I would support this bill since it makes a lot of sense. I am not going to benefit from this since I have masters and not PhD but people who have sacrificed the lure of big money to live on campus with 2-3 roomies for almost 5 years in which time their friends who graduated are driving lexus and staying in 5 Br homes need some consolation prize. This is a great move for these students as well as the country.
While I definitely support this bill, I fail to understand your logic here. They definitely are bright candidates but they did everything by choice for the personal and professional gain. They should be given GC because they are asset to this country not because they don't own lexus or 5 Br house which by the way tells a lot about other hardworking people who own them.

No is the correct answer.. they are here as visitors (not residents - US tax returns are for US residents - tax return 101)

Those who pass a "substantial presence" test in the US can be claimed as dependents if they do not have significant income in another country, and are not claimed as dependents by anyone else. IRS will take your tax dollars whether you have a SSN or not ;-) That's why they issue Individual Tax Identification Numbers. Dependent visa holders use the ITIN to uniquely identify themselves in tax filings.

I can not convince my self about one would not get job forever. Few of my friends struggled for jobs for about six to ten months but then they actually got good jobs and that is even in industrail engineering area with indian experience.

Some of our friends perhaps had to look for a job longer, but some are even with the same comp for years and years, just reg 9-5 IT job, one guy is Sys admin, the other is programmer. I know it sounds unbelievable but no one complains about workload, having to sacrifice qaulity time with their familes, paying too much in taxes or car insuarance or similar. Moreover, they can afford to have vacation twice a year and they all have families, purchuased real estate and the likes.
In fact, in my home-country, coming to the US on H1 visa and then getting EB green card is literary unheard off. Very very few souls came via that route and not all succedded in getting their GC

I am primary applicant on our 485 application. Mine and my daughters case doesn't show any LUD. But my husband's status changed to case transferred to local USCIS office. He was on H4 for 6 years and have not used EAD yet. No gaps in Visas. no law violatiobns. Prerry Straight forward case. Recently we applied for Online EAD Renewal.
Any idea why his case might have got transferred ? What should we expect next?

Lot of people do not know what they are gettng into, a lot of new H1b applicants go look for employers promising Green Card carrots and switch jobs only to find out at a very later stage that they are retrogressed. Same with sub labor, lot of people switch companies as they get sub labor, just to find out later they cannot apply 485 due to retrogression.
A lot of people still don't know what kind of mess they are in. I tried explaining this to a lot fo people who do not understand, and they never made an attempt to understand, thats the reason why IV still has only several thousands members where those affected by retro is in lacs.
My only advice to you is "think positive", "put a lot of effort in your skill and job", "stay put with latest news", "Help IV" and be careful with employers or lawyers or body shoppers

I doubt that there is any "transfer tax". As long as you have filed your income tax return that showed the source of that "saving" (good job there), you have already paid taxes on it. Also, your parent don't have to pay any tax on it since there can be no double taxation of the said money.

Before Nebraska service center retrogressed their processing dates I was able to speak with an IO. I asked her a few questions relevant to this.
There maybe a public USCIS rule / procedures that would confirm what she told me.
Q) When is the name check typically initiated
A> Soon after receipt
Q> Is my name check cleared.
A> wait a moment..... yes
I've also explained why Nebraska processing dates moved back...
1) Transfers from Texas
2) VB moving forward coupled with no pre-adjudication. Therefore they have to go back to older receipt dates.
3) 180 day name check rule taking effect -- clean up old cases.
4) Public processing date was internally known to be too far ahead of reality (and therefore causing service requests).
Now could USCIS hide behind name check now?
Probably not for more than 180 days, because you could file a WOM and win.
Can they stagnate processing dates --- yes, and there is a risk that they will around 2nd July 2007 date (last year's fiasco -- if I need remind anyone). That would make me barking mad since my receipt date is about 59 days before that.
A WOM will likely succeed when an individual is arbitrarily processed more slowly, and now name check is not an excuse. However, a WOM is much less likely to succeed when a whole group is processed slowly, since USCIS can always claim resource constraints. The happened with labor cert and BECs, the case(s) that I read the judge basically said to speed up one application would slow down another. So you need to show that you are behind the reasonable processing times with respect to others, then you can force USCIS's hand.

Unfortunately Nebraska center is closed at this time, so I got transferred to the national service center and possibly to a level 1 case handler. Everything will be alright. It happened to me the same way .I just submitted an experience letter from one of my colleague who is still employed with my previous employer. My 140 was approved as soon as they received the documents.
I hope you have progressive experience (it means, growth within the company, as you gain years of experience). This is essential. Other than that, you should be good.

What you are advising her/him to do is lie to USCIS that he/she is sick when she is not. This is on the same lines as doing what those guys behind bars did, brining people on H-1B from India to the US without actually having a job for them.
Again, its people like you that is giving genuine legal immigrants a bad name, and putting us all (including yourself) in the LONG immigration queue!
I see that you have written letters and participated in other campaigns. None of those will materialize if you're teaching others to missuse the H-1B system. How hard is it for you to understand that these are the kinds of loopholes because of which we are stuck with no visa numbers?
Get a letter from your employer saying they are granting you a personal unpaid vacation as per your request(which can be done using a pre-dated letter to them). Make sure you are getting your medical coverage from them(if you have it through them). Provide that and an explanation that you are taking personal time off due to health etc/stress. Hopefully that flies with the USCIS.

I recently added pages to my passport in India while I was in Vaccation. It was painless process as I went through travel agent and have to pay extra money. No police verification is required if your renewing. Adding pages/renewal is all the same process.
If you apply in Tatkal, you will get your passport in a week. If you do in India, I advice you go through some travel agent.
Did not renew here as my job requires frequent travel at short notice.
If you are not travelling internationally then it is best to do it USA.
