If it was EB2, you have better chance of winning lotto than get EB2 approved with 3 year degree. I had 3yrs + PG Diploma + 6 Years of Indian Experience + 13 Years of US experience and I was never able to cross the labor certification hurdle. BTW, I tried 2 times.
There is a little chance if you had 3+2 years degree and the labor was looking for Bachelor�s and would accept equalent foreign degree as evaluated by reputed firm. I believe your diploma was the hurdle.

Does any one know how mant days it takes to get denail notive .I-140 denied on April 22 and says notice mailed but didnt recieve yet .Both emploter and attorney havent recieved any thing yet .Is this Normal ?
You should call USCIS to let them know that your notice is still not reached to you, so incase if it's stuck on the way, they could send another copy.

Hello Folks,
I am on H1-B since Aug2009 and last year I transferred around 40K USD to parents. All these transfers were spread over the year in the denominations of 5K per transaction.(As and when I saved money).
My question is, do I have to pay taxes in US on this money transferred to India. I know that my parents don't have to but I am not sure about myself.
Any pointers in this regard will be highly appreciated. Thanks,

That is because I see lot of kids come to "what was the name again" schools with megre or no GRE scores just to land here once they get to OPT they get 8 - 10 yrs of experience out of nowhere and they are out in the job market. I can spend all day writing about them, the school and the quality of education but it is not going to do any difference.

What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?

Your question is not clear but when you say I-94 I assume you mean the I-94 that you got the last time you entered the country, right? The expiration date on that has nothing to do with your status as long you have an approved I-797 for your H1B extension till April 2008. You are in status till that time.
But you do need an unexpired Visa stamp on your passport if you leave the country and want to come back to the US.
So the way I see it, even after filing 485 you will continue to be in status till April 2008 and then I am sure you will extend that for another term if your I-485 is still pending.
As for going to Canada to get a new I-94, it may not work because they do not make you surrender your old I-94 when you go to Canada and so therefore do not issue a new I94 when you return after a short trip to Canada.

I wonder the reasons for Switzerland to be #1. Its a small country with minimal immigration and not much resources. Key revenue might be from Tourism. They are not known for scientific work etc.
... Maybe swiss bank accounts are key to it ! ;)
One big plus for Switzerland: their universities and advancement in technology.
Both ETH and EPFL in switzerland are THE TOP institutes in Europe for advanced technical degrees. Also, in the past 3-4 years, they have undertaken a huge initiative to invite the creme de la creme from around the world to switzerland, and looks like that is also paying off. Every professor/scientist/PhD I know would gladly accept a chance to go there!
So, Im not surprised that they are number 1. They strategized.. and they got exactly where they were trying to get! Whereas here, they got stuck mixing up illegals and skilled people, addressing fencing issues instead of labor backlogs, etc etc...and lost sight of a bigger, more valuable goal.

I signed the G-28 for 485, EAD & AP. Attorney received the receipt notices for all and he just emailed the case no(s) and A #.
When I ask him to mail me the receipt notices, he says its not their general practice to send them to clients and they are really not useful when I start getting the FP notice etc...This is really weird!
Folks - Is it possible to get a copy of the receipt notices by calling USCIS?

That's correct, employer cannot withdraw I-140 after I-485 has been pending for 180 days. Also, even if I-140 is not approved after 180 days, it can be ported to a different employer, provided that the original I-140 was approvable. Ability to pay in that case is determined based on the original company's ability to pay.

You may actually work for any employer in the meantime, provided, you have proper authorization.

You wont be watching the visa bulletin after 12 years as by then you have got you GC or you are back in your home country since your patience would run off by then.
Whatever be the case, its better to forget keeping a track of when the Visa "sad News" Bulletin is going to come and predict.

My PD is Feb 2004, so I've been current for almost 2 months now. Though, my ND is 9/12/2007 and NSC is processing 7/14/2007, so that's not current yet...
Receipt date and not notice date is the factor.
Also, NSC has been processing even people with October notice dates and appoved people with current PDs.

I am checking with different attorneys, and might change from my current attorney as he is totally useless. He opened a SR for me, and everytime I call him, he tells me to wait for 30 days.
I have taken Infopass, met the local senator, opened SR and nothing worked. Any ideas on what can be done next?
I went through this last year in August and September. Nothing happened, instead I got a reply in October (by that time my PD was not current), telling me that my PD was not current. They entirely ignored what I had expressed. Nothing can be done to bring results in 13 days. In any case, visas may have already exhausted, however, new visas will be available in October, so there is some hope.
Why cases seemingly work in random?
(i) Work is given out in lots. For example cases 1-100 are given to A, and 101-200 to B. Both begin to work at the same time. Cases 101 gets processed much earlier than case 100. It is possible that by the time case 90 is touched, all visas are gone, so cases 91-100 are left high and dry.
(ii) Receipt date is controvercial. Centers don't care when USCIS got your case. Each center cares when they (the centers) got the case. So for them, receive date is when the center received (which means opened and entered) your case. That's why true receive date is close to ND.
(iii) IO working on a lot suddenly falls sick, and goes away leaving his lot at his desk. Visas are used by other IO's
(iv) A file slipped out to behind the desk, and the case remains pending for a very long time.
