These assumptions marked in red are incorrect. ROW has been consolidated into 1 category to simplify the visa bulletin. ICMP countries exceed the quota, that's why they have separate entries. If another country exceeds the quota U.K. for example, then it'll have it own column in the visa bulletin. The quota for EB-ROW is 40K - per country limit for ICMP for that category X 4. That's why EB3 India has been getting screwed ever since they re-interpreted the spillover rules (in the middle of 2008). Otherwise, you would see EB3 ICMP get at least 8K GCs in 2009.
1) Each (EB1/2/3) - 28.6% WW quota = 40040
2) 5 subscription cataegories under each EB category: I,P,C,M,ROW
) Assumption - USCIS distributes equal share amon3g these 5 different subscription categories = 40040/5 =8008 in each EB category for a particular subscription category.
Example:
EB3 All = 40040 ( 0.286 x 140000)
EB3 ALL = EB3 I + EB3 C + EB3 M + EB3 P + EB3 ROW

So, what made you import yourself here? You could have stayed back in your own country..by the way, coming on a H4 was a choice..it wasn't forced upon you...didn't you know before coming here that you would have to stay home on a H4? H4->F1, H4->H1...all these options are always open to you..

Some IV members were in DC at USCIS building yesterday (Tuesday, July 10th, 2007) from 10 AM to 1 PM. There were reporters there including CNN-IBN and Voice of America (Aaj Tak chanel) with video cameras. We saw the deliveries of flowers being made by UPS and FedEx. The DHL guy told the flowers were already delivered in the morning in the big truck. The security guards at the loading dock of USCIS were not allowing Video Shooting after the reporters shot the UPS deliveries going inside. When the FedEx tuck came in, they made him park right near the Loading Gate and were trying to cover up by parking two other vans each side of that truck so nobody can shoot the delivery.
Then IV members went inside the USCIS building from the main gate to hand deliver the flowers with Get Well Soon ballon and card for Emilio Gozales. Teh Video cameras followed until the security guard asked them to stop the recording as they didn't have prior approval. The security guards, receptionists and people around were smiling by seeing the flowers for Gonzales. They let the IV members proceed towards the visitor area. Where another secuirity guard asked who the delivery was for and directed to one of the Gonzales's secretaries, Rachel, who accepted the flowers. There were people around her. Rachel said to them "This is creepy, as far as I know he ain't sick, we received flowers last week, they were pretty too. Yesterday someone sent him cookies. This is some kind of peaceful protest". Then she also read the card in front of IV members. IV members asked her about the website update which says they are sending these flowers to Walter Reed. She said yes, we are doing that. IV members thanked her and left the building.
On the other side, the reporters with cameras were asking for approval to shoot inside. They made them wait and then several people (from different level of securityty to management) came to talk with them and finally said they can not allow to shoot for security reasons. Can you please further explain how the visa flow will work if instead of horizontal flow it is made vertical flow... or you have some other interpretation?

Yes, the old system will be restored. Please note that this is the only sure fire way of EB3-I going forward. There is some comments that EB3-I can really only benefit if EB2-I goes current with the current horizontal spill over rules. Such statements are clearly misleading. Eb3-I will not directly be impacted by EB2-I being current. It just allows EB3 to get a lot of numbers which will first be used by EB3-ROW before spilling over into EB3-I.
With this change, we get EB3ROW move ahead faster, it probably would have been C had the rules been followed, and EB3 would have started moving ahead.
The only way for EB3 to move ahead is for EB3-ROW to become current, nothing else will help EB3 beyond the visa recapture (which is iffy at best). If we get USCIS to follow rules, this happens sooner, and EB3-I starts to move sooner. If not, EB3-I shall wait for a long time.

cir failed because the senate did not have a filibuster proof majority (60) to pass cir. This time the democrats are expected to gain 4 to 5 seats in the senate, that will take there majority to 54 or 55 from the current 50 (49 +liberman). With a majority of 54 or 55 the filibuster will not happen again in senate and cir will pass in the senate.

We wasted lot of time, money and effort with this 485 filing for the last 15 days. I am terribly disappointed with the outcome now.
We need to file a lawsuit against USCIS and Dept of State for the loss that has happened to us.

Good suggestion, I didn't ask about EAD, I will check next time. But I guess evantually EAD would be revoked after I485 is denied. I think H1 is a backup plan if MTR denied and till appeal is decided..

on a different note, how is the Kolkata consulate doing on PIMS aspect ... am planning for a visit back home and need to go for visa stamp as well - last stamp expired ...

He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.
If anyone come across in this situation then please reply to my question.

I also did googling.. but couldn't get fax# or email of Director @ NSC [GERALD HEINAUER]. It seems not avialble in public domain.

Yes, I mean EB5. Another not, DOS/CIS waited till now as it takes some months to get a trend, as it seems CIS is cracking down on EB1C since later last year, and it took some time to see EB1 usage fall off and is plateauing now.
I wish 12K is for 6 months only, and that 24K total this year will surely clear all pre-07/2007 EB2 I/C. However, it seems as unlikely, I looked at historic EB1 approvals on DOS statistics page, EB1 has about 40K quota, their usage

2006 24K

2008 39K
2009 42K
2010 41K
So even if we think all surge after 2006 is due to abuse use of EB1C of india bodyshops, EB1 will still use about 24K, which left about 16K for EB2. I am sure those bodyshop ppl will apply under EB2 now, and I hate to say, but EB2 after 07/2007 seems still a daunting task, only visa recapture will help.
