No, there is old Child Protection Act and it protects from aging out while I-140 is in process. So child age is determined as age on time of filing I-485 (that means that visa is immediately available) minus time that I-140 was pending with USCIS.

I had my I140 approved too and had mentioned it in my application. They dont bother you. They however gave me 221g to verify student status and delayed my visa for two weeks. Interview was less than 2 mins and the vo said she had to verify student status thats it.
What is that? Never heard of that before. Do I have to take anymore documants with me for this?

what option you used to call? my case is similar. but both labor is mine(one stuck due to auto remand). I want to know if interfile is automatic or not? I am candidate for layoff this month end after 7 years of job in company. I also want to call to USCIS know.

dpp: did you open a SR or contact USCIS that you think might have expedited your FP? Also, what was the timeline of your case Xfr from CSC back to NSC? Also, is your FP scheduled at an ASC in CA Bay area? Pleasr provide more information.
I am July 2 filer, ASC in Bay Area. My case was receipted at CSC with ND Sep 6. It was then transferred and received by NSC on Sep 21.
I then opened a service request for FP on Oct 2. On Oct 22, NSC responded that case is waiting for biometrics at local ASC. I then lost all my patience and on Nov 6 shot off a mail to ombudsman, Prakash , highlighting my details.

If receipt date is the issue then I won't have been approved either and nor would hundreds of my friends and colleagues who have got approved having receipt dates after me. Also our receipt date is July 23rd 2007 as is in the receipt notice from TSC and TSC is currently processing Mid -August. So TSC is not even looking at her case and just sending you a standard reply. This is the same reply that I received on opening a service request at TSC, I had hopes that they would treat inquiry from Congressman's office with more due diligence.
All I need to know is what is holding her approval and if anything we can do to fix. I have got that" to wait 90 day' reply last year also. Let's see what they have to tell about the FP/Biometrics.
Problem is I can't even leave the country without the green card now that I am approved but god knows when I will get that...All my colleagues at work have got their physical cards for their entire family in mail and that's what hurting me about the inconsistency of the way they treat applications.

Going to Initial Review after approval is scary but normal when you get done FP after approval. I think if you have the I-797 approval then there is nothing to worry about. If you follow a thread in tracki*t you will know that couple of people also got similar status change after FP.

It takes one week to get the visa stamped. I did it and went to India in August. They will schedule FP for you in a location close to you.

I came back via Frankfurt last month. AP no prob. But be aware of Lufthansa. It was worst trip of my life. Bugger airline had cancelled flight from FRA to Mumbai without notifying. They gave me two options after I landed at FRA. 1. Wait at airport for 27 HOURS for next days flight (as they don't give Indians visa @ airport for hotel stay) or 2. Wait for another 6 hours at airport, then take flight from FRA to zurich, wait at zurich for 3 hrs, then zurich to Dubai, wait at dubai for 3 hrs and then dubai to Mumbai. Unwillingly I had to accept 2nd option.
Staff is damn rude, had to wait in long line for 3 hours to talk to cust service.

Patience is not just a virtue but a way of life for thousands of Legal immigrants who have been living in the US for a number of years . Besides the everyday stress of Job,Mortgage,Health and education of their children they live with the added suspense of when their application for permanent residency ,commonly
referred as "Green card" will move ahead from its deep slumber.
To apply for a employment based "Green Card" , a employed worker's company needs to fulfill the
requirements of the DOS/USCIS and the date the application is received by the department is referred to as the "priority Date". A movement of a month keeps the hopes and spirits high of the applicants and their families and a couple of months is sheer joy. In 2004 there was a negative trend of retrogression of
the applications in queue and the dates moved back instead of moving front. It implied a waiting period of a couple of years at the minimum. So midway of the application process everything stalled, all eyes turned towards the senate and the house hoping they would mediate and provide respite to this broken situation. Nothing happened and so we waited for the much anticipated CIR as it was told to us that a comprehensive immigration reform will address the situation of the legal immigrants also besides its main agenda to solve the issue of illegal immigrants in this country.
The CIR died , then mid June the USCIS came up with a bulletin announcing that it will start accepting applications for adjustment of status for all employment based applicants and their dependents ..From then on it was a scramble to fulfill a long list of requirements to be able to apply on time. The first task was
for my husband to convince his HR to sponsor the process. Since they had already budgeted for the fiscal year and are on a spending freeze , it took a lot of convincing . The HR complied and gratefully we set out to get our Medical exams(at own cost of 150*2).Since we live in a small state with few doctors we
drove 2 hours to a neighboring state to get them on time. Being a mother of 3 small kids, I could not work on important paper works with them around. So after putting them to bed we spent the entire night pulling out the required documents from archives and placing them in order; numerous phone calls to parents
back in India to collect their date of birth, place of birth information and completed the questionnaire. Got passport pictures(60$) and mailed it all to our lawyers praying it will be one of the first to reach the department office on start of business on July 2nd..little did we suspect that this was nothing but adding insult to the injury plan by the honorable DOS.. They had already prepared a rude
shock when they released a bulletin update on July 2nd stating that they will not accept any applications as they had already allocated all the visas for the current fiscal year in a unprecedented action.
This has left thousand of families like us confused, saddened and in the middle of nowhere.
We are raising families here, our everyday life is no different from any other AMERICAN middle class family with same expectations and hopes, so its not easy to presume that we can pull out or get out of this situation and return to our home countries . We still have faith in the constitution and the spirit of this country and preserve faith that this wrongdoing will be reversed and we will get the opportunity to achieve what we have waited for years in a long queue, abiding by the law and fulfilling all requirements to the

Please help me. There is no LUD on my status online. I had my finger printing done on sept 19. CODE 3. For both my husband and me!! I don't see any updates on the status online. Can someone tell me what I should do? FBI says they sent the prints the same day!!!!

compares all combinations of your name
against FBI national namecheck program database
(86 million records).
This one comes back faster (they say less

no hits , but if there is some hit ....then
human person needs to clear all hits by requesting
copy of the paper documents from any /all
of the 250 FBI offices across USA . So this
is time consuming process and some of us have
been waiting for over one year , two years , three
years etc.
the LUD thing has no significance. you cannot
interpret much from lud and it causes
unnecessary anxiety . some people don't get any
luds from receipt date until approval.
try a service request first to find out if your
namecheck is pending .if you get a letter saying
"processing of your 485 is delayed because
investigation into your background remains open"
or something like that , then it means the namecheck
could be pending !

How do we know if you have 40 credits?

It is very simple calculation.
Every year if you earn more that certain amount it becomes four credit. I don't know current amount, but it used to be very low between $5000 and 6000 per year. Usually people in computer industry might be earning 4 credits in first month (Jan) itself.
You can't get more than 4 credit in a year. It takes 10 years to accumulate 40 credit (basically it become 10 tax returns).
Low wage people earning less than $5000-6000 per year take more than 10 years to accumulate 40 credit.
Also this 40 credit need not be contineous.
F1 students and on OPT usually don't pay Social Security Taxes and so don't earn tax credit points.
