I don't think there is any way of knowing if your case is pre-adjudicated. The only way you will come to know is if you receive an RFE or an interview appointment.
Although officially so far, USCIS has not branded an I-485 status as "pre-adjudicated", if you haven't received any RFE and/or any other negative status about your 485, and if your case is outside the processing dates of the Service Center, then obviously dude your case is pre-adjudicated. I don't understand why most of the people are ignoring this simple fact. I think we need to stop consider USCIS a mystery box, and start treating it like an organization that processes the applications in a structured way.

I don't know if IV is already doing it...but we need to meet all these lawmakers who are considering immigration reform....get the details of the bills they are proposing....see what the common benefits are...and help them to converge toward a unified bill that will help all.
A difficult task ....but it needs to be done if we have to have any hope in passing some meaningful legislation.

It is now game time!!
Two very significant legislative vehicles, namely the PACE bill and Comprehensive immigration bill are right on the corner. PACE is scheduled for discussion end of Feb, and the comprehensive Immigration bill beginning of March. In this dynamic legislative climate, it if very difficult to predict which of these potential vehicles could bear fruit, or even predict the timeframes accurately. IV�s strategy is to pursue both the bills and push for our goals to be on them.
We are in immediate need of funds for that very purpose. We are seriously low on gas right now, for the journey ahead that we are only just starting on. We have only raised $30,000 in the last 50 days; even more alarming, fund raising has gone down drastically in the last 2 weeks. At our current burn rate, we will be out of money in a month or so, just when we expect the bills to come up for discussion on the Senate floors. As you can expect and appreciate, there is a cost for achieving anything politically. IV has already demonstrated a great deal of leadership and persistence to work on retrogression relief and labor backlog elimination. Many IV members will start making trips to DC in the coming weeks to meet lawmakers at the hill. We need your help NOW!
Members that have not yet contribute money, please do so TODAY! And members that have already contributed please consider another contribution. We need all hands on deck. Also pass on the message of the immediate need of funds to your friends.

I agree, you will be competing with all the illegals. But.....
1. How likely are they to file their apps on the first allowable day that USCIS will accept the applications? Not very. Most of us know what's going on and will be ready to send in our apps first. Ofcourse if some EB based guy is pottering around instead of moving fast, thats his problem.
2. How many illegals can afford the high priced attorneys? Most of these poor guys dont know to speak, read or write english, forget about filing out USCIS forms.
3. How many illegals maintain perfect records of their time and can recreate a paper trail of the time they spent in the US. I certainly can and most legal wannabe immigrants can definitely prove the time they have been here (paystubs, utility bills, credit card statements, bank statements, etc.)
The point I am making is - this is the best option I have seen in a long time. Even the stupid point based system had its drawbacks. This is unconditional. It will get vast support from the hispanic community also. The UK has the same thing. Be on a work permit for 5 years and then you are eligible to apply for Permanent Residency. I believe there is also some clause in the UK system that states that you have to have been in the UK illegally for 10 years as against 5 years for a legal immigrant. I'm sure setting the illegal bar at 10 years and legal bar at 5 would be acceptable for most people.
If we reapply under this section, we will be competing with the massive illegal-to-AOS guys based on our Receipt date for adjudication.

Not sure why you would generalize all H1b holders as experiencing hell - I for one did not. Anyways if you take the time to browse the forums you will find the answer to your question.
Malibuguy007 , you seem to me a guy who could save 2-3000 dollars per month and think you are in heaven(Typical GULTI mentality) . These are the points on basis of which i called life of H1 hell

If it is useful, I will post each or all of these. Even, some Canadian sites have picked up issues listed in IV home page ( and probalbly spinning them to their advantage)

As i said lawyer told me that no use of MTR. We went with EB3 and now i am on EB3 train with I-140 approved. I was wondering that can i re-appeal now after 2 years .

Thanks for the reply , let me file the H1 transfer with Employer2 now in "Premium route" with the I-140 approval from Employer1 and see if we get a approval. Once i get a approval , i think stamping it wont be an issue after 7-8 months even thought Employer1 has revoked that I-140 ?
However i want to clear even if the Employer1 revokes this I-140 my PD still remains locked - right ???
This is not clear for retaining a priority date when I-140 is revoked. As per a US CIS memorandum, when I-140 is revoked for misrepresentation or fraud, person won't be able to carry the PD over. On the other hand, there are regulations that state that beneficiary would no longer be able to carry over the priority date in the event of I-140 being revoked.
Please note that the memorandum does not have the force of law.

I just got off the call from uscis regarding my I-485. My PD is in the first week of Mar 2006.
Per the USCIS website, they are suppose to process even the first week of Mar 2006 although the Aug VB says it is 01MAR06. I spoke to the second level IO and he was confident that my case would have to wait for the next month. I insisted that the uscis website says otherways, he went and verified with the third level (or his peer) and came back and told me that I was correct.
Infact told me that my case was pre-adjd and being reviewed by IO currently.
I am sure the same applies to you with the Sep VB. Good luck !!!

There is nothing in the USCIS memos to suggest that USCIS has implemented any such policy. CR you talked to may be ignorant and giving wrong info. Or it may be deliberate to reduce the number of (repeat) calls.
I would suggest recording the conversation with CRs so that we have proof of this conversation. Don't forget to ask his/her name and id number while doing this.

"You can continue the work with I765 receipt notice provided your employer is OK to continue and told me to provide the receipt notice to the employer as a proof of your application is in pending. As I am surely aware of the fact that in order to continue the work we must have an approved physical EAD. I was totally surprised and asked him "Are you sure?? can we continue the work with the receipt??", he replied "Yes and only if your employer agrees for that!"
I have no clue???? What to do, friends please share your thoughts on this.

1) Do you consider this(having filed 485) to be a better situation for yourself and your family?
2) Do you consider that IV advocacy and lobbying, flower power, media attention etc played a large role in this reversal?
3) If instead of what happened, they had instituted a policy where you could file 485 while retrogressed if you pay a $1000 extra filing fee per petition. Would you not have done it?
4) If you answered yes to all the above questions, Can you find it in you to do the honorable thing and contribute something, to say thank you.
We had atleast 320K 485 filings, if just 10% of these people contributed something, anything at all, money would not be an issue. Why is this not happening? There should simply have been a better response to the request for donations. Forget about the other guy, you just do your part, even if you did not do it before you benefited, do it after you did. Do it because it is right. Do it because, the more you do the better your chance to get further. Remember nothing invested, nothing gained.
