How does one get to know if his Labor Substitution was rejected? If a Receipt Notice was received does that mean that it was accepted? And, can they reject it later?

I finally heard back something from my Senator's office. He sent me an email from USCIS stating that my FBI check was clear but that I needed new fingerprints as the first set had expired. The email also said that she would request a fingerprinting appt for me which should happen after 30-60 days and once I got fingerprinted the Senators office can contact her so that she can expedite with the I 485 supervisor.
Now my question is should I waoit for her to trigger the 2nd fingerprinting notice, or should I just take an Infopass and try to get them scheduled ? I mean should I really wait 30-60 days just for a fingerprint request (assuming they remember to send one) or can I proactively request it to save time.
Would appreciate a response ?

I never said 80,000 FB visas are reserved for EB. Then those numbers would not be called as FB visas, would they?
Any way, if you look at the statistics (page 52, http://www.dhs.gov/xlibrary/assets/CISOMB_Annual_Report_2007.pdf), USCIS has not fully utilized all available EB visas for 12 years out of the 15 years. So why isnt EB3 India moving at all ?
Even bigger news is that "Other Workers" have become Unavailable for the whole world.
It furthers strengthens the theory that good number of 245i's are EW category and not in the regular EB3 category.
This hypothesis is further supported by the fact that all EB3 dates have been sustained above May 1st for a few months now.

I don't think it is the CP filers' fault.
...
But, I agree that the requests by the original poster should not be a part of IV's letter campaign.
Everything else will then just follow...
And hopefully no more waiting for mid of the month bulletin updates :-) and years and years of restricted choices due to ongoing GC...

My other thought is for July 2007 485 filer, 180 days is already completed. Assume the namecheck started on Aug 2007....
NSC is curretly processing EB I-485 cases filed before July 30, 2007. TSC - cases filed before April 10, 2007. So according to the USCIS policy: "If at any point your case should become more than 30 days outside our normal processing time, and you haven't received a written decision or update from us within the last 60 days, you can help us by calling customer service and letting us know. We will research your case, see what needs to be done to get it processed, and get back to you with an explanation."
I.e. NSC cases filed before July 1st are considered outside of processing time. The USCIS explains it in the latest name check FAQ posted today.

It looks like NSC has slowed down a bit on EAD processing. I am seeing many posts where folks e-filed their EAD renewals in the 1st week of July 2008 and are still waiting for the FP appointments notice.

E-filed on May 5th, FP on June 6th, no updates since. Concerned as I'm working on EAD and current one expires August 29th.
Paper filed AP in late June, approved already (as per e-mail) even though I only needed it in mid October!!

Sure, why not. An immigrant who is not in valid status is one who is legally not allowed to be in the country. Therefore he is a security threat. If somebody who should not be allowed in your house were in your house, you would consider him to be a security threat, wouldn't you? Am I missing something here?

I am going to India via Franfurt next week.
I have AP with visa expired.
I saw the following document on German Consulate - New Delhi. http://www.new-delhi.diplo.de/contentblob/1827030/Daten/857105/DD_Airport_Transit_A.pdf
It says:
- a valid residence permit or visa for the USA, Japan, and Canada
- An Airport Transit Visa is not required for holders of valid visa issued by
Bulgaria, Romania, Cyprus, Ireland, United Kingdom, Canada, Japan or
the USA irrespective of the travel destination.
I have a Canadian Visitor Visa. Do you think I will need Airport Transit Visa or I am reading it wrong?

Sorry, I did not raise my arm to indicate that it was ALL sarcasm. Durbin is aginst H1B. Although his press release says that he is not against green cards, but thats just bull.
And if he is appointed Labor Secretary, that will be the last straw to break the camel's back.

I'm sorry to hear this...Its happened...
if you really wanna bring your employer to lime light..prepare yourself..first....Remember..its your life here...anyone[including me) can give free suggestion here ....
There is no use working with this kind of Employer anymore...so my advice is switch to another employer[Good One] before you react to this...Make sure you pretend as if you are not aware of this and get the best out of him before you leave...once you r done...then show who is he to the outside world...
I'm sure you be having atleast mail proof...[If not ditch the plan of suing and move on with your next opportunity]....take some time and prepare all the possible proof...hire a good lawyer....File a case against the attorney in the local law chamber where the attorney is practising....they will definely call you to settle the case...make sure you record it as the proof[if you don't have one already ::)].....
Then hit the employer...make sure you ask a collosal sum through your attorney[Never give chances]....and then post his name and details in the Immigration blogs....
You lost one of the major milestone in your life...never give up this time....
