Mr. Vayalar Ravi , Minister of Overseas Indian Affairs,is coming to USA on June 27,2006. He is coming to Washington DC on July 4 to meet Indian Ambassador and Indian community. We should try to meet him personally and explain the problems we are facing. He can talk to US counterparts and do something for us.
Let us organize an event to meet him on July 4. Since It is a holiday, lot of people can meet him and chat with him.
Any comments from IV Core Team ? Can we contact the Indian Ambassador to arrange a meeting with the minister ? is it possible ?
This is a Golden opportunity !
First of all what you want honorable Minister to do. Ask him to talk to US Congress to pass the law so that we get GC faster. Let say he speaks on our behalf. All I see happening is things getting worse rather than getting better. Those who are on the other side of the table will get a point to oppose to those who are supporting us. This is what going to happen. Every provision that is supporting our cause will be opposed by the fact that it has been done under the influence of foreign Government in this case it will be Indian. Organizations like numberusa is vehemently looking for a way to prove that how all pro-immigration provisions are anti-american. So we hand over them the Jackpot.
Whole idea of involving Indian Minister looks to me like small kids involved in a fight seeking help of their parents to get the issues fixed. Here we are not dealing with neighbors kid. Lets grow up..

Hi fundo14,
I saw you post regarding the case being transffered to Des Moines Iowa. My case has the exact same update as of March 19 2008. Its been like that since then. Yesterday, I spoke with an IO from NSC and she told me that my case is picked up for Extended processing. I am not sure what it means!!! I have applied for my EAD and AP renewals and asked her about the status of those in light of the pending additional processing of my I485. She told me that my EAD and AP renewals also would be held up until the additional processing is completed. On pushing again, she told me that in case my EAD is due for more than 90 days, i would have to walkin to a local center and get an interim EAD. I am inferring that it may be a pending interview call. My attroney also said the same thing. I dont have any criminal background, didnot do anything illegal in terms of immigration like being out of status or on bench.. So my best guess would be that its a pending interview. I had taken a infopass appnt last month and the officer in my local office also told me that my ead and ap renewal would not be approved until additional inquiry is completed. I am quite concerned and confused from last month as to what is wrong with my application to warrant a refusal of my EAD.
Lately, I have been observing several people have their cases transferred to Des Moines Iowa and interestingly around the 19th of the month. I am guessing USCIS moves cases around the 19th to the local offices
People plz share ur thoughts..
It just means that your case will be now processed at a local office. I mean to ask if Des M office the closest USCIS office to you? There is a good chance of interview here......its random so dont worry about it. When USCIS will call you for interview they will send a list of what to bring and you can search on IV for a post where I had mentioned what kind of questions USCIS officer asks. Hope this helps.

Compile a list of famous immigrants like Albert Einstien, Madelene Albright, Henry Kissinger. Add to that the list of doctors, scientists who were immigrants and benefited mankind. Change the mental image of the immigrant as a low wage seeking, will work for food worker.
Bring out the other side of the story. Let Lou Dobbs fight history and deny it.
Add Gov.Arnold Schwazenegger, Senator Mel Martinez, Gen.John M.Shalikashvili (former chairman of the Joint Chiefs), Gov.Jennifer Granholm, Late Peter Jennings, Commerce Secretary Carlos Gutierrez, Labor Secretary Elaine Chao

Hmm...let me guess. Well, I had same issues with my current lawyer who is a official corporate attorney for immigration matters with my employer. Good part is, I didn't have to pay money to him but bad part is he is mostly not-responsive, arrogant, treated us like slaves, rude and what not. He doesn't answer anything about AC21 and we have to go thru' HR if we have any questions. Many a times, employees are completely unaware what is going on with their immigration papers. I did not receive my LC or copy of I-140. Guess this differs from person to person and company to company.
well, now since I have decided to enjoy freedom using AC21, I would like a good lawyer to represent my case; whom I should be able to ask questions.

rbharol,
Dude thats why we started this topic. To see feasibility of living in Canada but working in US. Windsor/Detroit are the 2 cities closest to each other across US/Canada border.
If you can get job in detroit area you can do this. You wont pay any more tax than you would have made with same income in canada.

The coming back of CIR seems imminent - we need to step up lobbying/calling/faxing/writing. Is IV still have the lobbying firm support? do they have any specific suggestions so EB friendly amendments will be introduced/succeed.
With dates being current I think everyone will say - hey employment based system does not have backlogs why increase their numbers. This priority date movement is so complex its easy to mislead anyone.

