derivative 485 for yourself based on your wife's application before it was approved?
I think your lawyer made a huge mistake of not filing a derivative 485 application for you beginning of September when her PD got current, this would have ensured you got tagged along with her application, mere letter to look at your case when your priority date (2001 eb3) is not current doesn't make any logical sense...
Keep the hope... on the bright side your PD is 2001. Best wishes and good luck!
