Not much good news for EB2 and EB3 India. I hope folks realize and do the lobby day seriously.
Here is the timeline for folks that are not serious
EB2 India: Waiting for July - October spillovers thinking that most EB2 will be current. The prediction threads have hyped this a lot. Many will benefit this year. But many will miss this bus too. Some from those who will miss this bus, would be back wanting to do something in Nov - May timeframe. Others will waste their time on predictions and trackers and make those site owners rich.
EB3 India: Many who filed in July 2007 are still happy with EAD status. They worry and contact IV only if their I140 is revoked, I485 denied or if EAD renewal is delayed. Some still sulk or want to blame someone (even IV) for their delays. Those who have not filed I485 yet are few in number. Many new Eb3s still do not know the extent of the backlogs. With time they will slowly learn about the backlogs and wait times. When they suffer due to lack of EAD, they will all make noise on IV asking for some action. This is the reason why the I485 filing action item thread is still weak and pre-mature. I would give another 2 years for the non-I485 folks to have retrogression sink in.
Retrogression is not going away. If it goes away, only applicants will benefit from it. And these applicants are too weak and small in number to even raise their voice. So why would anyone pass a law to make these people happy that do not even want any law changed. After 2 years all the folks who are not participating in advocacy days and contributing, will contribute to IV. At that time, if we in core are still around, would rather ask them to lead the effort if they can and if they are really serious. The current advocacy day campaign and contributions are a measure of seriousness for us to plan our next agenda items.

PD - July-2004. Pre-Adjudicated.
How did you know that your case was assigned to an officer. I called uscis three times and I was told that they could not say if my case was assigned to an officer or not.

A# is assigned during I-140 approval process. Unless you get an approved I-140 from your employer it is difficult to get the A#. BTW, I didnt knew my A# so I just left that field blank and sent I-140 Tracking number instead.

Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

I hope 180 days had passed after 140 approval. A little more detail on the case will be appreciated. Was it a case of substituted labor?
First try to figure out what the previous company has done.
Get the help of your attorney ASAP. Figure out if there is a way to undo the damage.
I am not very sure of the details, a person I used to know was forced to join his previous company because they threatened him in similar lines.
& please do keep us informed along the way. We may be able to be of assistance to you in some way or the other. Local IV chapters have access to local Congressmen etc.
If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

So the question still remains. Which is better school for MS with a little lesser load on the pocket.
I wonder why every dicussion has to take a E2 vs E3, regional discrimination and other such things. Can't we have a proper engaging, fruitful discussion on any topic. Learn to respect and appreciate others. In God's scheme of things nobody is greater or smaller.

Looking at the Labor cert , it says "Masters degree" and NOT "Masters or equalent". that might be the caused the I140 denial .
Any one had this situation before ?

I am planning to send a letter to President, First Lady, DOS chief besides other Govt. rep. Anyone has the addresses?
I am in CP and I am writing to them to allow CP filers who are already working here in the US to file for AOS (even if the PD is not current) anticipating a very long delay for EB3 I. That way we could get atleast the minimal benefits like EAD, AP.
If any CP filers from EB3 I wanna join me, more than welcome!

65 pending cases for 2004 here. Even if we multiply by 10 - 650 cases?. Fair deal?
I have also been wondering how to extrapolate this to total numbers. Its probably a good reprsentation of spread. (ie. 1% is 2003 and earlier, 20% are in 2004). but actual numbers???

I don't think any analysis is done. That is only going to divide the community.
Some would say preference be given to EB category benefiting EB2(I&C).
Some would say PD should be given preference predominantly benefiting EB3(I).
If they follow the current spill-over rules, as you are aware, EB category would be given preference.

I myself don't quite understand how exactly education and years of experience are translated into years of SVP. When on my PERM I had MS +5 years of experience required, they said on the denial notice: "The total time time for education, training, and experience entered on Form ETA 9089 equals 5". Which exceeds maximum of 4 years for level 7 (zone IV) and that's why they denied it (again, despite I didn't claim that that the requirements are "normal"). Apparently this 5 is not just experience years, nor just years of education. Does somebody understand how exactly the SVP time is calculated from degree and experience?

There were 1M+ EB GC applications as of March 2007 (when Ombudsman's report was written). There will be 1M additional applications by Aug 17 2007.
Lets assume a very conservative #: 1.4M by Aug 17. Then, 1.4M/140K = 10 years minimum.
