Guys - I have 2 sets of questions:
1. Case 1: Re-enter on AP with a valid H1-B visa till Oct 2010 (not stamped in Passport though). What status do I have (AOS or H1-B)? This is assuming that I work for the same GC sponsoring employer. I currently have 3 copies of AP (and 3 for my wife) - will I have to turn in all 3 of them at the POE? I have read that the Immigration Officers keep 2 of the 3 APs and return one back to you. The I-94 is stamped for 1 year - what do I do after a year? Do I have to renew my AP every year to maintain my status in the US?

Look at this part of Wall Street Journal :
Look at this. Even when the conversation if totally on "high-killed workers", there is always and has to be always, a line or a sentence about illegal immigrants. Somehow, you cannot discuss anything about anything unless you have one line about illegal immigrants. The only sensible reason to discuss illegal immigration in same topic as "attract and retain" the "high-skilled workers" is that if there are people who are high-skilled, need to be "attracted and retained" and also happen to be "illegal".
So folks, look around yourself, do you find anyone who is "high skilled", "illegal" and also need better laws to be "attraced and retained". NASA folks and folks from silicon valley, please check the cubicle next to you to find an illegal rocket scientist or an undocumented microchip designer. To add to this point. This is AFTER the implosion of CIR on the Senate floor. CIR was supposed to be the reason issues around legal highly skilled immigration were deferred.
So, after deferral, implosion of CIR, we yet get a line clumping these two. It is almost like a nicotine addict trying to break the habit. Media can be so close minded.
All I can say is what IV has done to try to separate these two issues, is nothing short of herculean. Now atleast we are seeing some semblance of a separation. I think the Rally in DC was a highly significant moment in this regard. I am also pleasantly surprised to see as much attention given to the immigrant visa issue (ie green cards) as was to the rest of it. Previously highly skilled immigration was thought to be tantamount to H1b visas. The issue of permanent green cards was a footnote.

Like you I had been waiting since 2005 (when my labor and I 140 got approved) for my PD to be current. Now that its been current since October 1, 2008 and even had been current in few months in early 2008 I realize that its just one more wait.
Nothing is going top happen by increasing quota unless USCIS speeeds up processing and decised to process based on a documented criteia (right now its completely random as TSC and NSC are out of synch and neither seems to follow any sequence of PD, ND or RD).
Me and others like me have been waiting since 2001 and we are still stuck even though PD is current. We have a special thread for us who are pre OCt 2001 PD and are still waiting. So if anything focus on getting USCIS to process orderly and efficiently. If you increase quota but dont change USCIS behaviour you will be worse off.

I have been doing the same research for the past one month, here is my experience.
1. Termlife Vs Wholelife.
Term is better than whole life. Instead of going with whole life, you can have Term + Saving account. For example, if you need $500/year for term and $2500/year for whole life. Take the Term insurnace and pay $500/year, open a saving account and deposit $2000/year ($2500 - $500).
2. You can compare the different life insurance with ratings. http://www.term4sale.com/
3. No life insurance for H1 (non-immigrant)
I have talked to WesternSouthern and Metlife agents. WS does not offer Life insurance for H1 but Metlife offer life insurance provided that insured person must be working in the same company for last five years.
4. Insurance here (US) vs India
Term insurance in India is much higher than insurance here. I got the quote here for $500/year but for the same insurance amount, the LIC cost me Rs.80,000.00
5. Hidden items
Make sure, you understand all the hidden item when you take insurance from here(US) or India. If you (owner+beneficiary) take life insurance here, the insured person stays outside the country for long time (more than six weeks) and if the insured person dies then you can't claim.

and that is why we need contributions. as long people "don't believe" we don't succeed. it's up to you, it's your issue as much as mine. professionals cost a lot of money, and this thread is quibbling over 20 and 50 bucks. anyway who is the knight on the white horse coming to rescue us? it's just us buddy, and we have to do our best. i like your analytical thinking. we need you to join in and help. any number of volunteers is less imho...
.....if ppl want to contribute lesser amounts all they need to do is find some like minded friends pooling their resources and making it into a big one time contribution. I have tried to convince some of guys I know over here but to no avail....less said the better...also tried using the charm of a good bottle of scotch to do the job...no good.....but we need to keep trying......bickering will not lead us anywhere....

Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.
What are your thoughts, is it worth filing in EB2?

One intelligent posting amidst the cacophony. Keep it up. Sometime back one of the admin wrote about tightening the belt, holding on to ride this wave of market trouble. I wonder whether someone knowledgeable could create a thread (or add to one that exists) about this mess, mechanisms that led to it and how it is going to affect the slaves, pintos and the rest (of iV) in the next 12 months? An intelligent discussion for a change. While the Fed chairman reads the letters, emails and warnings from pintos, slaves and co. lounging by his swimming pool, sipping his martini (of course, according to the p, s & company, while market is burning), we can read something useful about the economy to prepare ourselves for the worst...