I know some people think that we should not spend too much time on Lou Dobbs but to not protest his inaccuracies is to allow him to manipulate public opinion against us. It seems like his latest enemy is the "indian immigrant".
Some of you may have seen his interview of Senator Tancredo who suggested that there were about 700,000 immigrants that had come to the US legally on H1B visas and had overstayed illegally. Mr Dobbs of course did not question these numbers and facts and there has been no subsequent supporting information to back up such claims that negatively affect the perception of legal immigrants to the US.
Meanwhile Michale Moore has stated on his website that they "are now going to start looking into the veracity of other reports you have aired on other topics. Nothing you say now can be believed. In 2002, the New York Times busted you for bringing celebrities on your shows and not telling your viewers they were paid spokespeople for the pharmaceutical companies. You promised never to do it again. But there you were, in 2005, talking to Joe Theismann, on air, as he pushed some drug company-sponsored website on prostate health. You said nothing about about his affiliation with GlaxoSmithKline.
Clearly, no one is keeping you honest, so I guess I'm going to have to do that job, too"
Question for IV leadership - should we as a community should inform Michael Moore of Lou Dobbs inaccuracies when we find any?
Thank You

Looks like you got angry.Everybody knows H1 requirements as much as you do.Do you think are the only one who is smart in this world.I don't think so.
Thanks for sharing your "2 cents" opinion. I understand this is coming from a person who used the term slave for his H-1 job condition.
You haven't answer me the question"What if your H1 is denied once you started working with out its approval" which I replied in your first post.
If H-1B is denied, then you are out of luck. For that reason, I have mentioned that file H-1B premium, and join the new job after H-1B approval and you will have "peace of mind" in that case.
Also you have replied me that H1B is not for speculative job.If it is true then what is the need of H1 Change of employer. Can you inform USCIS to remove this option.
Read for yourself and get en-lighted.

...to ensure that alien beneficiaries accorded H status have an actual job offer and are not coming to the United States for speculative employment.
When your H1 got approved first time the same USCIS verified your Educational certificates. Why they want to do the same verification again and again?
It is more than just educational qualification. The job has to be specialty occupation and employer has to define job duties in detail. Each H-1B petition is treated independently.
I advice you to read [dot com] articles which sometimes point out that USCIS document were not clear
Lawyers are entitled to opinion as well, just like anybody else. After all they are running business. FYI, I am not on visa anymore.

I have asked same question to the lawyer and here is his reply:
-------------------------------------------------------------------------------------------
To be able to do EB-2, you will need to have, in addition to your 3-year bachelor's degree, at least another 3-year degree or a 2-year master's degree.
If your post-graduate diploma is 3-year, you may be able to make the case for EB-2 if you can show equivalency to master's degree. One-year PGD would not be sufficient for EB-2.

Thank you for your advice. My last M.Sc. and Ph.D. is from the USA. My Ph.D. is about manufacturing of aircraft brakes with Honeywell.
EB1-B or EB-2 is more suitable for me?
what bothers me is that I am not cited in the literature yet and I do not have awards.
Thanks,
John
Your situation is slightly different than many I have come across. If your qualifications, research work, project etc have unique qualities, then you may still have a fighting chance. But you may have to do a lot of homework: find out NIW holders in your / related engg field, ask a few lawyers: do not believe right away if somebody promises they could, try to enroll in as many professional associations as possible, enlarge your skill portfolio etc.
BTW, is any degree of you from US?

Yes, it is all luck with this kind of stupid process they follow.
If some one in India talks about this stupidity before we come here will be nice I guess as once we come here with lot of ambitions and aspirations without knowing internals of stupidy we all get stuck, neither there nor here and keep waiting for GC dream to come true.
There is no logic for this process.

can someone explain it again in simpler terms ..does the above mean that if a 485 is pending then that person is not out of status (or unlawful presence) till a decision is made on the pending 485 ?
if you re-enter the US on an AP, they give you an I-94 with teh same date of expiry as your AP expiry (within 1 year). AILA was wondering if USCIS could come out with a memo clarifying that essentially that I-94 has no meaning, if you are in the US after it expires, you are still within status (because you have a 485 pending, and that gives you status until the decision is made on it)

It's all about money my friends. Legal are already paying taxes. What they want is all these 12 million people to pay taxes too. Once these ppl come forward and apply for legal visa they will be backloged and will keep paying fees and taxes. After 20 years another cycle.
Nothing is going to happen for legal. All efforts r waste.
