Hello all
I am a silent visitor of this website.
Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????
My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

The following information is asked in the first field of ETA form 9089.
"1. Are you seeking to utilize the filing date for a previously submitted application for Alien Employemnt Certification (ETA 750)?"
"1-A. If Yes, enter the previous filing date"
"2-A. "Indicate the previous SWA or local offiice case number OR, if not available, specify the state where case was originally filed:"
The reason for that question in the form 9089 was to give an opportunity to convert the old labor applications rotting in the Backlog Elimination Centers to PERM, when PERM was first introduced in Mar '05. AFAIK, this has got nothing to do with porting the PD. PD porting can be requested while filing the second I-140 after the new EB-2 perm labor has been approved. You don't have to disclose anything while in PERM phase.

Wife: EB3(04/2002 SUBSTITUTION) Pending I-140

"Many people are in your scenario.
There are many ways to do this. Each one being a little more expensive then others.
What can be done:
Your wife files as primary and you secondary on her 140.
You file as primary and her secondary on your 140.
Option #2
You file alone on your 140
She files alone on her 140.
Somehow if the dates should move backwards and her 140 on labor substitution should get denied (you never know with labor sub); then for her to file on your 140 the date has to be current or she canʼt file until it becomes current.
You and her just file on her 140. Problem is if the 140 gets denied then the window of opportunity to file the 485 again may not be for a couple of years.

If you want to be safe and want to spend more money then she would file as primary on her 140 and you as dependent. Then at same time we would file you as primary on your 140 and her as dependent on your 140.

Or, you can hedge your bets by each filing as your own primary because if one of the cases falls into a problem, the person can switch to be a derivative, but could run into a problem if there were not current priority dates at the time. But, so long as your both remain in H-1B status, and not use EAD/AP, that is minimized"

Ganguteli, why do you keep on questioning everybody's intentions all the time. the other day, I had posted about L1 exploiting the loop to file GC in EB1 and your answer was plainly stupid and irritating - "I would have done the same thing if I had a chance"....
There is nothing wrong in exposing any kind of visa fraud...I came here on F1 10 years back and still in line for GC after getting masters from a decent school and working with major employers. What is wrong in making sure that it is FIFO....
It is not just Gantuteli doing this. Almost every other poster on this board seems to be doing the same. Any opinion expressed against the visa fraud perpetrated by these outsourcing cos is met with derision, ridicule and contempt. Of course, the poster is immediately labelled as an anti immigrant or a tunnel rat.
Why do the posters have to resort to ad hominem arguments ? Why dont posters consider the merits/demerits of an argument and then provide civil responses ? In my opinion even if anti immigration activitists, barring the racists, post arguments or views, those views need to be considered on due merits. I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
Having a house in this market has become a pain as it has made me immobile with respect to good job offers.

How about we create a video. Take parts of this (http://www.comedycentral.com/motherload/?lnk=v&ml_video=89349) from the daily show. Take parts from the 60 minutes and read out from the NY Times article etc.

If it is not mistake you are thinking as Conspiracy. What is the motive of conspiracy? What I am telling is making all PD current was mistake as everyone will expect atleast 300k I485 applications and that many Visa was not available. They made another mistake to correct previous mistake. There is no pro or anti immigrant stand is needed to evaluate this. I do not believe conspiracy theories. Even 9/11 attack also so many conspiracy thories are there. Unless we get some evidence everything is speculative only

It is rather unfortunate that people on consular process track despite the fact that they have approved I-140, yet they couldn't be allocated visa while other people on adjustment process could file their I-485 when everybody PD became current. don't you think it is rather unfortunate.

My colleagues and friends are sending e-mails to Judiciary committee members. I am preparing draft for this mail. I am going to divide this mail into sections. One section describing what H.R. 5882 is (recapture, justice against discriminatory treatment based on country of birth, USCIS efficiency) and another sections would describe what it is not (not amnesty, not an increase in numbers). Yes ndialani,i waited for 6 month which i did because i don't know I140 premium started from June 2009(For most the cases).They started in Feb 2009 but its applicable to some limited cases).
May be i would have moved it to premium if i knew in June.Some of the options which i would have tried during that 6 months period was InfoPass,Senator,Ombudsman etc but wasn't very serious about 140 as i thought it may take some years for gc(since the dates very moving very slowly at that time).

+ve skin test does not mean anything.
You can be +ve if
1. If you ever had TB
2. If you ever had TB medication
3. If you ever had TB Vaccination
If you are +ve, you need to do chest x-ray to verify whether you have TB or not. Tell your doc for chest x-ray. For me, I knew I will be +ve and so I told my doc for x-ray at the first time and did not have skin test.
I Got Positive Skin Test. What Should I Do Now? Please Inform Me.

Called one more time using the POJ method to NSC... This was probably the most fruitful call to NSC in the last 7-8 odd times i have called them.
Someone called Terry answered the call... Hats off to this lady...If there is a way i would want to recommend this lady for a promotion and make her the project manager for all the rest of the IOs who answer the call!!!
My case PD is 1/15/05, filed at TSC, transferred to NSC in Mar 08, applied AC 21 in Aug 08 and did biometrics in Feb 09.
Information i received on my case from this call:
1. This lady got my receipt#, checked details and history on my case, let me know that the case is preadjudicated (she defined preadjudication before that)
2. and then, told me that the case is NOT in storage area.
3. She mentioned that preadjudicated cases are held in an area called exams area and my case is currently on its way from exams area back to the officer who had preadjudicated my case earlier in Oct 2008.
4. She then checked my wife's file to see if that is also with my case just to make sure that file is not lost etc and confirmed that both files are together.
5. She also mentioned that nothing else needs to be done right now for my case as it is already on its way back to IO.