You have to understand derivatives and structured investment vehicles to understand what the economy is facing. The risk of sub prime CDO's has been spread thorough out the credit markets. Just imagine Bear Stearns which has a head quarters building in NYC worth $1 billion was sold for $236 Mil. Yankees pay A-Rod more than that. This will tell you how the valuation of derivatives has depleted cash flow and liquidity of a wall street titan which had stood through the great depression, 2 world wars, market crashes in the 1970's, 87, 01 and recessions in between.
Google "Long term Capital management (LTCM)" and study their history you will see what derivatives are capable of. Warren buffet calls derivatives "Financial instruments of mass destruction".
So the man is faced with such a mess, don’t insult his intelligence by making unwarranted statements.

Mindblowing. Do people really believe the Oct 2007 deadline? Haven't we seen many deadlines come and go? This is extrememly unfair to those stuck at BEC; don't go around spreading this impression that the BEC issue has been resolved.
If indeed the majority at IV believe that BEC is not a problem, then it would not be a stated goal of IV. Let me repeat, so long as it is listed as a goal, it is the moral responsibility of all of to support and work towards resolving the issue.
This is important. Don't just pretend to support IV and play down what matters to others. Your must support all the goals we have at IV and not pick and choose what you like.
Also please don't repeat the false logic of "labor certs will be taken care of by PERM." If that is the case why would we at IV have BEC resolution as a goal? The least you can do it not try to dilute the seriousness of the BEC issue, even if you don't care much about the problem.

IV has had a number of discussions with lawmakers and administrative officials, first to understand the issue and next to solve it. From our discussions, it has become clear that the lawmakers still view this as a temporary problem and are not willing to legislate for getting any more into this. Never the less all of them did agree that the efficiency of the BECs left a lot to be desired. So we were working a bi-partisan coalition of lawmakers who were willing to put pressure on DOL and USCIS on the need for efficiency and transparency.
All of this was before the crazy pace with which the Comprehensive Immigration Bill began to move. We do have to realize that this bill is a golden chance to have our provisions in place and we have less than 2 weeks to works on it. Frist wants either of the Immigration Bills to be passed before Apr 7th. If we do miss out on our goals in this bill and this bill gets passed, we will not be able to revisit our issues for a long time. So right now a lot of the attention is being given to it. This does not mean that BEC is forgotten. Hope you do understand.

Let us say USCIS has unused visas, which they want to allocate and they have moved cutoff dates to Jun, 2006 for EB2, similarly Sep 03 for EB3.
My question is, will the visa issuance would be in the order of Priority Dates? or Notification Dates? Recently there has been lot of pressure on USCIS to issue processing results based on Priority Dates, will this force USCIS to correct its ways and issue visas based on Priority Dates.
I might have digressed a little bit on the topic of predicting cutoff dates but this question is lingering among all the IV folks who would be current or already current.

I am from India and I have worked in the USA for the last 6 years. I have immigrated to Canada with a Job 6 months back to avoid overystaying. My experience in Canada is very bad. I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.
Which part of Canada are you talking about ? you may be right about the difficulty in finding jobs, but the "politeness" and "racism" part I just dont understand. From my experience of canada (BC and ontario) I can say on the whole people there were much more polite and helpful than anywhere in the US. As for racism, it exists in every country - even in the US, especially in rural areas of the south.

How about tourist visa? you can get multiple entry for 10 years, but I guess no of months you can stay in India is a question. I am applying for my son too, both of us hold Indian passport, what you guys suggest? go for OCI?

Why the bloody hell are you guys judging him for what he has done? He only asked for some advise regarding immigration implications of his situation.
I do not think any of you who is beating him down like this has any right in doing so. I bet that each and every one of you have done more mistakes than Mr.Sahaayam did. You just were never caught. You must have done more filthy things than 'shop lifting'. I'm sure you have all lusted after women, watched porn, frequented strip clubs and drank a lot of filth. Some of you might have slept with more than one woman.
Don't you think these are more filthy than shoplifting? Guys come on! I would not have any problem if one of you who has never committed any mistakes in life would point out other people's mistakes. But none of you are good enough.

Is there any law stating you can not sleep with more than one woman and can not apply for GC� or anyone here who slept with more than one woman pleading guilty and asking for help?
Accidents do happen. But if you intentionally did something and trying to blame others without any shame� No one forced him to steal at gun point or he was not starving or life or death situation here. There is no regret or remorse from him for what he has done. His only point is others are lucky and not getting caught but only he is. I guess that�s what infuriating every one here.
