We are in exact same scenario, but was thinking that H4 holder has to enter using AP to continue to use EAD after "vacation" . So is it like, Use H4 for travel and EAD to work, instead of , Use AP for travel and EAD to work? This will be of great help to many people who are scared to use AP or not want to face the extra half hour at immigration counters.

mhathi's listing of unknowns is right it makes the analysis not useful. More importantly there is a 6 month missing period in the FY2005 data from Oct 2004 to Mar 2005. I have been searching for this as my case was filed in this period. The FLC data is maintained by some guy in Utah whom I emailed. He got back and said that data is not available as Backlog reduction centers were being setup and they havent entered those 6 months into the dataset. I expect that there was a surge in applications in those 6 months before PERM came into existance. So without that data the analysis is pointless.

Yes, this is not falling in place with their processing dates. But i think, you should be getting your approval any time. May be, have your attorney contact Vermont center for inquiry. Or you can call the customer service directly.

I was not bragging. I was just thinking out aloud, so to speak. Economic ups and downs like this this are a normal part of economic cycles in a capitalist economy. My observation is that IT industry is not as badly affected as other sectors. I have not seen people sitting without jobs for extended periods. I mean, some people do loose jobs but they get something else within a couple of weeks. That is pretty much normal functioning of markets.

Congress is trying to pardon 12 million illegals as a one time measure and give them Green Cards. (OK - Very good)
On the other hand we are about half a million who entered the country legally and helping the U.S. economy and paying taxes. Why don't they consider giving all of us Green Cards as a one time measure too ?????

Who gets FP notice? is it attorney or us?
We also filed on July 2nd at NSC.. got EAD and AP. buit no sign of FP yet. we were also out of country for last 3- 4 weeks. Is there chance we could have missed it?

Ok my last attempt to convey my thoughts:
If your H1B is approved and you are granted an extension it only means that your application was approvalble at the time of filling. Now in order to maintain H1B status you should have:
1. Job with that employer who sponsored H1B
2. Income as dictated in LCA
3. Other condition such as NO DUI etc
Now what if one of the condition in the list above is:
4. Your I-140 on which the extension is granted should NOT be revoked.
I know this is not spelled out clearly, becasue in the past no one took this avenue. Now with premium processing everyone wants to do a quick PERM + 140 to get 3 more years on H1B. It is important that USCIS should clarify their stand on it, one way or the other. In fact if any of the service center sets a precedence by simply implying that one's H1B is invald after I-140 is revoked the interpretation will be cleared. Unfortunately it hasn't happend yet or I we are not aware of it. I hope they clarify it sooner than later.
That's why you have to be quick...Before your earlier employer revokes the petition...(that takes some time..) you got to get a new labor and a new approved I-140 and after that they cannot throw us out technically...
The whole thing is a mess..

I now applied for EAD for my wife (not because she is going to work, just go get SSN). I do plan to get SSN for her and then file amended 2008 return. I wonder if I will get stimulas package then (the one which was given in 2008)?

I am sorry to hear ur situation, but can you tell us more? Like why should someone get a RFE for h1b extension??? I got my h1b extension last year for 3 years without any hasstles and also got stamping, offcourse I provided all tax documents and paystubs (latest) for the H1b extension.

I do not know of the SanDiego breakers 10k. I will look it up in runners world. 10K's should be lot of fun. I will support you if you take the lead with this. I can get my workout buddies and my family to participate in these events with me. I was thinking of signing up for the SanDiego rock and roll half marathon in summer but it would be brutal to run 13.1 miles in SanDiego in May. I am going to be signing up for the Nike Women Half Marathon in SanFrancisco this year as well. Count me in to support with this event, getting people to participate, fundraising etc. Some of my friends are certified fitness trainers and they teach in fitness clubs around OC. We could use their help for sure.
