Gurus,
July filer...
Here is my current situation
1. Entered US on H4. H4 is stamped on the passport until 2010.
2. Applied for EAD (July filer) and current using EAD for work
3. Will go to India this year end and planning to come back on the stamped H4.
Here are my questions
1. When I entered on H4, on the POE, the officer would have marked my status as H4. Now, I have used EAD...so currently I am on AOS pending status. How do they know this? Is this based on the I-9 that I have filled for the employer? But I9 form is retained by the employer unless requested by USCIS, so how does USCIS know that I am on EAD (AOS)?
2. When I go to India, I will surrender the I-94 that I received when I entered on H4. So when they tally their records, will they treat me like H4 leaving US or EAD (AOS) leaving US?
3. When I reenter US on H4, again my status will change to H4 right?
4. At this time I assume that the EAD card that I have is still valid (Not invalidated because I entered on H4 and not on EAD/AP. So, If I have to start working again, Do I need to fill the I9 form again for the same employer.
5. If I do not fill the I9 form, then how will USCIS know that I am working on EAD...which means that my status is AOS pending?
6. In my case, the primary applicant chooses to remain on H1. So if our I485 gets denied does this mean that I am out of status because I am using EAD or does it mean that I am fine because I entered on H4 and that is what they have in their record.
7. If I am out of status, can I file for a change of status to H4 or an extension to the previous H4 from US itself so that I continue to be in statusor do I have to leave and enter the country again?
Thanks in advance for your replies

Uma001,
My previous to previous employment is 3.5 yrs for which they said nothing. RFE clearly mentions name of my last employer and says to submit proof with dates worked from-to, responsibilities and job details.

Dude....
You want to see the March VB:) ?
Why waste time? Just look at Feb VB..it will be the ditto copy n paste.
The lazy html programmer might have already cut it by now. He will take 3 days to paste it into a new page. After all that 'hard work', he will bring out a broken link on the 4th day.
Really getting tired of this monthly ritual!
The fun lies in the anticipacation for a forward movement! Its like the first thing you want to make sure to atrt your month!

People do not buy house to sell it. They buy it so that they can live for a long time. And when you do not know how long you are going to stay in this country(because of immigration issues) then why would they buy. There is something called closing cost, who will pay them if you have to sell?
Yes Sir, very true: "People do not buy house to sell it". I am not suggesting that you buy a house and sell it, I am suggesting that in case you plan on buying the house .. don't get intimidated by the bad immigration experience of few folks. My point is that in worst case scenario, if you have to go back to India (which is less than 1% chance), there are ways to deal with house situation.

Is it possible to file I-485 without I-693(Medical) ?
The reason I ask is that I cannot get a doctor's appointment in July. For some reason, if we are able to file in July, can I submit the 485 first and submit teh I-693 later.
Please advise

We all know why! America decided it's smarter than anybody else: "Hey, let's let new people into the country and then exploit them for as long as possible! Well, we gotta give them some hope that that some day they would have the same rights as everybody else, but who said we need to keep the promise? There are so many ways not to: overcomplicated "process", quotas on Green Cards, processing delays, no fixed, mandatory processing times, etc." Once you realize the main goal of the immigration policy - to create permanent underclasses whom America can discriminate and exploit, everything that happened in the immigration history of USA, especially recently, becomes very logical. Unfortunately, it's a long time tradition in US to exploit and discriminate "recent" immigrants. Remember "No Irish need to apply"? How about the Chinese workers who built the transcontinental railroad and then were lynched and Chinese were effectively banned from immigrating to US for the next 70 years (see shusterman.com for more historic examples).

I will next month. Using same/similar job. And also, my lawyer said that we do not need to send AC-21 letter to USCIS, wait for the RFE, if any. So don't worry and enjoy this small freedom.

Why don't you find someone who is in similar situation ? i.e. who is on EAD or on H1. There several websites that can help you : shaadi.com, jeevansathi.com, bharatmatrimony.com. Now I'm not endorsing these sites. Just providing you with some options you can look at. Man accept it - life is tough. We have to play the hand we have been dealt. Also remember one more important quote:

...There is some possibility that India EB-2 could again become available if it appears that the demand for India EB-1 will not exceed the annual limit, but, that determination will not be able to be made until the second half of the fiscal year.
So I think EB-2 India will remain U at least until May bulletins.
My prediction is everything remain the same. EB-3 ROW moves forward slightly in between 15 days to 60 days.
My prediction is based on the quote above and also the bulletins from Feb. 07 to Mar. 07

Webfax to push Brownback Amendment.
Latest Update - We have reached our target of 400 faxes. No need to send this fax any longer. We have turned it off now.
Friends,
The bill will be passing the Senate soon, and most likely be finalized and voted on Thursday.
Please bear in mind, that immigration voice DOES HAVE alternate ways to get the amendments into the final text of the bill if both Cornyn and Brownback's amendment are not floored and voted in this final lap of the debate. So please be patient and please have faith.
The Brownback amendment is a direct result of IV's efforts in Senate offices with QGA's help. The amendment can be read here : http://immigrationvoice.org/forum/showthread.php?t=876
In order to give one more push to this amendment, we urge you to send a webfax support Brownback Amendment. Its is under the webfax menu as webfax Number 15.
Please enter your real name,(full name) and your address, phone etc on the webfax before sending it. With a few clicks, your webfax will go to all 100 senators therby generating support for this amendment.
Thanks.
Jay.

Situation:
H1b valid until 2010, visa stamp expired.
AP available
Not recieved EAD yet
Can you we go on a cruise to Bahamas?
Also do Indian citizens need visa to Bahamas cruise?
Thanks in advance
Getting visa to go on cruise to Bahamas is not a big issue. People go in bunches to watch cricket matches when they play it in West Indies.
A travel agent will be able to answer your question.
Transit visas in Eurpoean countries is a pain and wierd rules and complex rules that very is something that gets discussed in these forums.
But, nevertheless, you may get an answer here.
Do please consider contributing now as we are running a funding drive

It certainly seems like the RFE rate for supportive evidence has increased recently. Certainly for the 140 cases but also for other petitions as well. I had never received an RFE before, but recently got 2 for different petitions. An RFE always makes you a little antsy no matter how routine it is.
We are also hearing about PERM audits higher and denials also more frequently.
So far the RFEs seem to be for the common issues, like ability to pay, education qualifications etc.
It might be a good idea for someone to compile a list of typical RFEs at various stages. The rest of us can start adding for the benefit of those who get one in the future. In fact it might have been done already. I remember Logiclife putting something together during that 485 filing time in July/Aug.

My wife and I filed AOS/EAD on July 3rd. USCIS has given us a notice date of Sep 7. I got my EAD on Sep 17th, but my wife's EAD status shows "Case pending." Anyone else whose EAD receipt date is 2 weeks old and still no EAD?

The link is broken, can you please post the corrected link?
Yes, it is not working today. It was basically a pensylvania law suite and USCIS memo. I have saved it at work, Will try to attach it on Monday.

Gurus,
July filer...
