According to BCIS (spoke to them yesterday), the Schedule A apps filed before retrogression will keep getting processed, because they were filed when Schedule A was current.
I take this with a pinch of salt. Can anyone who filed 140/485 last year before retrogression hit EB 2, please post your experience? Have 485s after 2003 been approved?

I filed My concurrent I-140 and I-485 in Schedule A Group-II , EB-2, Exceptional Ability in Arts and Sciences Application with USCIS recipt date of AUGUST 24, 2006 for both I-140 and I-485?
(1) My I-140 is yet not approved I had asked my attorney to do premium processing. In this new situation should I go for premium processing or hold it back as they will not process my I-485 due to un availability of numbers in Schedule A.
(2)With current retrogession in Schedule A in November visa bulletin What will happen to my I-140 and I-485 processing.
(3)If Schedule A categorey ends after 10/5/2005 as indicated in November visa bulletin what will happen to CASES like mine which were filed after that? does they get transfered to EB-2 ( or EB-3) with their filing dates, set as priority date?
(4) Does establishment of date of 10/5/2005 in NOVEMBER visa bulletin means that they will still process application that they accepted till this NOVEMBER-2006 .
Your experienced help is Gretaly appreciated in this developing situation.

I have to agree with you on this. Its not like Bollywood did not make movies before Danny Boyle made one about slums and poverty in India. There were so many good movies made by Indians with not a single white or foreign contribution, but never even released outside of India. It took a white man to come and show the world the poverty stricken children of India that the world stood up and took notice.
My hope is that things will change now. Just as the world has realized the technical talent Indians have in IT and Business, my hope is that they realize that we have others talents too!

AC21 can be as safe as a any normal 485 case so do not worry. Its classic case of USCIS ignorance on AC21. I would say, hire a good lawyer and prepare for a MTR. I have seen Ron Gotcher as a very prominent proponent of AC21 rules. You can take his help. I used AC21 and got GC approved without any hiccups. My case was handled by Ron and I have been completely satisfied with his services.
PS: I am not affiliated to Ron in any way. This is my personal experience.

There are way too many problems infront of Fed Chairman.
1) Asking people not to walk out of homes and pay up their loans
2) Making the wall street firms like Lehmen, bear sterns run their businesses as usual.
3) Contain the inflation so that long term interest rates are lowered.
4) Come out clean if the US policy is shifting towards Weak dollar or going back to string dollar policy. Either way US and world over have to face gyrations in near term.
There is blood on everybody's hands for the mess we are in.
1) Japan for too long provided the world with cheap loans (~1%).
This money not only found its way to corprate India but also into US
Housing markets.
2) Americans spent money much much more they earn or worthy off.
3) Globalization created another affect (Read Alan greenspan's 'economic conundrum' theory). Google it, you will find plenty of articles.
4) China for too long manipulated their currency and provided the world cheap goods.

Now my incorrect answer for the time being: Go to India and do shoplifting. You will get instant punishment. No court hassles etc. Get beaten up , cough up money to the cops and then come back. Your experience in India and USA will help you learn more. I feel the punishments in US are not harsh enough. If you have a bad habit of shoplifting and you used to do it in India then ignore the answer above and check into a rehab and request them to have you share a room with Winona Ryder.You both have something in common and you will be able to relate to each other very well.

She will continue on H4 status until she uses EAD (by filing I-9 with an employer when she starts working). At that point, her H4 is automatically invalid and she is then on EAD. Until then she can be on H4. Same rule applies to H1.
Thanks this is useful information. Also I am planning to continue in my H1 status as per company policy they allow EAD/AP only for spouse and not the employee. In future, will I be able to file EAD/AP for myself separately or does this need to be done with 485 filing? No offense to anybody from Canada. I am simply trying to illustrate the rationale about the GREATEST IDEA OF THE CENTURY, THE SILVER BULLET, THE FINAL FRONTIER TO ALL IMMIGRATION PROBLEMS - "point based system"!!!!! Oh really???
As such, Canada does not really have as many jobs as in US. Offcourse it is a fact that PhD and Doctors drive cabs in Canada because they can't find jobs, but someone who is not a US citizen finds a good job in USA because it is simply the land of opportunities.
I am not saying points system is the best, but opportunities play an important role and thats why US has so many jobs compared to other countries, though so many jobs are outsourced. There is always growing demand and the economy is huge and accomodative.
Canada on the other hand is still slow to add jobs it the pace America does because of the lack of infrastructure (As I have not been in Canada, I don't have much information on how things work, but I know for sure that getting jobs is very difficult)
We must have a seperate thread on merits and demerits of points based system over the existing system and the issues being faced in countries like Canada etc..

Your good fight on the retrogression issue kind of kept us going without giving up. In just a few days what some of you have done with www.immigrationvoice.org is amazing and it truly deserves a lot better than the faint response they have got so far from all of us in this legal black hole. Honestly, I do not care if we are not able to raise 100K dollars for the lobbying efforts for the next immigration bill on February. I don not care if this money is finally lost. It will be money well spent if we all realize that we have to do something instead of waiting years and years and years� Any money is worth the effort regarding our goals, even if our present intention does not succeed. Is worth it!!. Lets move on, hoping for the best� It is worth to try this next immigration bill. Any money spent on this is worth it� Can not you guys see it? More and more years on this black hole!! Dates for Eb2 india will touch early 2005. And dates will not move back from that point for rest of year. Of course it will move forward again in Aug 2009 bulletin.

Although I paid $1276 last year, my balance was $476 after 25.2 % return on funds. whole life has surrender charges apart from hefty financial charges ,so you can not withdraw when you want.
