Hello All -
I am planning to get my PP renewed at the NY consulate and had a couple of questions and I was hoping someone could shed some light on them.
i) The DC website states that one can *only* apply 6 months before expiration date but the NY website does not? Mine is going to expire in ~8 months. Anyone know if it is 6 mo across all consulates?
ii) They have it in big red font that the photograph should be 3.5 cm * 3.5 cm, the US standard PP size is 50 mm * 50 mm .. any ideas where I can get them done in the right dimension?
iii) If applied in person do they issue the PP the same evening?

i think that you should have minimum six months left for expiry anything less than that leads to more processing time thats what i was told at SFO when i renewed in 2001 and was told the same when my wife renewed at Wash DC in 2006. I think they take a day to process means if u give today u will get next day . Same day are are cases thats my first hand and second hand expierences

Exactly....I don't say this a trick by USCIS to divert our attention but that will definitely be the result. Everyone here (except with the older priority dates) will face retrogression very soon. Please try to understand this folks.
Everyone will file for 485 and will get stuck in the backlog, before you know if, it will be Oct-08 and then they will scrap the old system and make everybody file under the point system. Which of course would be a nightmare as the USCIS or one of its derivatives would not be able to cope with the flood of application. At the end of the day all of us would be 1000s of dollar down and would still be posting here complaining about the process.
Bottom line is, with a limit of 20 amendments, one can be assured there won't be one looking out for us out on the fringes.

Right now we don't have any savings, paid off the car as of Oct 30th. I was trying to figure about the money which we are going to save from here on...I will take all your advice, sounds so logical and keep the emergency fund for 6 months aside.
Coming to the city we live, it's a small place in Florida and not many employment opputunities for techie people. Like I said I am working for state while my spouse is consulting and travels every week (can't find a job in his area). We never imagined a management change leading to a risky and frustrating job situation, making us to repent our buying a house. Because the moment I stop impressing this new boss, we are out. Huh...I don't want to imagine that, because we will be left with a house we can't sell or rent (don't know if some one would want to rent it) and have to move.

Yes, you can. If it is with the same employer, you are OK., else there can be problems such as below.
if 180 days have passed since your 485 RD and and if you plan to use it with a different employer then any RFE raised for your 140 will not be answered by your old employer and your 140 will be denied.
if 180 days have not passed, your employer will revoke the 140 and you are in the limbo.
The best course is to wait 180 days from 485 RD and have an approved 140 before venturing out.
Please let me know Can we use EAD with out I140 Approval.

Sorry for not mentioning in my first post earlier... Just now I received a copy of the Letter which my company received from the USCIS. It is mentioned as "NOTICE OF INTENT TO DENY (NOID)".
Reasons:
- Section 203(b)(2)(A) of the Act states
- 8 C.F.R 204.5(I)(3)(ii)(C)
These are related to the Education for 3 yrs degree..
- What is the next step ?
- What is the chance of a positive result?

Recently Vermont center processing time for H-1B extensions moved to Oct-1-2007. As per new USCIS reporting method of processing times, what this means is, they have COMPLETED processing applications received as of Oct-1-2007. This means, people who have applied for extension after Oct-1st should be getting their approvals these days.
I want to find out which dates currently they are at based on your feedback of your application date and whether you received approval or not as of today.
My case: Applied Oct-30-2007 Status: Pending

My i 140 is denied on A2P issues.Ive filed MTR.Any one knows how long it takes to hear back from them on MTR.anf if MTR gets denied can i file new 140 using same old labour ?some one help please >>>
I got my I140 approved just today!!. It was pending since Oct 2006. And then they denied it in March 2008. After filing MTR it took a month to get it approved.

my employment is terminated a month ago. I still need to file h1 transfer to the GC sponser. I am single
I am told that H1 can be transferred only with in 10 days-20 days or so. which means that it is already a month. so in case if I dont get the h1 or if I have an issue in the H1 transfer, is that the end of my being H1.
If I were to be on H1 again is it going to come under the cap along with those new H1 filers? I still have one and half years to complete 6 years.
I have a fall back to EAD though based an approved 140 and 180 days past 485.
But how do I get the spouse then???

There are some places, where employee is kept out of the loop and is being exploited. USCIS is the only body which can help in this. It should send copies of all the transactions it makes with either attorney or the employer. that way the employer/ attorney doesn't get a chance to exploit the employee.
While we can seek IV's help in this for future, what options do we have NOW if we are caught in this situation? Is there any expert on this out here? Can we use a copy of the FP notice instead of the receipt notice. The FP notice has all the information like Name, Case#, RD, ND etc..

Even with 40 credits it is not possible for Indian nationals to get SS payments in India. If you look at the rules closely on the SSA website, there is no simple way to get benefits paid in India unless you are a US Citizen. You must be present in the US for that
